EX PARTE MOTION TO RELEASE BAIL

ACCUSED, through counsel and unto this Honorable Court

respectfully avers THAT:

1. Accused posted bail for his provisional liberty in the above-

captioned case in the amount of Twenty Five Thousand Pesos
(Php 25,000.00) as evidenced by Official Receipt No. 3801909
dated July 8, 2013 with bondsman yyyyyyy of Palo, Leyte;

2. By virtue of the ORDER of this Honorable Court dated June 21,

2017, the above-captioned case was provisionally dismissed, the
dispositive portion of the said order reads, as follows:

“WHEREFORE, in the light of the foregoing,

the prosecution having shown no interest to further
prosecute its case evidence by their absence despite
due notice and warning of this Court to present its
evidence today and no motion for cancellation of
today’s hearing having been filed. Considering that
the accused consented to the motion of his counsel
for the provisional dismissal of this case, let
therefore, this case filed against xxxxxxx be
PROVISIONALLY DISMISSED.”

3. Said Order failed to provide for the release of the bail bond
posted by the accused.

 WHEREFORE, premises considered, it is most respectfully
prayed of this Honorable Court that the cash bail bond in the amount
of Twenty Five Thousand Pesos (Php 25,000.00) be released.

Other relief just and equitable are likewise prayed for.
