SHORT TERM e-TENDER NOTICE

Name of Work: Providing Supply of Manpower on Short Term Contract Basis for
Project Implementation Unit- Gurgaon on e-tender basis

The National Highways Authority of India (NHAI) hereby invites short term bids (e-
tender) from experienced firms/organizations (hereinafter referred to as the
“Bidders”) to bid for the works detailed in the table as mentioned below from the
eligible bidders, excluding those firms who have been declared as non-performing
by NHAI or the firms those are black listed/debarred for specified period by NHAI.

2. Bidding is open to eligible bidders on e-tender basis.

3. The preliminary requirements (detailed requirements are given in the Bid


Document) of bidding firm / contractor for above packages are mentioned as
under:-
i) The agency should be registered under PF, ESIC, GST authorities as per
applicability.
ii) The agency should have experience of minimum 03 years of similar type of
work in any Central/State Govt. or Central/State Govt. undertaking.
iii) The agency should not have been debarred/blacklisted by any of the
central/state Govt. or Central/State Govt. undertaking enterprises and no
legal proceedings shall be pending at the time of submission of offer.
Affidavit in this regard is mandatory to be furnished by agency in Annexure
-II.
iv) The agency should be regular income tax payer and should have filed their
returns up to date.
v) Required Bid Security and Average turnover of last 3 years-

4. The Scope of Work:
The agency shall provide the required manpower to NHAI office in Gurgaon.
i) The services of agency shall be based on pay & reimburse nature. According
to which the agency shall raise monthly bill along with necessary documents
after disbursement of salary & wages etc.
ii) The monthly bills should be accompanied with necessary proof of deposition
against GST, Provident Fund and ESIC as per applicable rules.
iii) Agency shall be liable to pay the wages by the 7th of Month & accordingly
pay slip of employees provided to them, copies of the same shall be
enclosed with monthly bill. If agency failed to pay the wages by the 7th of
Month, a fine of Rs.2000/- per Employee shall be charged from the agency.
iv) Agency shall be liable to file all type of statutory returns timely, in case,
against any type of penalty towards them NHAI shall not be liable. It shall
be the responsibility of Agency to indemnify NHAI against any such liability.
v) The wages paid to employees should be higher of the Minimum Wages of
Govt. of Haryana and Labour department. All payment to the manpower
engaged shall be regulated as per the circulars issued by NHAI from time to
time and the rate of wages prescribed by NHAI shall apply. NHAI shall not be
liable towards any penalty against violation of minimum wages act.
vi) NHAI shall contribute charges towards PF, PF Admin and ESIC on prevailing
rates from employer side. However employee’s contribution shall directly
be recoverable from salaries payable to employees engaged by the agency,
and shall be deposited in the employees A/c with concerning authorities.
vii) Employees engaged by agency must possess minimum qualifications as
mention stipulated in Bid Document. The CV of employees has to be got
approved from NHAI.
viii)Agency shall have to supply employees promptly as desired by NHAI.
Replacement of any employee shall be made within 7 days of direction of
PD, Gurgaon.
ix) The strength of employees supposed to be engaged may increase or
decrease as per requirement of NHAI. Present tentative strength of
employee is given in the bid documents at sl. No. 5.
x) Agency or the employees engaged by it shall not have any claim on
permanency, regularization, absorption in NHAI. Agency shall have to submit
necessary written consent in this regard from employees to be engaged by
them.

5. Mandatory documents (Attested copy of documents should be furnished):-

Certification of works performed by agency under any Central/State Govt. and


Central/State Govt. undertaking enterprises in the prescribed format of minimum
03 years of similar type of work.

i) Documents showing Average turnover during last 3 years issued by a
Registered Chartered Accountant/ supported by copy of audited accounts.
ii) Certificate of registration of “Business Operation”.
iii) Copy of registration with PF, ESIC, GST etc. from concerned authorities.
iv) Copy of Bank statements for last 01 year.
v) Labour License (If Applicable).
vi) Documentary proof of filed latest IT, GST, Labour, PF, ESIC returns for the
FY 2017-18.
vii) Affidavit in respect that the “Agency has not been debarred/blacklisted by
any of the central/state Govt. or Central/State Govt. undertaking
enterprises and no legal proceeding is pending”. Affidavit in this regard is
mandatory to be furnished by agency in Annexure -II.

6. Earnest Money Deposit: (EMD)

Bidder shall have to submit an amount of Rs.3,18,000/-as Bid Security in the form
of Demand Draft or BG (in the format prescribed Annexure-I ) issued by any of the
nationalized and scheduled bank of RBI in the name of Project Director, NHAI-PIU,
Gurgaon along with the Bid, and Bids without EMD shall be rejected.

The EMD amount shall be refunded to the unsuccessful bidder after the completion
of bidding process.

7. Validity of bid and agreement:-

The bids should be valid for a period of 120 days from the date of receipt which
may be extended if required.

Time period of service of agency shall be initially two year which may be
increased/ reduced/terminated by one month’s prior notice by either party.

8. Performance guarantee:
Successful bidder shall have to submit at the time of signing of contract an amount
equal to 10% of the contract amount in the form of DD/Bank Guarantee in the
name of Project Director, NHAI-PIU, Gurgaon, towards performance security valid
up to 14(fourteen) months (from the date of signing contract agreement), which
shall be refundable after successful completion of the contract. The amount shall
be returned one month after successful completion of service and compliance of
all the conditions. Authority reserves the right to accept or reject any or all the
tenders without assigning any reason thereof.

10. The document containing the instructions to Bidders and form of Contract
shall be available on web portal as given at sl. No. 9.
11. The amendments/clarifications to the Bid Document if any shall be hosted on
said website only.
12. The Bids shall be submitted in the prescribed format given on the said
websites before the date and time as mentioned above. No other format of
submission is acceptable.
13. Representatives of the bidders (maximum of two) who choose to attend may
attend the opening of the bids at NHAI-PIU, Gurgaon on the date and time as
mentioned above. However, such representatives shall be allowed to attend the
opening of the bids only if they produce letter of authority on the letterhead of
the bidder, at the time of opening of bids as mentioned above.
14. Submission of the Bids after the Bid Due Date and time shall not be permitted.
Bids are required to be submitted by Bidders, only as per the Standard Time and
not the time as per their location/watch.
15. The Bidders are advised to submit their Bids well before the Bid Due Date. The
Authority shall not be responsible for any delay in submission of Bids for any
reason.
NHAI reserves the right to accept or reject any or all Bids without assigning any
reason thereof.
