INSTRUCTION TO BIDDERS.

1. Contractors are advised to contact civil office on any working day for understanding scope of work
and deployment of machine and tools before quoting.
2. Rate quoted by the parties will be considered based on minimum wages existing on the date of bid
opening, any increases in minimum wages and statutory liabilities after bid opening date thereon will be
paid extra by IFFCO.
3. It is estimated that to carry-out this job as per Enquiry, approximately 4 No. of Unskilled persons will
be required on working day and 2 nos. unskilled labours on holidays. However, it would not be obligatory
on part of the IFFCO to offer work to enable you to employ, 4 employees on all working days and 2
person on holiday."
4. The quoted rates should be workable after considering all statutory requirements as per Iffco rules.
5. Considering of norms of PF. Bonus, insurance etc as per IR rules). Hence bidders are advised to
consider all norms as applicable while quoting the rates.
6. Necessary brooms, spade, tagaras, trolley to be arranged by contractor failing of which IFFCO can
arranged it through other sources & deduction of such expense shall be made from contractor bill.
Area above mentioned are tentative and for guidance purpose only.
7. Necessary camel cart or Tractor shall be deployed for cleaning of sludge taken out from
Sewage pits or sumps every month without any extra cost to IFFCO. The rates should be
inclusive of all expenses.
8. Necessary diesel operated pump shall be deployed by IFFCO as per need.
9. Party has to work even in odd hours as per exigency of work for which no extra
compensation shall be payable.
10. Sumps are to be cleaned as per schedule every month as directed by IFFCO.

NOTE:

1) Contractor shall give daily report of the job done to civil office.
2) Necessary deployment of task force shall be confirmed by party from civil section on any working

Forces are required preferably of age below 50 years.
3) Approximately 1316 Man days may require to carry out the total job in entire year.
4) If the quoted rates are found lower than the workable rates after considering
all statutory requirements offer may be ignored.
5) Deployment of manpower shall be based on working days of each month. Deployment of manpower less
than the specified, as deduction shall be made from monthly bill @ Rs.300/-per man days as penalty.

NOTE:

CONTRACTORS ARE ADVISED TO VISIT THE SITE CONDITION & UNDERSTAND THE
SCOPE OF WORK BEFORE QUOTING THE RATES.

1. DURATION
The order will be valid for a period of ONE YEAR from 03-11-2010. IFFCO shall have right to
extend the work contract period by a further period of 3 MONTHS unilaterally from the date of expiry
of the original duration at the same rate and terms & conditions of order and 12 MONTHS with mutual
consent at the same rate and terms & conditions.

2 DAMAGES If job is not attended within the specific time to the satisfaction of IFFCO penalty up to
5% of monthly bill amount will be levied by IFFCO.

3. SPECIFICATION:

a) Work to be carried out as per the requirement of IFFCO.

b) Entire jobs as listed above should be carried out on daily basis through out satisfactorily during
the currency of the contract, as per the requirement of IFFCO.

c) The tenderer should visit the site and acquaint himself with the working conditions and asses the
quantum of work to be carried out before quoting the rates.

d) The contractor should provide adequate services by deploying task force for executing the job
irrespective of weather and time.

e)The work shall be carried out suiting to the plant requirement and in an expeditious manner. If in the
opinion of IFFCO the work is not being done satisfactorily or is being delayed, IFFCO will have a right
to employ other agencies to get the work done and the cost of the same shall be recovered from the
Contractor.

f) All care will be taken by the contractor as regard to safety. Safe working procedures in providing
required services, shall be followed by the contractor.

g) The contractor shall comply all Security and Safety regulation of IFFCO. Necessary safety godgets
such as safety shoes and helmet shall be provided by contractor once in a year.Failing of which
IFFCO has right to get it issued and distribute same to labours and deduction of such issuce shall be
made from contractor’s bill.

h) IFFCO reserves the right to cancel the work order at any time if the work is not done / carried out
to the entire satisfaction of IFFCO. Also, if the contractor fails to do the work satisfactorily, IFFCO
shall get the work done from any other third party at the risk and cost of contractor and deductions
shall be made from bill / security deposit.

i) IFFCO reserves the rights to terminate the contract at any point of time without assigning any
reasons thereof. In case of termination of order, contractor shall be paid as per agreed rates of the
order for actual work completed by him on approval of competent authority, after making deductions,
if any.

j) Contractor shall arrange all necessary tools and tackles required to carry out the job and the
contractor shall provide safety gadgets like safety shoes / helmets etc. If the contractor fails to
arrange safety gadgets, the same may be issued to the contractor on chargeable basis as situation
demands and felt necessary to IFFCO.

