REGULATION ORDINANCE NO. 2018-024

AN ORDINANCE AMENDING REGULATION ORDINANCE NO. 97-042 "AN
ORDINANCE CREATING THE ILOILO CITY POUND AND FOR OTHER
RELATED PURPOSES"

\::d WHEREAS, Section 458 (4) (viii) of the Local Government Code states that the
\\ ~ Sangguniang Panlllllgsod empowers t11e Sangguniang Panlungsod to ''provide for the impounding
1\ of stray animals; regulate the keeping of animals in homes or as part of the business, xxx and adopt
measures to prevent and penalize cruelty to animals"~

W.HEREAS, there is a need to promote responsible pet ownersh.ip to ensure the health,
order and sanitation in t11e City;

WHEREAS, the amendment for the ordinance creating the City Pound is in consonance
with RA No. 9482, or the Anti-Rabies Act of2007;

WHEREAS, Local Government Units (LGUs) are tasked to implement RA No. 9482 in
coordination with other government agencies;

WHEREAS, the City of lloilo has been previously recognized as a Rabies-Free City, but
recently there have been positive cases of rabies in the City;

WHEREAS, the goal of the Rabies Prevention and Control Program of the Department of
Health is to eliminate human rabies by the year 2020;

WHEREAS, the population of' stray dogs and cats have been increasing, leading to
increased risk of rabies exposure;

WHEREAS, there is a need for the Iloilo City Government to runend some sections of
Regulation Ordinance No. 97-042;

WHEREAS, the Iloilo City Government needs the support and help of the Barangays in
the enforcement of this amended ordinance;

NOW, THEREFORE, be it ordained, as it 1s hereby ordained by the Sangguniang

Panlungsod of the City of lloilo that;

ART. 1. - "Section l: Definition of 'ferms":

c, Animal Catcher - any city employee tasked of catching stray anima1s freely roaming or
roaming-at-large."

Shall be amended to read:

c. Animal Catcher - any m:rson authorized and trained by the City Veterinarian
Office tasked with catching stray animal(s)/animal(s)-at~large;

in Addendum:

d. Temporary impounding/holding facility - a facility that shall be provided by the

Barangay Council for stray animals or animals-at-large caught by the Animal Catcher. The
said facility shall be duly approved by the City Veterinarian;

e. Pet Owner(s) - owner/s of registered or unregistered domesticated animals, s11ch

as, but not limited to dogs and cats.

ART. 2- "Section 3. _Licensing Fee

a. An owner of a dog/cat at least three (3) months of age within the City of Iloilo shall
reg'ister such animal with tl1e City Veterinarian and shall pay ru1 annual license fee of
fifty (50) pesos. Such licenses animal shall then have a tag attached provided, however,
that a dog or cat shall not be licensed and issued a tag unless it has been vaccinated
against Rabies, such fact of vaccination to be shown by a certification from a licensed
veterinarian.

d. Any stray animal or animal-at-large caught by animal catcher shall be brought to the
City Pound"

a. All owners of dogs and cats within the City oflloilo shall register their pets whicl1
are at least three (3) months of age. The animal shall be registered with the Citv
Veterinarian for an annual license fee of PhPS0.00 per animal.

The City Veterinarian shall also conduct registration of pets at the barangay level,
i11 coordination with, and at a pre-agreed schedule with the Barangay Council.

Upon registration, the registered animal shall be issued a tag which shall contain
information s11ch as the name of the pet, name and contact number of the owner;
provided that prior to the issuance of such tag, the animal has been vaccinated
against rabies. and such fact of vaccination shall be in the form of a certification
from a licensed veterinarian.

