I, ROXAN V. DAYOK, Filipino, 48 years old, single, and with

residence at Brgy. Dakit, San Francisco, Southern Leyte after having been
duly sworn to in accordance with law, hereby depose:

PRELIMINARY STATEMENT

The person examining me is Atty. Angelica Grace G. Reyes of the

Public Attorney’s Office. The examination is being held at the Public
Attorney’s Office, Sogod, Southern Leyte. I am answering her questions
voluntarily, to the best of my knowledge and fully conscious that I do so under
oath and may face criminal liability for false testimony and perjury.

PURPOSE

This Judicial Affidavit is being offered to support the Position Paper of

herein Respondents to be submitted to hi Honorable Adjudication Board;
specifically their position, that they should not be ejected as tenants of the
subject landholding.

Q1: Nganong nia man ka sa opisina sa PAO karon? (Why are you here in the
PAO Office?)
A1: Kay magpatabang ko sa kaso naho sa DARAB. (Because I want to ask
help regarding our case before the DARAB.)
Q2: Kaila ba ka niining si Raul D. Duarte? (Do you know a certain Raul D.
Duarte?)
A2: O. Si Raul Duarte ang administrador sa luna na Lot No. 1833, na gisaupan
sa ahong mama na si Isabelita Dayok sauna, na karon ako na’y nagtikad.
Kaning juta nahimutang sa Brgy. Dakit, San Francisco, Southern Leyte. (Yes.
Raul Duarte is the administrator of the land known as Lot No. 1833, tenanted
by my mother, Isabelita Dayok, before. But now, I am the one cultivating it.
The land is located at Brgy. Dakit, San Francisco, Southern Leyte.)

Q3: Kung administrador si Raul Duarte, kinsa man di-ay ang tag-ija anang
juta? (If Raul Duarte is the administrator of that land, who then are the
owners?)
A3: Ang mga sumusunod ni Felix Hortiguela jud ang tag-iya anang juta. (The
heirs of Felix Hortiguela are the owners of that land.)

Q4: Kanus-a di-ay nagsugod si Isabelita Dayok pagsaop anang juta? (When
did Isabelita Dayok start being a tenant of the land in question?)
A4: Ag ahong inahan nagsugod ug saop anang juta pagkahuman sa
pagdeklarar sa Martial Law, sa ahong bana bana mga 1974. (My mother
started tenanting that land after Martial Law was declared, sometime in
1974.)

Q5: Unja, kanus-a man ka nagsugad ug tikad sa juta? (Then, when did you
start cultivating the land?)
A5: Nagsugod ko pagtikad anang juta katong December 29, 2016 sukad sa
paghimo ni Mama ug Waiver ug Quitclaim, na dili na sija ka-atiman sa juta
tungod kay tiguwang na sija. (I started cultivating that land on December 29,
2016 when my Mother executed a Waiver and Quitclaim for the reason that
she could no longer look after the land she was tenanting because she was
already elderly.)

Q6: Kanang giingon nimung Waiver ug Quitclaim, ug ipakita na nimu

makaila ka pa ba ani? (If the said Waiver and Quitclaim will be shown to you,
will you still be able to identify the same?)
A6: O, Ma’am. (Yes, Ma’am.)

Q7: Naa ko’y ipakita nimu na dokumento na gingalanang Affidavit of Waiver

and Quitclaim, notaryado ni Atty. Fabian C. Maamo, Jr. ug gimarkana na
Exhibit “1”, mao ba ni ang dokumento na imung giingon? (I am showing to
you a document named as an Affidavit of Waiver and Quitclaim, notarized by
Atty. Fabian C. Maamo, Jr. and marked as Exhibit “1”, is this the document
you were referring to?)
A7: O, mao na, ma’am (Yes, that’s the one, Ma’am.)

