PET VIOLATION NOTIFICATION PROCEDURE

In order to prove due process has been given to all pet owners who have committed rule violations, the
following procedures are suggested:

1. When any witness calls the Managing Agent or Board member, he/she is to be advised by the
Managing Agent or Board member that:

A. All violations must be documented in writing (to guarantee due process to pet owner) prior
to any Board action, which includes:

B. Date, time, location and description of violation, and the witness’ signature.

C. Witness must agree to be available in the event of a hearing or court action to act as witness
to documented circumstances before the Board takes action. When agreed to by witness:

2. ALL written communication regarding warnings and or fines to the pet owner will be instituted
and completed by the Managing Agent within three (3) business days of receipt of the written
incident report.

3. ALL communications from Managing Agent to the pet owner regarding violations must be in
writing, with a copy to the Pet Committee. This means any phone calls to pet owners regarding
violations will be followed up with a letter stating the details of the phone call. This conversation
and written follow-up constitutes a warning which is to be mentioned in the phone conversation
and correspondence.

4. There will be no mention of late fines unless the managing Agent is prepared to administer them
monthly, which includes written documentation to the pet owner, in his attempt to collect money
due the Association.

5. The first two documented violations will result in a written warning from the Board of Directors,
sent by the Managing Agent.

6. The third documented violation will require a hearing before the Board of Directors to review the
violations; the desired outcome to modify behavior.

7. The Board members will be notified of the hearing in the Manager’s Report for the upcoming Board
meeting.

8. The hearing will be conducted at the beginning of the next scheduled monthly Board meeting (if
time permits) upon obtaining Pet Committee approval. The Managing Agent will contact witnesses
as soon as the date is determined by phone and letter, so they can be present at the hearing.

9. The fourth documented violation will result in a fine of $50.00 and a notice of the Board’s intent.

10. Fines will continue to add up ($100.00 for successive violations) until such time as they are paid,
or the Board decides to file a lien against the property. Liens must be foreclosed within 2 years.
