The Case of a Child and a Neighbor’s Dog

I. Relevant Facts
- The witness, Mr. Fred Puzon saw the dog bit the arms and leg of the
daughter of Mr. Peter Banag, Mary, aged 6.
- He confirmed that the dog belonged to their neighbor, Mr. Arthur Sison
- He immediately ran to protect the defenseless child from further attacks of
the dog.
- The owner of the dog, Mr. Arthur Sison, came out of his house to secure
his dog and immediately called a tricycle to bring Mary to a nearby clinic.
- According to the witness, the victim was knocking at the gate of Mr. Sison
to buy ice candies.

II. Chronological order of Relevant Facts


On September 12, the 6 year old-daughter of Mr. Peter Banag was bitten
by Mr. Arthur Sison’s dog as witnessed by their another neighbor, Mr. Fred
Puzon. The witness stated that he saw the victim knocking at the gate of
Sison in order to buy some ice candies, when suddenly the latter’s dog got
out of their house and bit Mary’s arms and leg. Puzon came immediately to
protect the victim from further attacks by the dog. Fortunately, Sison went out
to assist the victim by bringing her to a nearby clinic wherein she was given
proper medical attention shouldered by Sison.

III. Provisional Legal Dispute


1. Banag wanted Sison be liable and demanded that he pay the sum of Php
20,000 for the damages suffered by his daughter.
2. Sison denied that he is liable.

IV. Principal Issue

Whether or not Arthur should still be held liable for the damages
suffered by Peter’s daughter.
