REGULATION ORDINANCE NO. 2018-102

AN ORDINANCE SUSPENDING THE IMPLEMENTATION OF REGULATION
ORDINANCE NO. 2015-305 PARTICULARLY SECTION 33 OTHERWISE KNOWN AS
THE ORDINANCE AMENDING SECTION 31 (A) AND 33 OF ORDINANCE NO. 2004-
149 OF THE ENVIRONMENT CODE OF ILOILO CITY

Lady Julie Grace L. Baronda, and Hon. Ely A. Estante, Jr.;

WHEREAS, on June 23, 2015, amendment to Ordinance 2015-305 was enacted as

follows:

"Sec. 31 - Regulating Garbage Disposal, Cleanliness and Sanitation

a. Municipal Wastes - xx xx xx x. It may also arrange a weekly or twice-weekly
schedule for yard and garden sweeping and cuttings as well as other special
wastes and for which a service fee of One Thousand Five Hundred Pesos ( P
1,500.00) per trip is charges. xx xx xx x
b. Sec. 33- Tipping Fee - xx xx xx. The City Government shall charge tipping
fees for deliveries of solid wastes at the dumpsite of Brgy. Calajunan for
private haulers at the rate of THREE PESOS (P 3.00) per kilo. "

WHEREAS, on July 16, 2018, Regulation Ordinance 2015-305 took effect adjusting the
tipping fee for the dumping of garbage at the Calajunan Dumpsite for NINETY PESOS (P
90.00) per cubic meter to THREE PESOS (P 3.00) per kilo;

WHEREAS, the private haulers and recyclers operating within the City of Iloilo as well
as in the neighboring municipalities have aired their concerns considering that the adjustment in
tipping fees had a sudden and considerable increase which severely affect their business;

WHEREAS, some of these private haulers are hired by private companies to augment the
garbage collection trips of the city;

WHEREAS, based on the initial meeting and discussion with these private haulers, it
appears that there is some merit on their request to review the newly established tipping fee;

WHEREAS, pending determination of the said matter, there is a need to suspend the
implementation of the said rate in the understanding that the old rate for Tipping Fee under
Regulation Ordinance 2004-149 Section 33 of NINETY PESOS (P90.00) per cubic meter will
be implemented in the meantime;

NOW, THEREFORE, let it be resolved as it is hereby resolved by the Sangguniang

Panlungsod, in session assembled that:

Section I. - The implementation of Regulation Ordinance No. 2015-305 otherwise

known as an "Ordinance Amending Sections 31 (A) and 33 of Regulation Ordinance No. 2004-
149 of the Environment Code oflloilo City" particularly Section 33 is hereby suspended;

Section 2. - The old rate for Tipping Fee under Regulation Ordinance 2004-149 Section
32 of NINETY PESOS ( P 90.00) per cubic meter in the meantime shall be followed;

Section 3. - The existing laws regulating the dumping of Residual Waste at the Calajunan
Dumpsite shall strictly be imposed.
