MMDU 1st NATIONAL LEVEL JUDGMENT WRITING COMPETITION, 2018

The Judgment writing competition entails to capture the art of decision


making in budding lawyers aspiring to join the reputed judicial services and
to unfold the dynamic role of the Judges in relation to society.
The judgment writing competition involves a comprehensive approach
towards law in terms of theory & implication of law. The legal arguments on
facts and situation with legal precedents and reasoning pave way for judgment
writing.

Rules & Regulations:


THE EVENT SHALL BE ONLINE.
1. Eligibility
 The submission is open to all law students registered in
Graduate/Post Graduate/Ph.D. Course in any Institution/ College/
University.
 The students can register themselves as a team of 2 or may also seek
single registration.
 All authors must register separately as delegates for the main event.
 There is no cap for participation from a single institution.
 The participant may also be registered for other events of
UniversuMM, 2018.

2. Format Guideline:
 Language- The language for writing the judgment shall be in
ENGLISH only.
 Word limit – Maximum of 5000 words (including foot notes).
 Submissions should be made in MS Word format.
 Main Text – Times New Roman, font size 12, double spacing,
justified, with a margin of an inch on all sides.
 Footnotes – Times New Roman, font size 10. Substantive footnotes
are accepted.
 Citation Mode – Any uniform method of citation is allowed.

*Problem for Judgment Writing Competition- 2018


The Appellant Alok Girdhar Gupta admitted that his marriage was solemnized
with Smt. Akriti Girdhar Gupta in Karnal on 23-06-2009. Out of their lawful
wedlock ‘Krish’ was born on 5-09-2010. Respondent No.1 Smt. Akriti
Girdharlived with him in his parental house at Deepak Nagar, Urban Estate,
Karnal till 17-06-2010. During this period Respondent No.1 Smt. Akriti
Girdhar become pregnant. Meanwhile appellant Alok Girdhar Guptawas
convicted and sentenced for imprisonment for life in a murder case.
He had been released on bail by order of this court on 7-01-
2013. He took ‘Krish’ respondent No.2 from the house of Respondent No. 1
Smt. Akriti Girdhar. Respondent No.2 is living with Respondent No. 1.
Respondent No. 1 is in service, highly qualified has studied upto M.Sc.
Microbiology, PGDCA, B.Ed. and in occupation as Shikshakari Class-I officer
and living in Nilokheri.
In brief, the appellant Mr. Alok Girdhar Gupta was impeaching
her character. When he came out on bail on 7-01-2013, he took ‘Krish’
respondent No.2 from her house and refused to send back to her house.
The appellant alleged that Respondent No.1 Smt. Akriti
Girdhar had sent him message that she is inclined to marry with one Dinesh
Verma. On 8-01-2013 he (appellant) had gone to the house of Respondent
No.1 to leave Respondent No. 2. But Respondent No. 1 had told that she does
not want to keep Respondent No.2 because he is a mark of sin.
He is maintaining Respondent No. 2 well. Respondent No.1 uses
to ply daily to her work place from Nilokheri. Thus, Respondent No. 2 would
not get good education and proper maintenance.
The First Additional Principal Judge, Family Court, Karnal
ordered that the Respondent No. 1 is entitled to get the custody of the minor
son, Respondent No. 2 under Section 7 of the Guardian & Wards Act, 1890.
The appellant preferred the appeal against the order in the Punjab & Haryana
High Court, Chandigarh.

4. Submission Procedure:
 A cover page stating the name of the competition, the name of
your institution and the names of student author, with the
signature of student author.
 The Judgment shall begin on the next page.
 Do not state any matter in the judgment (except the cover page)
that might reveal your identity or of your institution.
 All the Judgments must be saved and sent as PDF file. The title
of the file must be in the following format MMDU_JWC_ TEAM
CODE.
 The result will be announced on 25th September 2018.
 All the participants will be given a participation certificate which
will be sent to them via Indian Postal Service.
 The winners will be called to attend the valedictory session and
to collect their prize and certificate(s).
