 Green Burial option
available in Nelson?
In June the Nelson End of Life Society presented to Coun-
cil the possibility of a green burial option at the Nelson
Cemetery. It was well received and is being investigated.
Green burials were started in Britain in the 1990s and
soon spread to North America. This initiative is being
driven by the baby boomers who have a high interest
in environmental responsibility. At present the choice is
cremation, which consumes huge amounts of energy for
each body and adds many toxic chemicals to the atmo-
sphere or traditional burial which often adds embalming
fluid, steel and concrete to the earth.
The Green Burial Society of Canada has criteria to meet
the green burial standard. They are no embalming, direct
earth burial in a biodegradable container or shroud, com-
munal memorialization (example: there are no individual
grave markers, but communal inscription on a boulder)
and subsequent planting of indigenous trees, shrubs and
plants. The intent is to optimize land use by integrating
the area with the local ecosystem.
The Public Works Dept is on board with this idea and
has suggested an area that may be appropriate. Currently
there is a bylaw in place which requires a fibre glass vault
for each grave and this needs to be amended.
Many communities in BC and across Canada are in
the process of providing this option as there is a high
demand. People are becoming aware of the possibility and
the benefits.

Ash is a sweet 1-year-old neutered male husky/shepherd cross
looking for an experienced and active guardian. He has a lot
of energy and is still a little raw training wise but is very smart
and eager to learn. Ash has lived peacefully with cats and dogs
previously, but he is not compatible with livestock. He is good
with people of all ages but tends to jump up and could knock
down small children. Ash is currently in foster care in Nelson but

Exciting new event for
KOOTENAY PRIDE
KOOTENAY PRIDE invites everyone to look for
another exciting new event at September PRIDE this year.
Organized by the volunteer, Michael Wicks, the event will
engage people with the history of LGBTQIA people in the
Kootenays, in BC and in Canada.
Michael said, “The PRIDE Archive POP UP (PAPU)
will happen in conjunction with other scheduled events,
and some stand-alone venues, giving an opportunity for
everyone attending PRIDE to access the materials, engage
with me and tell about their connection with the histori-
cal materials. We will also record conversations with peo-
ple if they wish, as they engage actively with this material.
That will bring an audio context to the archive.”
PAPU will include material from the 60s to the 90s;
gay liberation journals, newspapers, articles, brochures,
newsletters, rally posters, editorials, accounts of political
campaigns for liberation with setbacks and victories, Act
Up and Aids articles and the events at Celebration 90 Gay
Games, as well as Radical Faeries journals and newslet-
ters from different parts of BC. They will be popping up
everywhere you are during PRIDE 2018, Monday, August
27 through Monday, September 3.
Michael expects, “Locals, and the many visitors that
join us for PRIDE yearly will be very excited to look
through one particularly amazing collection put together
by Christopher Moore. It’s a complete picture and arti-
cle journal of the struggles of the gay people in Nelson
from 1991–1996 to simply put up a banner and have a
parade. It’s a record of how we stood up for simple human
expression and have developed that into one of the biggest
PRIDE Celebration in the South East of BC.”
Michael is requesting more materials in order to build
an even more extensive collection for the Touchstones
Art and History Museum Archive in Nelson, as well as for
inclusion into the BC Archives or the Canadian Archives.
KOOTENAY PRIDE seeks anyone who can contribute
material to enhance or build the local part of this archive
and has any history of the West Kootenay Gays and Lesbi-
ans, the earlier incarnation of KOOTENAY PRIDE.

FAIR SPOUSAL SUPPORT AGREEMENTS
ARE HARD TO CHANGE
When a marriage is over, both partners may
want to make a clean break and a fresh start.
One step toward this goal – with good legal
help – is to try and agree on the financial
aspects of the break-up, like property
division, child support and spousal support.
Our modern family law encourages such
agreements. They save court time and the
costs (financial and emotional) of going
to court. Importantly, having both former
partners “buy in” to the arrangement offers
the best hope that it will stick.
An example? A spousal support agreement
which says you will get periodic (say,
monthly) payments for a certain length of
time (e.g., three years) or a one-time fixed
lump sum payment. Such agreements
typically state they are meant as the final
word on spousal support.
Can you still get an agreement changed
later?
Rules under both the provincial Family Law
Act and the federal Divorce Act allow the
court to sometimes revisit such agreements.
The provincial and federal rules differ on
when a court will interfere. More often these
days, married couples, as well as common-
law partners treated as “spouses” under the
Family Law Act, turn to the provincial rules
when it comes to this.
It can be difficult to change an agreement,
however, if it is fair and consistent with the
objectives of the relevant statute.
Consider this recent case decided by B.C.’s
Court of Appeal, involving the Divorce Act.
Under this statute, the court will only
get involved if a “material change in
circumstances” occurs after you made the
agreement – and you and your ex didn’t
anticipate this change might happen when

