MEMORANDUM OF AGREEMENT

KNOWN ALL MEN BY THIS PRESENTS

This Memorandum of Agreement, entered into this 4th day of April, 2018 at Tacloban
City, Leyte, Philippines by and between:

The EASTERN VISAYAS STATE UNIVERSITY, a state university created by the

Republic Act 9311, with office address at Quarry District, Tacloban City, Leyte Philippines,
represented herein by its President DR. DOMINADOR O. AGUIRRE JR., and herewith referred
to as “EVSU” .

And

The “MONARK EQUIPMENT CORPORATION” duly organized and existing under the
laws of the Republic of the Philippines with the office addressed in South Luzon Express Way,
Corner Magsaysay Road, San Pedro Laguna, represented herein by its President, ONOFRE
BANSON, JR. and herein after referred to as “MONARK EQUIMENT CORPORATION”

WITNESSETH That,

WHEREAS, EVSU, which is mandated to develop youth and equip them with knowledge
and trainings relevant to the development needs of Region VIII and the Philippines, is offering
seven technical courses in the COLLEGE OF ENGINEERING.

WHEREAS, “MONARK EQUIPMENT CORPORATION”, with its office in South Luzon

Express Way, Corner Magsaysay Road, San Pedro Laguna, is committed to the improvement of
economic and social will being of the region and its population.

NOW, THEREFORE for an in consideration of the foregoing premises, “MONARK

EQUIPMENT CORPORATION” hereby agrees and assist EVSU in its academic endeavor
specifically in the areas of the student on the job training (OJT), use of facilities and equipment,
as well as the professional services of the Engineers and other technical persons under the terms
and conditions herein stipulated:

DUTIES AND RESPONSIBILITIES:

A. The EVSU shall carry out the following functions:

1. To identify and recommend qualified incoming 5th year Engineering

students to undergo on the job training at “MONARK EQUIPMENT
CORPORATION” operation areas and facilities that will enhance and
upgrade the students capabilities;
2. To be responsible for the personal conduct and character of the
students on training.
3. To contain adequate insurance to answer for any claim arising from
injury or damage during the execution of the training at “MONARK
EQUIPMENT CORPORATION”.
4. To assist EVSU in all other projects beneficial to the public within the
purview of the existing laws of the land.
5. EVSU students shall be responsible for any damage to property or injury
to persons arising from any act of commission or omission;
B. The “MONARK EQUIPMENT CORPORATION” shall
1. Identify and recommend from among its employee experts/ resource
persons another professional lecturers to lecture in the program
specifically in the major fields subject with due compensation on their
authority and as pre-arrange in order to minimize disruptions in their
regular functions;
2. To share the use of “MONARK EQUIPMENT CORPORATION”
facilities/equipment for instructional purposes subject to predetermined
schedule;
3. To protect the student trainees against any form of sexual harassment
pursuant to Republic Act 7677, otherwise known as the “Anti-Sexual
Harassment Act”.
 4. To evaluate the performance of the student trainee based on school
form and/or agency/company evaluation form and
5. To give certificate of completion to student trainee upon completing the
required number of hours duly signed by their trainer and head agency.
C. Waiver by the EVSU students.

1. That the EVSU students shall execute a formal waiver declaring

“MONARK EQUIPMENT CORPORATION” free and harmless from any civil and
criminal liability that may fall upon the students while inside the work premises caused by
incidents or accidents;
2. That “MONARK CORPORATION” is not an employer of the students
for the duration of the on-the-job training;
3. That “MONARK EQUIPMENT CORPORATION” is not obliged or
forced to hire students after the completion of the on-the-job training.

EFFECTIVITY:

This agreement shall take effect upon the signing by the parties and shall remain in full
force for the duration of the training period (240 hrs.) or from April 10, 2018 to May ___, 2018
unless sooner terminated by mutual consent of the same parties.

IN WITNESS WHEREOF, the parties have signed this present on the date and place
above written.
