The present Building Codes have been developed in compliance with the decision of
the Cabinet of Ministers of Turkmenistan and are designed to regulate the general
acceptance procedure for sites constructed or reconstructed under corresponding
construction contracts and ready for commissioning.
1. GENERAL PROVISIONS.
1.1 The present Acceptance Procedures should be applied to all the sites
irrespectively of their type of ownership, purpose or construction methods, in
compliance with applicable legislation and present Building Codes and
Regulations.
Amendments and changes applied during the construction process due to the
development of technical-and-economic cost-performance project ratio are performed
by the Project owner, Contractor and Developer in accordance with the established
procedure:

Amendments and changes should not exclude the amenity facilities designed to
provide the healthy and safe working conditions, in accordance with requirements of
safety procedures and industrial sanitation; as well as for the effective purification,
neutralization and suppression of hazardous emissions into the atmosphere, water and
soil; for production waste conversion; access communications; communications lines
and also melioration measures.
Acceptance of the last start-up facility is to be performed at the same time with
the acceptance of the whole project or its final stage.
1.3 In compliance with the present Building Codes and Regulations in consideration
of the specific production and realization of products (works, services), in
corresponding fields and sub sectors, the Ministry departments, inter-branch
associations and concerns may develop and approve their own Acceptance Procedures
(if it is necessary). In this case the specifics of such Acceptance Procedures, which
have not been reflected in the present Buildings Codes and which are relevant to
international contracts and agreements, are to be approved by “Turkmenminarhstroy”,
corresponding state craft union committees and by the concerned state inspection
agencies.
1.4 The final acceptance of industrial sites is allowed only if all the equipment has
been tested both individually and as a whole system. Upon the completion of the
corresponding tests, a Test Report should to be drawn up in accordance with the acting
standard acts (see Appendixes 1 and 2).
1.5 The final acceptance of stand-alone buildings, start-up facilities stages, built
in/on production areas and service buildings within the project frameworks is subject to
the regulations established for the final acceptance of the whole site.
1.6 The final acceptance of apartment buildings with areas designated for shops,
public catering facilities, public service establishments etc. is allowed only upon the
completion of all the building and assembly works, including those relevant to the
above mentioned facilities and establishments.
1.7 The final acceptance of above mentioned facilities, located into the built-in/to
buildings should be performed separately with the issuing of the separate Acceptance
Report.

heating arrangements of the adjacent sections are performed, and all the landscaping
works are finished.
1.11 The facility’s conformity to the approved design plans and specifications,
requirements of the established standards and regulations, as well as to the labour and
environment protection laws is proved by the Conclusions of the following supervision
authorities (see Appendix 3 for specimen):
NOTE:
The above mentioned list can be changed and amended by other relevant State
Supervision Authorities as far as they are established.
Apart from the above-mentioned authorities, Conclusions can be issued by
works inspectorates of corresponding craft unions.
1.12 The date when the Acceptance Certificate is signed by the State Acceptance
Inspection is considered as the construction completion date.

With the exception of cases specified in paragraph 1.10 and guarantee liabilities
terms, the date of the Acceptance Certificate’s signature signifies the termination of all
of the Contractor’s liabilities.
1.13 For the commissioning of the facility by the Project owner it is crucial to obtain
the positive Conclusions of the relevant supervision authorities, as well as the
corresponding License, if it is prescribed by the acting legislation of Turkmenistan for
the specific kind of activity.
1.14 The operation mode of the facility until it reaches its planned production
capacity is regulated by its Project owner (Investor, User). In case of the turn-key
construction of the facility its operation mode within the above mentioned period is
established in accordance with the provisions of the contract.
1.15 The final acceptance of each facility, as well as its commissioning, are
registered in accordance with the regulations established by the State statistical
authorities.
2.2 The above mentioned State Acceptance Inspections are appointed by those
bodies of authority that had approved the corresponding design plans/ specifications
and that are vested with the rights to control and utilize the public domain. The said
Acceptance Inspections are to be appointed not later than 30 days prior to the actual
acceptance date. The commencement and cessation dates of the Inspection’s activity
are defined by both the Project owner and the Contractor in compliance with the
provisions of the Contract.
2.3 Acceptance Inspections appointed for the acceptance of industrial facilities are
to be comprised of: Project owner’s representatives, representatives of the organization
entrusted with the future operation of the facility, as well as those of the General

