Existing Use Description: The existing Special Use Permit allows an equestrian establishment for the
boarding, training, and breeding of horses, to include riding lessons,
accessory structures, and a business identification sign on an 11.77 acre
parcel. Refer to attached Special Use Permit PSP 08-083 (Appendix “A”).
Note that public events are not approved under the existing Special Use
Permit.

Proposed Project
Description: Property owners propose to add an office building of approximately 1,300 SF
including laundry and restroom facilities.

Because the site plan will be changed, a Minor Modification is required to be


filed with the County of Tulare (application attached in Appendix “B”).

The application fee for a Minor Modification is $708 and the time required to
process the application is 4-6 weeks from date of filing.

Timeline: The site plan modification drawing can be completed in two (2) weeks.

While the Minor Modification is under review, design of the new office building
may proceed.

Next Steps
As you can see from the estimated project timeline – nothing happens quickly in the construction industry when approvals are
required. The total time estimate of 10 months for the project is reasonable based upon my experience of similar projects.

The first step in the approval process is the filing of the “Minor Modification” with the County of Tulare. For this filing you will need an
updated site plan showing the proposed location of the new office building. If all goes well, the “Minor Modification” will be approved
in 6 weeks by the County of Tulare.

To save time, the design of the project can proceed during the time the county is reviewing the “Minor Modification”.

In terms of construction cost: $180 per square foot is a good rule of thumb number to give us an estimated construction budget. With
a total project square footage of 1,300 sf, we get an estimated construction budget of $234,000. Design fees can be estimated as 8%
of construction cost for a total of roughly $19,000. This gives us a total estimated project cost of $275,000 +/- 20% (includes
contingency fund). Note that these numbers are very rough estimates to give you a general idea of total project cost. During the
design process we can firm up these numbers (and modify the design to fit your desired budget).

The immediate next step is to prepare a revised site plan and submit it to the County. My fee to prepare and submit the application
(including the site plan) is $1,800 (the $500 fee you’ve already paid will be credited to this amount). This includes preparing the
revised site plan (generating a new CAD drawing), collecting the necessary paperwork for the application, and submitting it to the
County of Tulare.

Additionally, $708 is payable to the County of Tulare for the processing of the “Minor Modification” application.

Time to approval: 8 weeks (2 weeks to prepare site plan and 6


weeks for County approval)

During Minor Modification approval process: I will solicit proposals from my sub-consultants (electrical and
structural) to provide a total design fee and timeline for the
project. Upon approval by you we will commence design of the
project per the above timeline.

Existing Special Use Permit
BEFORE THE PLANNING COMMISSION

COUNTY OF TULARE, STATE OF CALIFORNIA

IN THE MATTER OF SPECIAL USE PERMIT )

Resolution of the Planning Commission of the County of Tulare approving a


Special Use Permit/Final Site Plan requested by Pedrito M. Morales, 37997 Millwood
Drive, Woodlake, CA 93286, to allow an equestrian establishment for the boarding,
training, and breeding of horses, to include riding lessons, accessory structures, and a
business identification sign on an 11.77-acre parcel in the PD-F-M (Planned Development
- Foothill Combining - Special Mobilehome) Zone, on property located on the west side
of Millwood Drive (State Route 245), at the intersection of Avenue 380 and Millwood
Drive, north of Elderwood.

WHEREAS, an application has been filed pursuant to the regulations contained in


Section 16 of Ordinance No. 352, the Zoning Ordinance, and

WHEREAS, the Planning Commission has given notice of its intention to consider
the granting of a Special Use Permit as provided in Section 18 of said Ordinance No. 352
and as provided in Section 65905 of the Government Code of the State of California, and

WHEREAS, Staff has performed necessary investigations, prepared a written


report (made a part hereof), and recommended approval of this application subject to
conditions, and

WHEREAS, public hearings were held and an opportunity for public testimony was
provided at regular meetings of the Planning Commission on December 17, 2008, and
February 25, 2009, and

WHEREAS, at those meetings of the Planning Commission public testimony was


received and recorded from Heather Pelham, applicant's representative, in support of the
proposal and Gary Davis, Mike Moberley, Lou Gligorljevic, Marily Reese, and Vincent
lngrao spoke in opposition to the proposal.

NOW, THEREFORE, BE IT RESOLVED as follows:

MINOR MODIFICATION APPLICATION

REQUIREMENTS, FEES AND INSTRUCTIONS (Please use dark blue or black ink)
The application form must be filled out completely and in every respect with all questions answered and all
required attachments before the County can officially accept the application for processing. In the course
of accepting and processing the application, the Permit Center Official or Planner may ask the applicant to
clarify, correct or otherwise supplement the required information. The application may be filed with the
Resource Management Agency Permit Center, at 5961 S. Mooney Blvd., Visalia CA 93277. Phone

The Ordinance Code of Tulare County requires filing fees to be paid at the time of filing an application for a
minor modification. The required fees are to cover the cost to the County for the handling and processing
of the application.

The application for a minor modification must be accompanied by a minimum of three (3) full-sized 24”x26”
copies of the revised site plan and two (2) reduced-size 8½" x 11" copies. All revised site plans must
clearly show the existing plan as approved and the proposed modification(s) and must comply with all the
requirements that apply to the previously approved Special Use Permits, Planned Unit Developments, and
Planned Developments under the Tulare County Ordinance. The Site Plan must be a clear and accurate
drawing of suitable size showing the following:
a. Parcel dimensions (in feet)
b. Parcel/site location with respect to adjacent roads
c. Location of all existing and proposed above and below ground development improvements, including
any type of buildings, septic systems, wells, etc. (designate whether existing or proposed modification)
d. The distances (in feet) between existing and proposed development improvements, including distances
from buildings to the closest property boundary
e. Clear and accurate drawing of what is existing and what is proposed for modification

MINOR MODIFICATIONS-DIRECTOR’S APPROVAL
The Planning Commission or Board of Supervisors, as part of any action approving a special use permit,
variance, Planned Unit Development (Section 18.5) or Planned Development (Section 18.6), may include
in said approval a delegation to the Planning Director of authority to approve, without notice or hearing,
minor modifications to the site development plan approved by the Planning Commission, Board of
Supervisors or Zoning Administrator for the special use permit, variance, Planned Unit Development or
Planned Development, provided that any minor modification shall not substantially change or alter the use
approved or conditions imposed. If such authority is delegated by the Planning Commission or Board of
Supervisors, the applicant may apply to the Planning Director for a minor modification upon the form of
application required by the Director and upon payment of the application fee set forth herein. Such
modifications shall be noted on the approved plans and shall be initialed by the Director. The Planning
Director shall not, however, approve minor modifications in approved site development plans that would
modify any written conditions of approval without first requesting the body which took final action on the
use permit, variance, Planned Unit Development or Planned Development to determine if such change
constitutes a minor modification. If said body determines by resolution that such a change constitutes a
minor modification, the requested change may be approved by the Planning Director as provided in this
Section. If the requested minor modification is disapproved by the Planning Director, the applicant may
file for an amendment to the use permit, variance, Planned Unit Development or Planned Development.
