Abstract: A plaintiff can recover as damages for the negligence of the defendant compensation for
resulting damage only if that damage could have been foreseen by a reasonable man. It is not enough that the
damage was a direct consequence of the negligent act. By the negligence of the defendant's servants large quant-
ities of oil escaped into a harbour. The oil spread to a wharf owned by the plaintiff where, some floating cotton
waste acting as a wick, it was ignited by hot metal falling from oxy-acetylene welding there carried on. The fire
spread to the wharf and the equipment on it. The trial judge found that the plaintiff did not know, and could not
reasonably be expected to have known, that the floating oil could be set alight, but that the damage to the wharf
and equipment was a direct result of the escape of the oil.
