As of today I have not heard back from Oak Run developer Kulbir Ghumman of DECCA, Development
and Construction Corporation of America, or his daughter Priya Ghumman, DECCA’s current President,
Director, and Registered Agent, according to the attached 2018 Florida Profit Corporation Annual
Report.

I am currently making emergency modifications to the rain water discharge system that apparently
undermined the column at the front of my home. Then I will make a formal request to DECCA to repair
this column pursuant to the Villa Maintenance Program, and may make a claim against DECCA’s
contractor policy. My insurance company denied my claim, but said I can make the necessary repairs
myself. Thank you.

This will acknowledge your email, and is a very brief response to some of the issues you raised.

Since you agree with the Engineer’s evaluation of the column at the front of my home, and the
Engineers determination, I direct your department to assist the contractor, DECCA, Development and
Construction Corporation of America, or whatever it calls itself now, with the required permits to take
the remedial actions necessary to repair said deterioration as noted.

My parents paid DECCA to construct this home in 1993-1994, and at all times pertinent since then, this
is a maintained homesite. Attached you will find a letter dated August 16, 1994 from DECCA addressed
to my parents, Cornelius & Penelope Gillespie, at 8092 SW 115 Loop Ocala, FL 34481, the subject
property. Under the Villa Maintenance Program, DECCA is required to repair cracks and paint the
exterior of the home on a five year cycle. In keeping with the industry standard, DECCA is required to
repair cracks greater than 3/8 inch in width which are the Builder's responsibility. If at any time the
crack in the stucco exceeds 3/8 inch in width, DECCA is required to make the repair. I am providing this
notice to DECCA, and ORAL, Oak Run Associates Limited, and the ORHA, Oak Run Homeowners
Association, Inc., by and through the persons shown at the end of this email.

During the establishment of Oak Run, DECCA and company officials pled guilty and were convicted of
federal crimes for knowingly hunting protected wildlife on the property. Oak Run developer Kulbir
Ghumman, and Herbert von Kluge, knowingly hunted protected red-cockaded woodpeckers, see
attached, United States v. DECCA/Ghumman, Kulbir, et al. case 87-00013, U.S. District Court, Middle
District Florida.

Given Oak Run’s past, I am concerned whether my home was constructed according to code.

For example, attached is a photograph of the column made during construction, which shows the block
going into the ground without a foundation. Did this construction comply with the building code in
Florida and Marion County in 1993-1994?

For example, I believe virtually every concrete driveway in Oak Run (3,400 homes) is cracked,
apparently due to a lack of thermal expansion joints. I invite you to personally inspect the defective
driveways in Oak Run and determine the cause of this damage.

On October 30, 2006, my mother Penelope Gillespie, was injured as a result of DECCA's entry door,
11637 SW 90th, Terrace, Ocala, FL, as reported in my letter Nov-27-2006 to James E. Flynn, President,
Oak Run Homeowners Association, Inc. (ORHA). When I returned the next day to photograph the
apparent code violation, I was assaulted by DECCA employee Emilio Gonzales, who tried to grab my
camera, see MCSO report 0610310707.

Currently I am in litigation with a number of parties (RMS v. Gillespie), including the Oak Run
Homeowners Association, Inc. (ORHA), and Development & Construction Corporation of America, Inc.
(DECCA). I have alleged wrongdoing by DECCA’s successor, Oak Run Associates LTD (ORAL) for

charging post-judgment interest prior to adjudication. This scheme is facilitated by the Marion County
Clerk and Comptroller.

Thank you for the November 2006 Special Edition ORHA Newsletter. The
transcript of the letter from Mr. Carls of Taylor & Carls, P.A. was informative.

My mother, Penelope Gillespie, has resided in Oak Run since 1994, and is one of
the original homeowners in neighborhood 13, Woodside Courts. I am her son and
primary caregiver, and want to report two incidents that occurred at DECCA's office on
October 30th and 31 st, 2006.

DECCA apparently has a policy requiring a personal visit to the office for routine
cable TV service changes. As such I accompanied Penelope to DECCA's office on
October 30, 2006 for a 1:00 p.m. scheduled appointment. As Penelope entered the office,
she tripped and fell to the floor. DECCA employee Kristina was present. I was able to
help Penelope back to her feet, and at the time she seemed all right, but the following
morning she awoke in pain and had difficulty walking.