Q8: Kahibaw ba ni si Raul Duarte ug ang tag-ija sa luna bahin aning Waiver?
(Does Raul Duarte and the owners of the lot know about this Waiver?)
A8: O, Ma’am. Kahibaw na si Raul, pero dili raba ko sigurado ug nagtug-an
sija sa tag-iya, ug bisan pa ug wa kuno sila kahibaw gipakapin man nang
Waiver didto sa akong Judicial Counter-Affidavit na gi-sumite naho sa korte
katong Hulyo 5, 2017 sa San Francisco, saunang gikihaan ko nila didto. (Yes,
ma’am. Raul knows about it, although I am not entirely sure whether Raul
told the owners of the land. However, even if they claim that they do not know
about it, I attached the said waiver to the Judicial Counter-Affidavit that I
submitted last July 5, 2017 to the Court in San Francisco, where they filed a
case against me.)

Q9: Gikan atong nakadawat sila anang Waiver, nakistorya ba nimo ang tag-
iya sa juta o si Raul na di sila ganahan na ikaw mao’y magsayop sa juta?
(Since they received a copy of that Waiver, did the owners of the land or Raul
try to tell you that they do not want you as their tenant?)
Q9: Wala man, ma’am. Ug wala pod sila nag-ingon naho na mupili sila ug
bag-ong saop. Nahuman nalang ang tuig, wa gajud sila nakistorya bahin anang
pagkasaop naho. (No, they did not, Ma’am. They also did not tell me that they
wanted to choose someone else as tenant. The year ended, but they did not
talk to me regarding my tenancy.)

Q10: Ngano man di-ay na gikihaan ka nila sauna? (Why did they file a case
against you?)
A10: Tungod man gud na sa panghitabo kaniadtong Disyembre 16, 2016. (It
is because of what transpired last December 16, 2016).

Q11: Unsa man di-ay ang panghitabo kaniadtong Disyembre 16, 2016? (By
the way, what happened last December 16, 2016?)
A11: Usa ka tuig pa usa anang panghitabo sa Disyembre 16, 2016, nananghid
na si Raul Duarte sa akong papa na si Sulpicio Dayok, Jr. na magtanum sila
ug Cacao diha sa juta. Wala mingsugot si papa, kay matod niya dili pwede na
ang administrador mao’y mananom sa juta, kay sa saop ra gajud nang
pananom. (A year before that occurrence last December 16, 2016, Raul
Duarte asked permission from my father, Sulpicio Dayok, Jr. if he could plant
Cacao plants on the land. My father did not consent thereto because
according to him, an administrator is not allowed to plant on the land, that is
the tenant’s right and obligation.)

Q12: Unja, unsa ma’y sunod nahitabo? (Then, what happened next?)
A12: Nagtanom ra gihapon sila ug Cacao, unja wa’y nahimo si Papa.
Gipangsunog pa gani nila ang punuan sa lubi kay malandongan ang Cacao sa
lubi. (They still planted the Cacao plants, and there was nothing my father
could do. They even burned the coconut trees because the trees shaded the
Cacao plants from the sunlight)

Q13: Unsa may gibuhat pod ninjo? (Then what did you do?)
A13: Mao na tong Disyembre 15, 2016, nasakpan naho sila Raul na nagsunog
na pod ug laing punuan sa lubi, pagkasunod na adlaw Disyembre 16 gisugo
ko sa ahong inahan na ibuton ang ilang mga tanum. (On December 15, 2016,
I caught Raul and his men burning another coconut tree. The next day, my
mother instructed me to remove their cacao plants.)

Q14: Unsa may gibuhat nila? (What did they do then?)

A14: Mao na tong gikihaan ko ni Raul ug kaso kriminal. Pero na-dismiss
tungod kay niingon ang korte na agrarian ning kasuha. (That was when Raul
filed a criminal case against me. But the same was dismissed because the
court said that the case involves an agrarian dispute.)

Q15: Kanang court order na imung giingon, mao ba ning dokumento na

ginganlan ug Order na gi-isyu sa Municipal Trial Court of San Francisco,
Southern Leyte kaniadtong Enero 19, 2018 ug gimarkahan na Exhibit “2”?
(The court order that you mentioned, is it this document captioned as Order,
issued by the Muncipal Trial Court of San Francisco, Southern Leyte last
January 19, 2018 and marked as Exhibit “2”?
A15: O, mao na, attorney. (Yes, that is the one, attorney.)

