COUNTER AFFIDAVIT

I, JUAN JOSE, of legal age, Filipino, with residence and postal address at 88
Mark Street, Sunset Valley Homes, Barangay Cutcut, Angeles City, after having been
duly sworn in accordance with law, do hereby depose and say:

1. That I personally know IAN T. KO, of legal age, Filipino, with residence at
456 Trinity Square, Sunset Valley Homes, Barangay Cutcut, Angeles City;

2. That on June 25, 2018, on or around 5 to 6 in the evening, I went to a


restaurant/bar in Korean Town, Friendship Highway since my friend, MIKEY BUSTOS,
wanted to show-off his skills in cooking Samgyeupsal the proper way;

3. That on the said night, Mikey vividly described the proper cooking
procedure which caused the attraction of other people’s attention, including the staff of
the restaurant;

5. That due to an accident caused by the waiter of the said establishment,


half of the soju was poured in the cooking grill, where a huge flame resulted;

6. That the said resulting incident startled all of us, which caused me to shout
the said employee, “Putangina naman kuya, magdahan-dahan ka naman!”;

7. That after such incident, the management asked dispensation for the
incident;

8. That after such incident, I went to the bathroom to fully calm myself so as
not to spoil the night;

9. That as I came out of the bathroom, I saw Ian Ko and his group ganging
up on Mikey and confronting him of what has earlier transpired;

10. That in the middle of the heated conversation, it turns out that the
employee was a friend of Ian Ko;

11. That despite the explanation offered by Mikey and the employee himself,
still, Ian Ko was enraged;

12. That out of nowhere one fist already landed on the face of Mikey;

13. That upon seeing that Ian Ko’s fist is approaching, I defended myself by
punching him as well since, at that time, it was the only defense that I could think of;
14. That upon seeing Juan Jose attempting to punch me for the second time,
and his friend approaching me with a clenched fist, I immediately forestalled it by
pushing Ian Ko, who is in front if me, and his friend;

15. That if it was not for the help of my friends and the staff of the
establishment where we ate, Ian Ko and his group would not have stopped punching
and cursing at us;

16. That Juan Jose scheduled on June 27, 2018, a meeting at the Office of
the Barangay in Barangay Cutcut to settle the dispute, which I asked to be re-scheduled
as I was out of the country due to an important business meeting;

17. That I advised Juan Jose that we should just meet on June 29, 2018 as
my return would be on June 28, 2018, but the same refused to heed my request;

18. That I struck Ian Ko only as a cause of self-defense;

19. That I am executing this affidavit to attest to the truth all the forgoing facts
and in order to counter a filed criminal complaint for violation of Article 265 (Slight
Physical Injuries) of “The Revised Penal Code of the Philippines” at the proper forum.
