COMES NOW ACCUSED MARLON JABSON y PERIDA and

WILFREDO DELA ROSA y DELOS REYES, through the Public Attorney’s Office
(PAO), and unto this Honorable Court, most respectfully aver that:

1) On April 16, 2013, the instant case was set for the arraignment of
accused Wildredo Dela Rosa y Delos Reyes and the pre-trial conference of
Marlon Jabson y Perida;

2) The two said accused manifested before this Honorable Court that
their co-accused DARIUS DOMINGO y PACHECO is already dead;

3) This Honorable Court instructed them to furnish a copy of the death

certificate of Darius Domingo y Pacheco;

4) In compliance with the said order, the accused are now submitting
before this Honorable Court a copy of the death certificate of Darius Domingo y
Pacheco. The same is attached and marked hereto as Annex “A”.

WHEREFORE, premises considered, it is most respectfully prayed of this

Honorable Court that the death certificate of Darius Domingo y Pacheco be
admitted and considered as proof of death.

Other reliefs just and equitable under the premises are likewise prayed for.
