 Every producer of fruits who requires distilling the fruit ferment to distillate is obliged to fill in the
ORDER-DECLARATION for processing the fruit ferment to distillate.
 Distillery keeper is obliged to check personal data in this declaration.
 Production date runs from 1.7. of current year until 30.6. of the year which follows this current year.
 Fruit producer and persons who live in common household can distillate the maximum quantity of 30
litres of absolute spirit (ethanol).
 If it it necessary to take ferments from more fruit producers together to one distilling batch (technology
reasons) so these producers have to make an agreement about the quantity of their ferments and
distillate as well. Fruit ferment is collected to fermentative containers from which is final ferment
pumped over to distillery. Distilling increment is converted to kg of delivered fruit ferments by
particular producers. It is not possible to collect the ferments from different kinds of fruits. The
distillery do not accept for distilling ferments in metal plate containers which have influence to taste
and smell of distillate and of course the final distillate quality. The distillery also do not accept the fruit
ferments which contains added suggar. Fruit producer is obliged to take away the ferment containers
immediately after the distilling process is finished. The distillery do not guarantee for loss or change of
containers in which the fruit ferment was delivered.
 Distillery keeper can refuse distilling the ferments which shows bad technology of fermentative process
(appearance, smell) and which can cause danger of bad quality of the following distillates.
 Fruit producer is obliged to take the final distillate and pay cash consumption tax and surcharge for
distilling. Amount of consumption tax and surcharge for distilling are hanged up at visible place in
distillery.
 In case that fruit producer don´t pay the tax and surcharge the distillate will be transferred to bound
store and will be given over to produer after the payment. If fruit producer do not take the distillate
within current production year the distillate will be destroyed with assistance of distillery keeper and
employee of revenue authority.
 Fruit producers can stay in reserved place during the distilling process. They are not allowed to come
near to mechanical device, interfere with technology procedure or staying in operating area. Without
asking they are also not allowed to help with assistant works. Distillery keeper doesn´t guarantee their
safety. Drinking of alcoholic drinks in operating area is prohibited.
 Distillate tasting in the smallest possible quantity is only possible for sense evaluation. Before sense
evaluation of produced distillate is tasting prohibited.
 According to § 4, chapter. 5 law No. 61/1997 Sb. and its following regulations the fruit producer and
persons who live in common household are not allowed to sell the distillate. Produced distillate is for
their own consumption only.
 Fruit producers have to ensure their own transport containers for produced distillate.
 It is also possible to deliver the distillate including the bottles and caps according to displayed valid
price list of distillery.
 Fruit producer is competent to check the quality of distillate, its alcohol content and quantity and
detected faults has to immediately inform about. Claims are solved immediately in distillery. After
delivery the distillate it is not possible to claim the goods and its quantity.
 Fruit producer is obliged to check the money-back after the cash payment. Later claim is not possible.
 Distillate samples taken from alcoholometer are destroyed by employee of revenue authority with
attendance of keeper of distillery.
 Fruit producer is obliged to take off the stillage otherwise he will be charged for transport and disposal.

Distillery keeper is obliged to issue the documents which confirm production of distillate, payment of
consumption tax and distillery surcharge. Fruit producer is obliged to sign these documents. Copies of
these documents remains in distillery.
