People of the Philippines vs Marry Ann Honor y Amadre

Criminal Case No. Q-11-172775

FACTS:

The accused Marry Ann Honor y Amadre was charged with the crime of Violation of
Section 11, Article II of R.A. 9165 (Comprehensive Dangerous Act of 2002) for illegally
possessing two (2) heat-sealed sachets of white crystalline substance containin
METHAMPHETAMINE HYDROCHLORIDE (shabu).

Prosecution: On October 12, 2011, at around 6:00 o’clock in the evening, while he and
other police officers were on duty at Cubao Police Station 7, Quezon City Police District, they
received an information from a Regular Confidential Informant about an alleged Drug Trade
Activity perpetrated by one aka “JOJO”. Acting on the information, they immediately
coordinated with the PDEA and prepared a Coordination Form, the Pre-operational Report and
the Buy-bust money. The witness identified these documents. Having been directed by PDEA to
proceed, the team of six (6) police officers, including the witness, conducted a short briefing and
thereafter proceeded to the target area along F. Manalo St., Brgy. Immaculate Conception,
Quezon City.

While the confidential informant and the undercover PO1 Villas were still far from and
casually approaching “JOJO”, somebody shouted “PULIS! PULIS! PULIS!” This made the
target ran away and escaped. At the very same moment, the witness saw the accused throwing in
the pavement two (2) pieces of small plastic sachets containing white crystalline substance. The
witness recovered the said sachets thrown by the accused and brought them to the police station
where the marking was made. The marking was made at the police station because it was raining
at that time. The witness identified the markings on the specimen as “NV/MHA-1” and
“NV/MHA-2”, which stand for the initials of NELSON VILLAS and MARRY ANN y
AMANDRE respectively.

Defense: The accused narrated that on October 12, 2011 at around 6’oclock in the
evening, she was at home waiting for her son and niece to arrive from the airport. Feeling uneasy
about their late arrival, she went outside and passed by an alley. She noticed that there was a
commotion which she heard and saw. There was an on-going chase by the police officers of the
persons involved in the “kara y kruz.” As she went out of the alley, she accidentally bumped a
policeman along the way and who then accused her of throwing the illegal drugs. She identified
the policeman as officer Villas. The witness resisted the arresting officer and denied that she
owned and possessed the illegal drugs. Having no choice but to submit to the arresting officers,
she allowed the officers to take her to Station 7 through a van. While inside the van, she claimed
that the police were forcing her to admit having done the criminal offense. The police subjected
her to medical examination and inquest proceeding.
