“Again, it appearing that the agreement is not contrary to law, morals, good
customs, public morals, and public policy, and pursuant to Articles 2028
and 2037 of the Civil Code of the Philippines, the same is hereby
APPROVED (also shown in the Order dated October 19, 2016) and
ADOPTED as the Decision of this Court insofar as the Civil Aspect is
concerned. The approval of this Compromise Agreement shall put an end
to the litigation of the civil aspect of these cases, except for purposes of
execution in case of default.
The parties are hereby ordered to faithfully comply with the terms and
conditions of the agreement.
So Ordered.”
2. The defendant has not complied with the terms and conditions of
the Compromise Agreement.
3. After a decision has become final, execution is a matter of right on
the part of the prevailing party and a ministerial duty of the court to
issue writ of execution.
