SANGGUNIAN RESOLUTION NO. 2015-112


A RESOLUTION FORMALLY AND EARNESTLY REQUESTING
DR. REBECCA V. DELAPUZ, CESO IV, OIC REGIONAL DIRECTOR,
OFFICE OF THE REGIONAL DIRECTOR OF THE DEPED
CARAGA REGION TO IMMEDIATELY TRANSFER MS. NELIA S.
LOMOCSO, OIC OF CABADBARAN CITY SCHOOLS DIVISION FOR
SHOWING CONDUCT UNBECOMING OF A PUBLIC OFFICER

WHEREAS, in pursuance of the policy of the City Of Cabadbaran for consultative


and transparent governance, the Sangguniang Panlungsod of Cabadbaran City, Agusan
del Norte formally invited Ms. Nelia S. Lomocso to be present in its July 15, 2015
Regular Session to shed light on the following issues:

a. Financial support of the City Government to the City Schools Division for
the recent Caraga Athletic Meet.
b. Special Education Fund (SEF)/ Special Education Enhancement and
Development Fund (SEEDF) as subsidy for the eight (8) teachers in
Puting Bato.

WHEREAS, the Sangguniang Panlungsod likewise invited some DepEd personnel


in the persons of Mr. Ryan Isaga, Mr. Ian Robillos, Mr. Jecyl Santillan, Mr. Nonito
Galdiano, Dr. Marife C. Dultra, Ms. Marites A. Udtojon, Dr. Lewelyn S. Bacleon,
Ms. Susan D. Estareja, Mr. Christopher A. Ortillano, Mr. Joel L. Pelenio and Mr. Japhet
K. Salazar to be present also in its July 15, 2015 Regular Session to shed light on the
above stated subject matters;

WHEREAS, instead of supporting the Sangguniang Panlungsod (SP) in pursuing


good and transparent governance, the City Council felt and strongly believes that
Ms. Nelia S. Lomocso, in manifest bad faith, ferociously looked for ways and means to
evade presence in the City Council’s Session and more so, used her authority towards
her subordinates to likewise avoid the City Council’s formal invitations, as evidenced by
the following scenario:

1. On July 14, 2015 Ms. Nelia S. Lomocso wrote a letter to Hon. Harris Glenn D.
Puyot, City Vice Mayor/Presiding Officer of the SP of Cabadbaran City
informing the latter that she cannot attend to the said SP Session because
she has to attend an emergency MANCOM Conference, with a manifestation
that she is free on August thus requesting that her appearance to the SP be
reset in the said month;

2. On July 14, 2105 Dr. Bacleon, Dr. Dultra, Mr. Ceballos, Mr. Ortillano,
Mr. Pelenio and Mr. Salazar wrote a letter to the Presiding Officer,
Hon. Harris Glenn D. Puyot informing the latter that they cannot attend to the
said July 15, 2015 Session for they have to attend an emergency MANCOM
Conference, hence they requested that their appearance be reset on July 31,
2015 saying that they will be available on the date;

3. On July 14, 2015 Ms. Estareja, the Division Accountant wrote a letter to the
Presiding Officer, Hon. Harris Glenn D. Puyot that she is not available in
July 15, 2015 Regular Session;

4. On July 14, 2015 the SP requested again Ms. Lomocso that except her, some
concerned invited DepEd personnel be permitted to attend the said regular
session;

5. The concerned invited DepEd personnel was then intentionally


prevented by Ms. Lomocso from attending the July 15, 2015 Regular
Session of the SP;

6. The Sangguniang Panlungsod, nonetheless went an extra mile by holding a


Special Session last July 31, 2015 for the sole purpose. However, no one of
the invited DepEd personnel showed except for Mr. Galdiano;

7. To the surprise of the SP members, Ms. Lomocso wrote a letter dated July
25, 2015 to the Presiding Officer Hon. Harris Glenn D. Puyot that she cannot
attend the July 31, 2015 Special Session. This act of Ms. Lomocso is
surprising in the sense that she was not invited in that particular Special
Session knowing fully well that she already requested that she be invited
sometime in August later;

8. The concerned teachers who said that they are available on July 31, 2015
Special Session, suddenly changed gear by likewise instructing the
Sangguniang Panlungsod without respect to just make a letter of inquiry and
they would just answer the SP writing;