In an effort to rectify the dangerous step that caused my mother to trip and fall, I
was directed to DECCA employee Emilio Gonzales. He was hostile, and appeared only
interested in whether we intended to sue DECCA. I explained that my concern was the
dangerous step. Mom is a nice lady who is not inclined to sue anyone, even though she
was injured. She does not want to spend her remaining years in litigation.

Mr. Gonzales was not convinced, and blamed mom for tripping and falling. Then
he referenced a lawsuit against McDonald's from a few years ago, litigation over a cup of
coffee that burned a customer. Mr. Gonzales drew a parallel between my mom's fall and

the McDonald's lawsuit, saying people have to take responsibility for their actions.
When I told him the step may not meet code (from my experience developing commercial
real estate) 11e said my mother should have read the warning sign on the door, and that the
sign provided fair warning. When I asked if DECCA's entrance complied with the
Americans with Disabilities Act (ADA), he demanded to know if mom was disabled.

Mr. Gonzales and I did not reach a consensus, so I decided to photograph the
dangerous step and discuss it with either an attorney or a building inspector. Enclosed are
some of the photographs I made. As I was taking the pictures, Mr. Gonzales emerged
from DECCA's office to confront me and then grabbed my camera. During the struggle I
lost my balance and fell. Law enforcement was summoned. The Marion County Sheriff
responded and documented the incident.

I am concerned about the dangerous step to DECCA's office, and what can be
done to remedy the problem. In my opinion, the floor should be the same height on either
side of the entry threshold, and there should be a hand railing along the steps leading to
the entrance door. My other concern is DECCA's apparent disregard for the health and
safety of Oak Run's residents. No one from DECCA expressed any concern for my
mother's injury; the only concern was if we intended to file suit.

Kindly advise if this matter can be addressed by the ORHA.

FACTUAL BASIS
In February, 1985, defendants Kulbir Ghumman, who was
president and sole shareholder of Development and Construction
• • • • •
Company of America (hereinafter DECCA) and Herbert Von Kluge,
vice
vice president of DECCA met with Arthur Tait, executive/president
of DECCA, and others to discuss steps necessary to obtain a
development of regional impact order to develop the Oak Run
Subdivision in Ocala, Florida. A development of regional impact
order was an order required to be obtained by developments which
because of their character, magnitude or location would have a
substantial regional effect in the area of development.
In Mayor June of 1985, Kulbir Ghumman and Herbert Von
Kluge were informed that the property owned by DECCA at Oak Run
contained cavity trees characteristic of an endangered species of
woodpecker, the red cockaded woodpecker. The defendants knew
because of conversations with experts that the discovery of an
endangered woodpecker species on the Oak Run property could
result in set asides of property as endangered species habitat as
well as time delays in approving the development .

On or about May 24, 1985, empibyees of DECCA, removed
cavity trees used by the red cockaded woodpeckers. In June of
1985, an employee of DECCA purchased shotguns and ammunition
which were subsequently used by Ghumman, Von Kluge, and others
acting under their direction, for hunting and harassing red

After the events stated a~ove, DECCA entered into a
memorandum of agreement with the Florida Game and Fresh Water Fish
Commission in which DECCA agreed to fund a 6-month study to
determine, among other things, whether red cockaded woodpeckers

were present at the Oak Run site. The study discovered no red
cockaded woodpeckers at the Oak Run site.


RESOLUTION

On August 10, 1987, a special meeting of the Board of

Directors of Development & Construction Corporation of America,

Inc., was held at 2440 Gulf Life Tower, Jacksonville, Florida.

As evidenced by his signature below, the director waived notice

of the meetfng.

The following resolution was proposed by and adopted by

the sole director of the Corporation:

RESOLVED, the President of the Corporation is


hereby authorized to enter a plea of guilty to
the offense of taking an endangered species of

wildlife •
as charged • of the Indictment
in Count II • •
pending against the Corporation in Case No. 87­
13-CR-OC-HTS. Further, the President is author­
ized to enter into and to cause the Corporation
to comply with the plea agreement attached hereto.

Adopted this 10th day of August, 1987.