who wants the agreement changed has to
prove there’s been such a material change in
circumstances.
Karen and Michael (names changed)
divorced after being married some 21 years.
Michael was a partner at a major accounting
firm. Karen contributed significantly to
his professional success while they were
married.
In 2008, the year after their break-up,
Michael and Karen settled all major
financial aspects of their divorce, including
division of property (over $2 million, split
equally between them), child support and
spousal support. To satisfy her spousal
support claim, Karen chose a one-time
lump sum payment of, ultimately, $411,000,
which Michael paid.
When they agreed to these arrangements,
Karen and Michael each had their own
lawyer, and Karen also had a financial
consultant helping her. The court noted
Michael had fully disclosed his financial
affairs (a big potential trouble spot in
coming to fair arrangements).
About five years later, Karen wanted the
agreement changed. She said Michael’s
annual earnings had gotten a lot higher
since the time of the agreement. She said
this was a material change.
But Karen didn’t prove that the possibility
of Michael making more money in future
wasn’t considered when the agreement was
made. In fact, it had been well understood
Michael’s income depended on his firm’s
earnings and would fluctuate (potentially
down as well as up).
So the spousal support agreement remained
valid, and the court didn’t change it.

It is with great sadness that we announce the
passing of Tim George Jmieff of Winlaw, BC.
Tim was born in 1936 to Polly and George
Jmieff, the elder brother to twin siblings Nellie
and Mike. He grew up on a farm along the Slo-
can River, chopping wood and carrying water
from a young age and helping his parents in the
garden, barn and hay field. Tim attended school
in Winlaw and Slocan and completed Grade 8
before going to work to help support his family.
He helped at Jones’ store in Winlaw, tried log-
ging, and worked at sawmills in New Denver and
Passmore before starting his career at the sawmill
in Slocan City in about 1966.
Over the course of over 40 years, he worked his
way from piling lumber and running the gang
saw to doing maintenance and equipment repair
on any and every machine in the mill. He was a
self- taught millwright who could fix anything,
and if he couldn’t fix a part, he would make a
new one from scratch in his metal shop at home.
Growing up on a farm with little money taught
Tim to do things himself. He learned to be re-
sourceful, using whatever junk or scrap was on
hand to keep vehicles and farm equipment run-
ning. He loved to read and learn from nonfiction
books and magazines—Popular Mechanics was
his favourite. He was passionate about trains,
tractors, steam locomotives and engines, and
went from reading about them to building work-
ing models in his workshop. Tim was so import-
ant to the running of the Slocan Mill that after
his retirement, he was asked back and worked
part-time for several years.
His neighbours and friends knew that whatever
mechanical problem they had, he could fix it. He
machined new parts that fit better than the old
ones. With careful patience, he shaved away hun-
dredths of a millimeter until the fit was perfect;
and he never charged friends and neighbours for
the work he did.
After finally retiring, Tim spent most of his time
at home, working in his metal shop, building
model steam engines and fixing machinery for
family and friends. He travelled with friends to
see railroad and mechanical museums in BC, Al-
berta and the US. He read extensively, and it was
not unusual for him to read a book a day when
winter weather forced him indoors.
Tim never married and did not have children,
but he treated his nephews and nieces as if they
were his own. He was a proud member of the
IWA union and a lifelong member of the Union
of Spiritual Communities of Christ. Tim was
predeceased by his father George in 1972 and
mother Polly in 2006. He is survived by brother
Mike Jmieff and sister-in-law Nina, sister Nellie
Keraiff, nephews Lucas Jmieff (Ginia) and Randy
Keraiff, nieces Natasha Jmieff (Neil Pereverzoff),
Karen Heddle (Curt), and Jackie Keraiff (Phil
Churchill), grand-nephews Nathan (Kayla) and
Justan Heddle (Jen), grand-niece Amber Chur-
chill, and five great-grand-nieces and nephews—
Harper, Daxx, Zane, Wilder and Violet. Tim will
be dearly missed by his family, friends, and by
those in the Slocan Valley community who knew
him. May he rest in peace.
The family wishes to thank all those who sup-
ported us during a difficult time and helped us
honour Tim’s request for a traditional Doukho-
bor funeral. We are grateful for the assistance
of funeral officiant Peter Relkoff, Bill Strelaeff
and staff at Castlegar Funeral Chapel, the Ap-
pledale Hall Society, the Slocan Valley cooks
and grave diggers, the singers, everyone who
brought squares and desserts, Ray Kosiancic
and Peter Barisoff for sharing their memories of
Tim, Mabel Kabatoff, Walter Malakoff and Sid
Salikin for sharing their music, Laura and JJ
Verigin for your kind words, and everyone else
who offered their condolences and support.

Slocan Family Fair Fun Day

A “Family Fair Fun Day” will be held on Sunday, Sep-
tember 2 at Expo Park in Slocan City. This event is held
each year by the Spirit Of Slocan Committee which is
made up of volunteers committed to implement various
projects designed to improve the appearance, quality of
life and spirit within the community. Our current project
is the landscaping and development around the cenotaph
site by the library on Harold Street.
Our Family Fair Fun Day will include a variety of activities
for young and old. Bring a chair and enjoy the live music at the
bandstand. There will be carpet bowling for the adults, artisans
market, food at the concession booth, kids games and races set
with a carnival theme this year to include a bounce castle, face
