premises",under certainconditionswith rights, dutiesand privileges
betweenor amongthem as
more fully appearsin said consolidation,extensionand/ormodification agreement,a copy of

which is attachedhereto and made a part hereof. Said Consolidation Extension Modification

Agreement(hereinafter"the Mortgage") consolidatedthe mortgage(s)refened to in ScheduleD

hereofto form a single first mortgagelien in the sum of $650,000.00.

Sixth: That the Plaintiff is the owner and holder of the subject mortgage and

note, or has been delegatedthe authority to institute a mortgage foreclosureaction by the owner

and holder of the subject mortgage and note.

Seventh: That the said mortgageswere duly recordedand the mortgagetax due

thereon was duly paid on the recordedinstrument in the proper County Clerk's Office at the

place and time which appearsthereon. If Plaintiff is not the original mortgageethen information

regardingthe chain of title will be containedin ScheduleD.

Eighth: That the defendants,HermanLamison,Jr., so named,have failed and

neglectedto comply with the conditionsof said mortgage,bond or note by omitting and failing

to pay the monthly paymentsof principal, interest,taxes,assessments,


water rates,insurance

premiums,escrowand/or other charges,all as more fully appearin ScheduleC, and accordingly,

the plaintiff has duly electedand does hereby elect to call due the entire amount presently

securedby the mortgagedescribedin paragraph"FIFTH" hereof.

Ninth: That heretofore and prior to the commencementof this action, part of the

original principal sum was paid to apply on said indebtednessand there remains due the amount

set forth in said ScheduleC.

Tenth: That in order to protectits security,the plaintiff has paid, as set forth in

ScheduleC, andlormay be compelledduring the pendencyof this action to pay local taxes,

assessments,
water rates,insurancepremiums,inspectionsand other chargesaffectingthe
mortgagedpremises,and the plaintiff requeststhat any
sums thus paid by it for said purposes
(togetherwith intereststhereon) should be addedto the
sum otherwise due and be deemed

securedby the said mortgage and be adjudgeda valid lien on


the mortgagepremises.

Eleventh: That the defendantsherein have, or claim to have, some interest


in or lien
upon, said mortgagedpremisesor somepart thereof, which interest
or lien, if any, has accrued
subsequentto the lien of plaintiffs mortgage.

Twelfth: That there are no pending proceedingsat law or otherwise to

collect or enforce said bond/note and mortgageand that there is no


other action pending which

has been brought to recover said mortgage debt or any part thereof.

Thirteenth: That the schedules,Exhibits and other items attachedto this

complaint are expressly incorporatedand made a part of this Complaint


for all purposeswith the
sameforce and effect as if they were completely and fully set forth
herein wherever reference

hasbeenmadeto eachof any of them.

Fourteenth: That by reasonof the foregoing, there is now due and owing to the

plaintiff upon said bond, note,assumptionagreement,consolidation


agreement,or recasting
agreement,the amount set forth in ScheduleC.

Fifteenth: The mortgageprovides that, in the caseof foreclosure.the

mortgagedpremisesmay be sold in one parcel.

Sixteenth: The Plaintiff shall not be deemedto have waived, altered,released

or changedthe electionhereinbeforemadeby reasonof the paymentor performance,


after the
dateof the commencementof this action,of any or all of the defaults
mentionedherein;and such

electionshall continueand remain effectiveuntil the costsand disbursements
