DEED OF REAL ESTATE MORTGAGE

(AS AMENDED)
KNOW ALL MEN BY THESE PRESENTS:

I, CORNELIO A. NEPOMUCENO, single, of legal age, Filipino and with postal


address at Tumana, Sta. Maria, Bulacan , for and in consideration of a loan in the sum of
ONE MILLION FOUR HUNDRED THOUSAND PESOS (P1,400,000.00) Philippine currency,
to me in hand paid by, JUAN CARLOS DELA ROSA REYES, of legal age, filipino, single and
with postal address at No. 27 Little Baguio Street, Marulas, Valenzuela City, do hereby
convey by way MORTGAGE, that certain parcel of land together with all the
improvements thereon and herein below described, situated in San Vicente, Sta. Maria,
Bulacan and more particularly described as follows:

TRANSFER CERTIFICATE OF TITLE NO. T-332587 (M)

A parcel of land (Lot 3560-B-4 of the subd. plan Psd-03-093934, being a portion of lot
3960-B, Psd-03-086594, LRC Rec. No. ), situated in the Barrio of San Vicente, Mun. of Sta.
maria, Prov. of Bulacan. Bounded on the NE., along line 1-2 by Prov’l mRd. (15.00 m. wide), on
the SE., along line 2-3 by Lot-3526, on the SW., along line 3-4 by lot 3553, both of Lolomboy
Estate; on the NW., along lines 4 to 6-1 by lot 3560-B-3 of the subd. plan x x x x x x containing
an area of FOUR HUNDRED EIGHTY NINE (489) SQ. Meters.

of which real property I am the lawful owner and in accordance with the provisions of the Civil
Code of the Philippines. PROVIDED, HOWEVER, that if I shall pay or cause to be paid to said
JUAN CARLOS DELA ROSA REYES, his heirs or assigns the sum of ONE MILLION FOUR
HUNDRED THOUSAND PESOS (P1,400,000.00) within SIXTY (60) months from and after the
execution of this Mortgage together with the interest thereon at the rate of 8% per annum
payable every month pertaining to first loan with the principal amount ofP1,000,000.00 and
the P400,000.00 additional loan in accordance with the terms and conditions as provided in the
Promissory Note , then this mortgage shall be discharged and of no effect; OTHERWISE, it shall
remain in full force and effect and shall be enforceable in the manner provided for by law.

That in case of foreclosure, the MORTGAGEE may elect to proceed judicially or


extrajudicially, and in the latter event, they shall be, as he are hereby, appointed attorney-in-
fact of the MORTGAGOR with irrevocable powers, among other things, to take possession of
the mortgaged property, to collect the fruits and rents there from, and to sell the mortgaged
property at public auction in accordance with the procedures prescribed in Act 3135, as
amended by Act 4118, for the satisfaction of all the obligations secured by this mortgage,
including reasonable attorney’s fees for the enforcement thereof and liquidated damages in an
amount equivalent to 25% of all such obligations as may then be due and outstanding, apart
from costs and legal expenses prescribed by the Rules of Court; and in case of judicial
foreclosure, the MORTGAGEE shall be entitled as a matter of right to the appointment of a
receiver of the mortgaged property, without bond, with the powers and authorities
appertaining to such position;

an area of TWO HUNDRED SIXTY FIVE (265) SQUARE METERS, more or less.