Contractor, Developer, the local Hakimlik (of city, region) and Fire Safety Department,
State Construction Supervision Authorities and State Sanitary Inspection.
2.4 Acceptance Inspections appointed for the acceptance of apartment houses and
public facilities are to be comprised of: Project owner’s representatives, representatives
of the organization entrusted with the future operation of the facility, as well as those of
the General Contractor, Developer, the local State Construction Supervision Authorities
(if the latter are not available local Departments of Architecture are involved), Head
State Inspection, Gosstandart of Turkmenistan, Fire Safety Department and State
Sanitary Inspection.
2.5 Upon the acceptance of apartment houses and public facilities constructed by
building associations the latter’s Board of Directors must also be represented in the
Acceptance Inspection (see paragraph 2.4).
2.8 State Acceptance Inspections may accept facilities upon their full completion, as
well as upon the completion of each separate project phase, in compliance with Scopes
stipulated by their designs and construction contracts.
2.9 Prior to the inspection of the facility by the members of the State Acceptance
Inspection the said facility is to be accepted by the Project owner from the Contractor.
This intermediary acceptance of the facility must be accompanied by corresponding
Reports on the completion of all the building and assembly works in general, as well as
Certificates of equipment testing, start-up and adjustment, stipulated by the Contract.
2.10 Facilities, the construction of which has been completed in compliance with the
approved designs and construction contracts, and which are therefore ready for
commissioning or have already been commissioned and produce corresponding
amounts of goods/services as of the planned production capacity, are submitted by the
Project owner and the Contractor to the investigation and further acceptance by the
Acceptance Inspection.
2.11 The President of the State Acceptance Inspection, (or customer), is to notify the
corresponding State Supervision Authorities of the beginning of the facility acceptance

procedures not later than 15 days prior to the first proceedings of the Acceptance
Inspection.
Representatives of state inspection agencies, before beginning of the State Acceptance
Inspection work, should issue the written conclusions on object’s state of readiness and
its conformity to the approved design, in a part controllable by those inspection
agencies, or they should direct participate in a state acceptance commission’s work.
2.12 Acceptance Reports (see Appendix 4) are to be signed by all the members of the
Acceptance Inspection.
In case when one of the inspection members declines to sign the Report, as well
as in case the corresponding State Supervision Authority expresses its objections
against the acceptance of the facility, all the acceptance procedures are cancelled.

the actual completion of the said works;
The set of construction drawing designs, issued by the engineering companies, with
signatures appended to testify that all the works have been conducted strictly in
compliance with them, as well as with all the modifications made by the staff
members responsible for the completion of the said works and approved by the
engineering company. The mentioned drawing designs are ranked as operating set
of documents;
stage-by-stage work inspection reports, hidden work inspection reports and reports
testifying the acceptance of separate critical structures (supports, frameworks,
bridges, arches, arch bend, bearing walls, bearing assembled steel sections and
precast structures.);

Reports testifying that all the inlets and outlets of underground service lines at their
passage through external walls have been sealed;
cohesive resistance in a bond of stone building bearing walls Test Reports (for
earthquake-prone regions);
Certificate testifying that all the incomplete works discovered during construction
by the State Supervision Authorities and technologic supervision of the project
owner and also during the progress of the Acceptance Inspection work;
approved design and estimate documentation and certificate regarding the general
cost-performance ratios of the accepted object;
the list of all scientific and surveying organizations involved in the designing of the
accepted facility;
documents securing the land use/ownership rights, and also permission for the
performance of installation and construction works;
documents regarding the geodesic demarcation basis for construction and also
regarding the geodesic works, performing during construction by the project
owner;

certificate testifying that the newly constructed facility can be provided with
sufficient operation staff and has all the necessary amenities (ablutions, meal
stations, residential and public buildings);
certificates issued by municipal operating entities regarding the fact that external
hot/cold water supply lines, sewage, energy supply, communication systems etc.
can provide the facility with the necessary services and maintenance;
Certificate specifying the actual construction costs, signed by both the project
owner and the Contractor;
2.15 In accordance with the provisions of the present Building Code, turnkey
constructed facilities are submitted for their acceptance by the Contractor and state
acceptance commission.
2.18 If the facility is found to be not ready for its commissioning, the state
Acceptance Inspection should issue a well-grounded Conclusion, which is later on
submitted to the attention of the authority by which it had been appointed. Both the
Contractor and the project owner are entitled to receive a copy of the said Conclusion.

