7. Describe the Republic Act 9165/6425. Based on this, differentiate prohibited


from regulated drugs.

I. REPUBLIC ACT 6425


“The Dangerous Drug Act of 1972”

A Republic act that describes drugs that are regulated and prohibited in the
Philippines. It also governs the sale, distribution, and proper prescription of the
said drugs, as well as the corresponding penalties for people who would violate
the act.

Based on this act,


● Prohibited drug includes:
a. opium and its active components and derivatives (heroin and morphine)
b. coca leaf and its derivatives (cocaine)
c. alpha and beta eucaine
d. hallucinogenic drugs (mescaline, lysergic acid diethylamide (LSD) and
other substances producing similar effects)
e. Indian hemp and its derivates
f. Others: natural or synthetic, with the physiological effects of a narcotic
drug

● Regulated drug includes


a. self-inducing sedatives (secobarbital, phenobarbital, pentobarbital,
barbital, amobarbital and any other drug which contains a salt or a
derivative of a salt of barbituric acid)
b. any salt, isomer or salt of an isomer, of amphetamine (benzedrine or
dexedrine, or any drug which produces a physiological action similar to
amphetamine)
c. hypnotic drugs (methaqualone or any other compound producing similar
physiological effects)
II. REPUBLIC ACT 9165
“Comprehensive Dangerous Drug Act of 2002”

An act instituting the comprehensive dangerous drugs act of 2002, repealing


republic act no. 6425, otherwise known as the dangerous drugs act of 1972, as
amended, providing funds therefor, and for other purposes.

It is the policy of the State to safeguard the integrity of its territory and the
well-being of its citizenry particularly the youth, from the harmful effects of
dangerous drugs on their physical and mental well-being, and to defend the same
against acts or omissions detrimental to their development and preservation. In
view of the foregoing, the State needs to enhance further the efficacy of the law
against dangerous drugs, it being one of today's more serious social ills.

8. Describe other laws pertinent to drug therapy in the Philippine setting.


A. Executive Order 218
- Law governing the Creation of task force, Supervision and support, and the
funding for the implementation Republic Act 9165.
B. Republict Act 10640
- An act to further strengthen the anti-drug campaign of the government,
amending for the purpose section 21 of republic act no. 9165, otherwise known
as the “comprehensive dangerous drugs act of 2002″

C. Implementing Rules and Regulations of RA 9165


- "Comprehensive Dangerous Drugs Rules of 2002”
- Act promulgated to implement the provisions of republic act no. 9165