9. The SP again invited all concerned DepEd personnel to attend the 91st
Regular Session scheduled on August 12, 2015, but were repeatedly
prevented by Ms. Nelia S. Lomocso from attending to the said Regular
Session;

10. Instead of professionally keeping her promise that she will be available in
August, Ms. Lomocso without any respect, instructed the Sanggunian to just
put the inquiries in writing so that she would also reply in writing;

11. Ms. Nelia S. Lomocso in her sinister move of defying the formal invitations
and denying the Sangguniang Panlungsod of the needed information
being sought supposedly through oral discussion during the SP Sessions,
invoked DepEd Memorandum Order No. 9-2015;

WHEREAS, it can be readily assumed and common sense would tell us that the
letters of Ms. Lomocso and the above named teachers were prepared by but one
person only because they all have identical reasons and alibi;

WHEREAS, the non-appearance of the invited DepEd personnel despite


numerous invitations by the SP cast suspicion that there is something fishy that the
administration of Ms. Lomocso is trying to hide from the Sanggunian Panlungsod of
Cabadbaran City, Agusan del Norte;

WHEREAS, the SP strongly believes that if the above named DepEd Personnel
only appeared in the said SP Sessions, major issues could have been discussed
thoroughly, such as:

1. Whether or not the City Fund used for 2015 City Regional Athletic Meet
was spent appropriately.
2. Whether or not the P 15,000.00 subsidy for each teacher in Puting-
Bato, Cabadbaran City was fully received by the teachers.
3. Whether or not Ms. Nelia S. Lomocso instructed the administrators to
collect certain amount from pupils, teachers and administrators for City
Regional Athletic Meet; and

4. Other relevant and corruption related allegations aired by some


concerned taxpayers, such as:

a. Ms. Nelia S. Lomocso instructed a principal to do the cooking


in her house in Magallanes, Agusan del Norte during its
Fiesta, even during classes.
b. Ms. Nelia S. Lomocso instructed one of her utilities to fixed
the comfort room of her house in Magallanes, Agusan del
Norte even during schools days.
c. Ms. Nelia S. Lomocso did not intervene and was “dedma” on
the broad-daylight physical altercation between Mr. Joel
Caytona and Mr. Joel L. Pelenio which was seen by some
students, thereby eliciting a bad example to the young
pupils.
d. NAT scandal in her division
e. Questionable purchase of one (1) unit flat-screen television
for her office.
f. Ms. Nelia S. Lomocso is receiving unauthorized RATA.
g. Unprofessional behavior towards ordinary teachers.
h. Ms. Nelia S. Lomocso posting offensive notices.
i. Ms. Nelia S. Lomocso unilaterally appointed and included her
daughter as one of the training staff/coach of the DepEd
volleyball team.
j. Unaccounted funds of the Cabadbaran City Athletic
Association.
k. Ms. Nelia S. Lomocso without delicadeza, accepted gifts and
tokens from lowly teachers during her installation as OIC-in
Cabadbaran City Division.

WHEREAS, the continued stay of Ms. Nelia S. Lomocso as OIC of the


Cabadbaran City Schools Division, will only cause more harm and injury to the teachers,
students, and the City of Cabadbaran as a whole because her actuations and deafening
silence on the allegations cast upon her created a hostile environment and glaringly
shows a conduct unbecoming of a public officer, which should not be tolerated by an
Administration that is truly following the Daang Matuwid of His Excellency President
Benigno Simeon C. Aquino III.

NOW THEREFORE

BE IT RESOLVED, by the 3rd Sangguniang Panlungsod, in its 91st Regular


Session, to formally and earnestly request Dr. Rebecca V. Delapuz, CESO IV,
OIC Regional Director, Office of the Regional Director of the DepEd Caraga
Region to immediately transfer Ms. Nelia S. Lomocso, OIC of Cabadbaran City
Schools Division for showing conduct unbecoming of a public officer.

RESOLVED FURTHER, to give copies of this Resolution to Dr. Rebecca V.


Delapuz, CESO IV, OIC Regional Director, Department of Education, Caraga Region,
J.P. Rosales Avenue, Butuan City for information and appropriate action and to
Ms. Nelia S. Lomocso, OIC Schools Division Superintendent, DepEd, Caraga
Administrative Region, Division of Cabadbaran City for information; to
Hon. Dale B. Corvera, City Mayor, this City and to Hon. Armin A. Luistro,
Secretary, Department of Education, DepEd Complex, Meralco Avenue, Pasig City,
Metro Manila for their information.
