Contractor's entitlements to extension of time.

3 STATEMENT OF CLAIM

4.3.1 The Contract Documents are defined in the Contract Agreement to consist of:

4.3.5 The Contract Documents must be read as a whole, and anything in one such document
must be read as included in all other documents, unless the context requires otherwise
(Article 2.12 of the Contract Conditions)
Milestones Dates
Sub-Clause 1.1.1 of the Appendix A provides that the description of Package A, the subject
of the Contract, comprises of no. of parts :
4.6.1 The General Conditions of the Contract provides procedures for Disputes Settlement under
Article 29. These procedures are either:

5.1 Generally
5.1.1 The Agreement was originally entered into on the basis of the Letter of Award dated 17
November 2013 and the Letter of Confirmation by the Contractor dated 26 November
2013. Formal effective date of commencement was identified on 10 December 2013 as
identified and conditioned in the Contract Documents.
5.1.2 The Contractor relies upon all relevant terms and conditions of the Agreement and/or
subsequent amendments thereto for their full meaning and effect. Without prejudice to
the generality of the foregoing, the following material provisions are expressly contained
within the Agreement/Contract Documents:
a) Article 14.17 of the General Terms & Conditions of the Contract provides:
“If the Contractor is or will be delayed in reaching completion, the Contractor will be
entitled to an extension of Time for Completion for the number of days assessed by
Kahramaa, if the Contractor satisfies consultant that all the following conditions apply:
14.17.1 the cause of the delay was beyond the control of the Contractor (including
an act, default or omission of consultant, but not including a Variation instructed or
agreed by consultant or otherwise determined) and the Contractor has not contributed
in any way to the delay;
14.17.2 the Contractor has taken all reasonable steps to avoid and minimize the
delay and its effect;
14.17.3 the Contractor has given to consultant each of the notices required
under Articles 14.10 and 14.18; and
14.17.4 the delay occurred to an activity or activities on a critical path of the
then current Execution Program, and consultant Approve such delay”.
b) Article 14.18 of the General Terms & Conditions of the Contract provides:
“The Contractor must give consultant notice of delay, its cause, relevant facts, and its
expected impact, as soon as practicable after the delay commenced”
c) Article 14.19 of the General Terms & Conditions of the Contract provides:
“within fourteen (14) days of commencement of the delay, the Contractor must give
consultant notice of the extension of time claimed, stating how the Contractor has been
or will be delayed in reaching Completion, by specific reference to an activity or activities
on the then current critical path or paths of the Execution Program and other
information sufficient for Kahramaa to assess the claim. If the delay continues for more
than fourteen (14) days, the Contractor must give a further notice every fourteen (14)
days thereafter, until after the delay ends, if the Contractor wishes to claim a further
extension of time, together with further information of the kind required by this Article
14.18”.
d) Article 14.24 of the General Terms & Conditions of the Contract provides:
“An extension of time according to this Article 14 or any other modification or alteration
to the Execution Program deliverables of the Contract shall be made only by a Variation
Approved by Kahramaa”

7 DETAILED PARTICULARS
7.1 Introduction
7.1.1 This section and the next set out the detailed particulars for each event that the Contractor
considers has delayed and/or disrupted the Works of Milestone 1., identifying its
contractual entitlement to an extension of time, and demonstrating ‘cause and effect’ with
the support of the contemporaneous records and delay analysis.
7.1.2 The Contractor was delayed and/or disrupted during planned duration of locatoin due to
the following events:

7.1.3 Pursuant to the General Terms and Conditions of the Contract, the Contractor considers he
is entitled to an extension of time due to the effect of these events. Detailed particulars in
support of each of the Contractor’s entitlements are set out herein below.