4. STATUTORY OBLIGATIONS:

I.The Contractor shall fulfill all requirements of statutory provision under various Industrial laws
applicable to him and enactment of Govt./Local bodies.

II.The contractor shall submit an appropriate Insurance Policy / Cover Note under the workmen’s
compensation Act, 1923 and the same should be valid through out the period of work to be carried out
in IFFCO.

III.The contractor shall submit a copy of PF code, Regulation obtained from RPFC and provide the
details of PF deposits to IFFCO every month i.e. PF challans along with summary in respect of whom
PF is remitted by them.

(A) In case the contractor does not posses the PF code no. and does not work at our plant site, the
contractor should confirm the following to enable us to determine the applicability of the provisions
of the EPF and MP Act, 1952 of the contactor :-

“The Contractor does not posses PF Code number and the persons employed by the contractor are
not exclusively engaged in performing the jobs for IFFCO, Kandla.”

IV If the contractor engage labour / manpower to carry out the job, then he shall be required to submit
the following:-

(A) A copy of labour license if the contractor engages or intends to engage 10 or more labour /
workmen for job, from the Licensing Authority i.e. Asstt. Labour Commissioner (State ),
Gandhidham. Police veryfication of labours as per Govt.of Gujarat notification.

(B) The enclosed checklist (in duplicate ) duly filled in and certified by the Contractor / Executing
Department along with all their bills.

(C) A copy of the Attendance register duly certified by executing department every month for the
period the party carried out the job

(D) A copy of the Wages Register duly certified by the Executing Department every month for the
period the party carried out the job indicating the payment of minimum wages fixed by Govt.
Authority from time to time.

5. PAYMENT TERMS

The contractor shall submit monthly bills for the job carried out and payment will be made within
30 days after bill date after making following deductions:
i) 5% Retention Money
ii) Income tax as per Income Tax Act.
iii) Any other statutory deductions.

The Retention Money shall be released after 30 (Thirty ) days from the date of the completion of
the work provided a completion certificate is issued by the Jt. General Manager (GE)./Dept Head.

ATTACHMENT- II
INSTRUCTIONS TO TENDERERS

1.Introduction
Indian Farmers Fertiliser Cooperative Limited (IFFCO) is Asia's largest Cooperative and Country's biggest
producer and marketer of fertilisers which is owned by 50 million farmers through 35,000 Cooperative
societies spread throughout the country. At present, IFFCO is having plants at Kalol, Kandla, Phulpur and
Aonla, Paradip.

2."Technical And Priced Commercial Tender" and to contain schedule of rates with quoted rates and
amounts duly filled in signed and stamped. [RATES SHOULD BE MENTIONED BOTH IN FIGURES AND
WORDS] The bid be submitted strictly as per Price Schedule enclosed with the tender without any conditions
in sealed Envelop.

3. Acceptance/Rejection of Tender : IFFCO/ Consultant reserves the right to accept or reject any tender in
whole or part and/or accept other than the lowest quotation without assigning any reason. The whole work
may be split up between two or more contractors if considered expedient by the Owner on their sole and
absolute discretion. The tenderer shall have no claim in this regard whatsoever.

4.Tenderer to quote for all items : The tenderers shall quote their rates with reference to 'each item and
must tender for all the items shown in the attached schedule of quantities. Partly quoted bids will be rejected.

5.Tenderer to sign all pages : All pages of the tender documents including corrections if any shall be
signed and stamped by the tenderer.

6. Erasures and Alterations : Tenderers containing erasures and alterations in the tender documents may
be rejected. All rates shall be indicated both in words and figures. Where there is a difference between the
rates quoted in words and figures, the rates given in words shall prevail.

7.Incomplete and late tender : Unsolicited/Incomplete/late tenders are liable to rejection without any
further reference.

8. Execution of Contract : The successful tenderer shall be required to execute contract with Owner within
reasonable time.