The first time registration of a pet shall entitle the pet owner to avail of free rabies
vaccination for the said pet. Such free vaccination shall be administered by the
City Veterinarian's Office, and may be availed of only once.

d. Anv stray animal or animal-at-large caught by the Animal Catcher shall be

impounded for three (3) days at the temporary impounding/holding facility of the
barangay 'lvhere it was found and shall be brought to the City Pound at the end of
the three~dav period;

ART. 3. - "Sec. 4: Pound Notice

Upon receipt of animals into the pow1d, the City Pound Officer shall send a note to its
owner/possessor if practicable) and shall advertise in the City Hall Building or Barangay ffall
where the animal was seizediimpounded1 a poWld notice tOr ten (I 0) consecutive days stating the
following:

c. Notice that unless redeemed~ the animals will be soJd at public auction for cash to
the highest bidder at said pound on the eleventh (1 l th) day between 9:00 am-4:00pm"

shall be amended to, and shall include:

Upon receipt of the animal(s) into the temporary impounding/holding facility. the
Animal Catcher shall send a note to its owner/possessor, if identified, and shall
post in the Barangay Hall and in the said impoundingfholding facility where the
animal was seized/impounded, a pound notice for three (3) consecutive days
stating the following:

d. If unclaimed after three (3) days of being impounded in the temporanr

impounding/holding facility, the City Veterinarian or his representative, in
coordination with the Barangay, shall facilitate the transfer of the impounded
animals to the City Pound;

ART. 4. - "Section 5. Disposal of Impounded Animals

All animals impounded, unless redeemed, as provided in the preceding paragraph, shall
be sold at the public auction, and those not sold at public auction for two consecutive auctions,
shaU be disposed as follows:

a. Healthy animals except as provided for in letter (b) of this section shalJ be donated
to Research Institution or if not acceptable to Research Institution shall be disposed
of in a manner which will not amount to unnecessary cruelty to animals by the City
Veterinarian;
b. Healthy cows, carabaos, pigs, goats, and chickens shall be slaughtered at the City
Slaughter House and shall be sold for public consumption in accordance with the
existing Jaws and regulations.

c. All sick and other kinds of impounded animals shall be killed humanely.

Shall be amended to, and shall include;

Animals impounded, unless redeemed by the owner(s), shall be for proper

disposition by the Citv Pound.

All impounded dogs and cats that are at least three (3) months old which have not
been vaccinated against rabies shall be vaccinated prior to release from the City Pound.

ART. S. - "Section 6. Vaccination and Impounding Fees

Itnpounding Fee~ there shall be an impounding fee for animal impounded as fo11ows:

For each animal P 100.00

For each animal not redeemed, an additional daily charge of
Ten Pesos (P l 0.00) shall be imposed

Vaccination fee - all impounded dogs and cats redeemed or sold at a public auction
which have not been vaccinated against rabies and at least three (3) month old shall be
vaccinated against rabies prior to release.

Shall be amended to:

Impounding Fee- there shall be an impounding fee for each animal impounded as
follows:

The said impounding fee shall be paid directly to the Baran gay Treasurer, and
shall be used for the maintenance of the Temporary holding/impounding, or
similar purpose.

ART. 6 - "Section 8 - The City Govenunent shall provide one (l) impounding vehicle for the
City Pound."

Shall be amended to:

Section 8. Implementation -

a. The lloilo City Government shall provide two (2) impounding vehicles for
the City Pound.

It shall also provide, tbrougl1 the City Veterinarian's Office, informative

materials containing, among others, basic information about rabies and
the penalties and/fees for violation of this ordinance. Said informative
materials shall be posted in conspicuous places in the barangay;

b. The Barangay shall provide a temporanr holding/impounding facility for

impounded animals, said facility shall be duly-approved by the Ci!l!
Veterinarian;

c. The City Veterinarian's Office shall provide the necessary training for the
Animal Catchers, and spearhead the information education campaign in
pursuit of a Rabies-free Jloilo City;

ART. 7. SEPARABILITY CLAUSE

In the event that any provisio11 of this ordinance is declared invalid, the other provisions
not affected thereby shal1 remain in ful1 force and effe(...'t.

ART. 8. REPEALING CLAUSE

All local Jaws, rules and regulations which are inconsistent with this ordinance are hereby
repealed or modified accordingly.

ART. 9. EFFECTIVITY CLAUSE

This ordinance shall take effect after sixty (60) days upon approval and compliance with
the prescribed mandatory posting and pub.lication requirements.