Q16: Unja, gikan atong gikihaan ka nila sa korte, mubahin paka nila sa
kutsitsa sa lubi? (After they filed a case against you in court, did you still give
them one half of the proceeds every time you harvested the coconuts?)
A16: O, mubahin gihapon. Suguon naho ag akong manghud na si Joan Dayok
na ihatod ug ihatag ang bahin nila sa halin. (Yes. I still give them their share
in the proceeds. I always instruct my sister, Joan Dayok, to deliver and give
to them their share in the proceeds of the harvest.)

Q17: Unja, dawaton ba ni nija gikan kan Joan? (Does he accept this from
Joan?)
A17: O, dawaton gihapon nija. Naa pa gani ko’y mga pesadas pagpamatuod
na mudawat gihapon si Raul sa bahin katong 2017 ug 2018. (Yes, he accepts
them. I even have the receipts to prove that Raul still accepted their share last
2017 and 2018.)

Q18: Mao ba ning imung giingon na mga pesadas? Kaning gimarkahan ug

Exhibit “3”? (Are these the receipts you are referring to? The ones marked as
Exhibit “3”)
A18: O, mao na, attorney. (Yes, those are the ones, attorney.)

Q19: Katapusang pangutana, ngano mang dili ikaw ang maghatod sa bahin
kang Raul? (Last question, why did you not personally deliver the proceeds to
Raul?)
A19: Tungod kay gikihaan man lagi ko niya, syempre mulikay ko nija kay dili
ko ganahan ug kagubot. Pero dili pasabot na mu-ikyas ko sa ahong
responsiblidad isip usa ka saop, mao bitaw nang si Joan ahong suguon. Pero
kahibaw gajud na si Raul na kanang bahin gikan jud naho, ahong manghod
ra’y tighatod. (Because he previously filed a case against me, clearly I wanted
to avoid him for I do not want any trouble. But that does not mean that I
neglected my responsibility as a tenant, which is why I always instruct Joan
to deliver the proceeds. Raul knows that the proceeds actually come and are
given by me, only that Joan delivers it to him.)

Q20: Naa pa kay laing ipuno ug isulti? (Do you have anything more to say?)
A20: Wa na maam. (Nothing else.)

the owners of that land.)

A5: Nagsugod si Roxan pagtikad anang juta katong December 29, 2016 sukad
sa paghimo ni Mama ug Waiver ug Quitclaim, na dili na sija ka-atiman sa juta
tungod kay tiguwang na sija. (Roxan started cultivating that land on
December 29, 2016 when my Mother executed a Waiver and Quitclaim for the
reason that she could no longer look after the land she was tenanting because
she was already elderly.)

makaila ka pa ba ani? (If the said Waiver and Quitclaim will be shown to you,

Waiver didto sa Judicial Counter-Affidavit ni Roxan na gi-sumite niya sa
korte katong Hulyo 5, 2017 sa San Francisco, saunang gikihaan sija didto.
(Yes, ma’am. Raul knows about it, although I am not entirely sure whether
Raul told the owners of the land. However, even if they claim that they do not
know about it, Roxan attached the said waiver to the Judicial Counter-
Affidavit that he submitted last July 5, 2017 to the Court in San Francisco,
where they filed a case against him.)

Q9: Gikan atong nakadawat sila anang Waiver, nakistorya ba ninjo ang tag-
iya sa juta o si Raul na di sila ganahan na si Roxan mao’y magsayop sa juta?
(Since they received a copy of that Waiver, did the owners of the land or Raul
try to tell you that they do not want your brother Roxan as their tenant?)
Q9: Wala man, ma’am. Ug wala pod sila nag-ingon namo na mupili sila ug
bag-ong saop. Nahuman nalang ang tuig, wa gajud sila nakistorya bahin anang
pagkasaop ni Roxan. (No, they did not, Ma’am. They also did not tell us that
they wanted to choose someone else as tenant. The year ended, but they did
not talk to us regarding the tenancy.)