9.Prices shall be inclusive of Works Contract Tax at applicable rates as per Gujarat Sales Tax Rules
inForce IFFCO shall not reimburse any Works Contract Tax separately once the prices quoted are inclusive
of Works Contract Tax as per Gujrat Sales Tax Rules. Form ‘C’ shall not be issued by IFFCO.

10. Validity of Quotation : The rates quoted by tenderer shall be valid for a period of 90 days from the
date of price bid opening for the purpose of placement of LOI/ Work Order.

11. PERFORMANCE GUARANTEE. as per standard terms & condition.

12.No cost payable for preparing tender : The tenderers shall not be entitled to claim any costs,
charges, expenses for or incidental to in connection with preparation and submission and subsequent
clarification of his tender even if IFFCO/ Consultant decides to withdraw the invitation to tender or
the tender is rejected on any count.

13. Jurisdiction : Notwithstanding any other court or courts having jurisdiction to decide the questions
forming subject matter or a suitany and all actions and proceedings arising out of or relating to this contract
(including any arbitration in terms thereof) shall be only in the court of competent civil jurisdiction in this behalf
at GANDHIDHAM.

14. Extension of Time : The time allowed for execution of this contract as specified in N.I.T. shall be the
essence of the contract. If the contractor commits default in commencing and or execution of the work as
aforesaid, the owner shall without prejudice to any other right or remedy, be at liberty to Forfeit Performance
Guarantee of contract. If the work is delayed (apart from force majors conditions) by any other condition which
[ in the absolute discretion of the Owner,] is beyond the control of the contractor, then upon happening of any
such event causing delay, the contractor shall immediately give notice thereof in writing to the Owner but shall
nevertheless use constantly his best endeavors to prevent or make good the delay and shall do all that may be
reasonably required to the satisfaction of the Owner to proceed with the work.Request for extension of time, to
be eligible for consideration, shall be made by the contractor in writing within fourteen days of the happening of
the event causing delay. The contractor may also, if applicable, indicate in such a request the period for which
extension is desired. The owner may give a fair and reasonable extension of time for completion of work,
depending upon the merit of the case.

15. Assignment/ Sub-letting : The contractor shall not assign or sub-let any part of the contract without the
written consent , of Owner .

16. Inconvenience to others : The contractor shall plan his work in such a way as not to cause any
inconvenience to public, owner and/or other contractors at site.

17. Contractor shall be responsible for the manner and method of execution of work. The work shall be subject
to the approval of owner from time to time for the purpose of determination of the question whether the work is
being executed in accordance with provision of contract.

18. General

A. In case any clarification are required, the tenderer shall approach the Owner/ Consultant in writing. The
Owner shall provide such clarifications in writing only. All clarifications provided shall be binding on Owner and
the tenderer.
B. No tenderer can withdraw his tender or revoke the same within the validity period. If a tenderer withdraws or
revokes his tender or revises the tender rates for any item within the validity period they will be kept on Holiday..
C. For enquiries estimated to cost less than five lakh public bid opening may not be conducted. Tender shall be
forwarded under cover of a letter written on the tenderers letter head and duly signed, in long hand using ink, by
a duly authorised representative of the tenderer.
D. Wherever it is mentioned "shall be done by contractor or supplied by contract" it shall be deemed to mean
shall be done or supplied by contractor at his cost.
E. At any time prior to the deadline for submission of bids, the owner for any reason, whether at its own
initiative or in response to a clarification requested by a prospective bidder, may modify the bidding documents
by amendment thereto.
F. The amendment will be notified in writing or by fax or E-mail/ letter to all prospective bidders who have
received the bidding documents and will be binding on them.
G. In order to afford prospective bidder reasonable time in which to take the amendment into account in
preparing their bids, the owner may, at their discretion, extend the deadline for the submission of bids.
H. The owner may, at their discretion, extend the deadline for the submission of bids by amending the bidding
documents in accordance with Articles E) to G) above, in which case all rights and obligations of the owner and
bidders previously subject to the deadline will thereafter be subject to the deadline as extended.
I . Effective date of the contract shall be the date of notification of award of work/ handing over of site
whichever is later.
J. BIDDER MUST MENTION THEIR ‘GUJARAT SALES TAX NUMBER ‘AS IT IS
REQUIRD FOR WORKS CONTRACT TAX AND P.F. REGISTRATION.