The list of facilities subject to the provisions of the present paragraph is drawn
up by the Cabinet of Ministers of Turkmenistan.
2.21 Upon the completion of the acceptance procedures all the relevant
documentation is kept by the project owner, or, if both the project owner and the User
are the same entity, then documentation is kept by the User (operating entity). The
storage period is permanent.
a) Certificate of acceptance;
d) Acceptance Report and relevant reporting notice are issued in 5 copies. Two of
the mentioned copies are forwarded to the regulatory body, that had appointed
the Acceptance Inspection, two – to the project owner and one – to the
Contractor.
2.23 Authority of the state acceptance commission will be terminated by the decision
of regulatory body, which had appointed that commission.

3.2 Acceptance of apartment houses, public facilities and industrial sites of other
ownership forms is performed on the bilateral basis (by both the project owner and the
contractor) in compliance with the construction contract conditions.
3.3 The facility (construction stage, start-up facilities, building, structure, or their
separate parts) shall be submitted by the contractor for its acceptance only after the
completion of all the civil and installation works under the relevant Contract.
The project owner is to be notified by the contractor regarding the fact in writing, not
later than in 30 days before the submission of the facility for its acceptance.
3.4 The local supervision authorities responsible for exercising control over the
construction and operation of the facility are to be informed in writing of its future
acceptance not later than in 15 days prior to the actual acceptance date.
Prior to the acceptance of the facility by the project owner, the said supervision
authorities submit their Conclusions concerning the conformity of the facility to local
sanitary and ecological standards, building codes and legislation to the project owner.
3.5 Acceptance of the facility by the project owner is performed on the basis of the
Conclusions issued by the relevant supervision authorities, as well as on the basis of
other documentation, proving its conformity to the approved design, standards, rules
and regulations, inspection and test reports etc.
The Project owner is entitled to entice any investors, including the project designers,
consulting and intermediary companies, insurance companies, as well as other legal
entities and individuals to take part in the acceptance procedures.
3.6 The acceptance of the facility by the Project owner directly from the Contractor
does not give the right on its placing into operation (commissioning). The
commissioning of the facility is performed on the basis of paragraph 1.13 of the present
Building Codes.
3.8 The purchase and sale of turn-key constructed facilities is not allowed if the
seller does not have all the documents stipulated in paragraph 1.11 of the present

4.1 Project owners (Builders) of public domain objects hold responsibility in the face
of relevant state authorities for the acceptance of completed facilities constructed in
contradiction to their approved designs, as well as for the low quality of construction and
installation works, preparation for the timely commissioning of the facility and for the
production of goods (such as: manning, providing the raw materials and electricity etc.),
testing (free and loaded) in the presence of the designers, civil contractors and assemblers,
adjusting the manufacturing methods to be applied, timely commissioning of facilities,
production of goods (services) within the time limits stipulated by the established
standards.
4.2 Project owners (Builders) of non-public domain objects hold the responsibility for
the fulfillment of liabilities entrusted to them by investors (construction, acceptance of
objects, preparing them to commissioning etc.) and also they are responsible for the
fulfillment of their obligations under the Capital Projects agreements (contracts).
4.3 Engineering companies bear responsibility for the conformity of the completed
facilities with the capacities and other parameters specified in the project, as well as for
the solution of all design-related problems that may arise during the construction process,
acceptance of objects and reaching their full operation capacities.
4.4 Research Institutes and similar organizations bear full responsibility for the
quality and reliability of issued documents regarding the engineering and technical
surveys (topo survey, and geology) of the site.
4.5 All the construction and mounting organizations and foreign companies bear
responsibility for performing the civil engineering and installation works in accordance
with the design, and within the established by contractor's agreement (contract) deadlines
regarding the quality of their work, as well as for the performing of individual equipment
tests and for the timely elimination of defects discovered within the construction period,
upon the facility’s acceptance or within the term of its testing and commissioning.
4.6 After the signing of the corresponding Acceptance Report all the relevant parties,
such as Acceptance Inspections, State Surveillance authorities and their officials,
responsible for issuing reports as to the correspondence of the facility to the established

standards and its readiness to acceptance and further commissioning, as well as the parties
responsible for forcing the said authorities/officials into accepting a facility constructed in
violation of the established regulations and standards, shall bear responsibility in
accordance with the acting legislation of Turkmenistan.