Q10: Ngano man di-ay na gikihaan si Roxan sauna? (Why did they file a case
against you?)
A10: Tungod man gud na sa panghitabo kaniadtong Disyembre 16, 2016. (It
is because of what transpired last December 16, 2016).

Q11: Unsa man di-ay ang panghitabo kaniadtong Disyembre 16, 2016? (By
the way, what happened last December 16, 2016?)
A11: Usa ka tuig pa usa anang panghitabo sa Disyembre 16, 2016, nananghid
na si Raul Duarte sa akong papa na si Sulpicio Dayok, Jr. na magtanum sila
ug Cacao diha sa juta. Wala mingsugot si papa, kay matod niya dili pwede na
ang administrador mao’y mananom sa juta, kay sa saop ra gajud nang
pananom. (A year before that occurrence last December 16, 2016, Raul
Duarte asked permission from my father, Sulpicio Dayok, Jr. if he could plant
Cacao plants on the land. My father did not consent thereto because
according to him, an administrator is not allowed to plant on the land, that is
the tenant’s right and obligation.)

Q12: Unja, unsa ma’y sunod nahitabo? (Then, what happened next?)
A12: Nagtanom ra gihapon sila ug Cacao, unja wa’y nahimo si Papa.
Gipangsunog pa gani nila ang punuan sa lubi kay malandongan ang Cacao sa
lubi. (They still planted the Cacao plants, and there was nothing my father
could do. They even burned the coconut trees because the trees shaded the
Cacao plants from the sunlight)

Q13: Unsa may gibuhat pod ninjo? (Then what did you do?)
A13: Mao na tong Disyembre 15, 2016, nasakpan ni Roxan sila Raul na
nagsunog na pod ug laing punuan sa lubi, pagkasunod na adlaw Disyembre
16 gisugo sa ahong inahan si Roxan na ibuton ang ilang mga tanum. (On
December 15, 2016, Roxan caught Raul and his men burning another coconut
tree. The next day, my mother instructed him to remove their cacao plants.)

Q14: Unsa may gibuhat nila? (What did they do then?)

A14: Mao na tong gikihaan ni Raul ug kaso kriminal ag akong igsuon. Pero
na-dismiss tungod kay niingon ang korte na agrarian ning kasuha. (That was
when Raul filed a criminal case against my brother. But the same was
dismissed because the court said that the case involves an agrarian dispute.)

lubi? (After they filed a case in court, did Roxan still give them one half of the
proceeds every time you harvested the coconuts?)
A16: O, mubahin gihapon. Suguon ko nija na ihatod ug ihatag ang bahin nila
sa halin. (Yes. He still gives them their share in the proceeds. He always
instruct me to deliver and give to them their share in the proceeds of the
harvest.)

Q17: Unja, dawaton ba ni nija? (Does he accept this?)

A17: O, dawaton gihapon nija. Naa pa gani ko’y mga pesadas pagpamatuod
na mudawat gihapon si Raul sa bahin katong 2017 ug 2018. (Yes, he accepts
them. I even have the receipts to prove that Raul still accepted their share last
2017 and 2018.)

proceeds to Raul?)

dili sija ganahan ug kagubot. Pero kahibaw gajud na si Raul na kanang bahin
gikan jud ni Roxan, aho ra’y tighatod. Kay inig hatod naho, muingon jud ko
niya permanente na gikan tong Roxan. Ug wa pod ko’y plano mupuli ni Roxan
isip usa ka saop kay mag-ulian man ko sa Cagayan de Oro. (Because Roxan
previously filed a case against him, clearly Roxan wanted to avoid him for he
does not want any trouble. But Raul knows that the proceeds actually come
and are given by Roxan, and I am only tasked to deliver it. Also, I have no
plans of replacing Roxan as the tenant because I go back and forth from
Cagayan de Oro, where my family lives.)
