Dear Mr. Grow:

Linebach Funkhouser, Inc. (LFI), consultant for the Louisville Metro Government, has
completed this Memorandum relative to the above-referenced property. This document has been
prepared to summarize recent sampling activities that were completed at the site as directed by
and in conjunction with the Kentucky Division of Waste Management (KDWM), Superfund
Branch.

BACKGROUND

Champions Park (formerly Edith Avenue Landfill) is located at 2050 River Road east of
downtown Louisville, Kentucky. The site is transected by Edith Road and exists between River
Road to the north and I-71 to the south. The landfill was operated by the City of Louisville
between the years of 1970 and 1991 under the KDWM Solid Waste Branch’s Permit Number
05600006. The primary material disposed of at the landfill was incinerator ash from the City of
Louisville’s former municipal waste incinerator. Throughout the years of landfill operation,
KDWM authorized limited disposal of additional materials in the landfill, including digested
sewage sludge, debris from tornado damage in 1974, street sweepings, solid plastics, metallic
materials, glass, ceramics, rock, soil, shredded tires and old appliances.

The disposal of incinerator ash was stopped in 1991 and a Closure Plan was approved by
KDWM. Following implementation of the closure plan, including final grading, placement of a
two-foot thick soil cap and vegetative cover, and installation of groundwater monitoring wells,
closure activities were completed in 1993. Groundwater monitoring continued until 1998. In
1994, KDEP authorized the City of Louisville to install soccer fields on the landfill cap and the
property was converted to the Louisville Soccer Park, which later became Champions Park.

The total landfill area covers approximately 50 acres and consists of two sections, existing on the
east and west sides of Edith Road as follows:

 Cell A – located on the east side of Edith Road (approximately 28 acres)


 Cell B – located on the west side of Edith Road (approximately 22 acres)

A weekend-long music festival (Bourbon and Beyond Festival) occurred at Champions Park on
September 22 and 23, 2018 and portions of the closed landfill were used for parking Recreational
Vehicles (RVs) and other related vehicles during the event. Record setting rainfall which
occurred during the festival created significant flooding of Champions Park and surrounding
areas, resulting in cancellation of the festival on the second day (September 23rd). Due to the wet
conditions, the RVs and other vehicles parked on the landfill damaged the existing soil and
vegetative cap which created ruts up to 5-inches deep. KDWM representatives inspected the
landfill via aerial photography during the week of September 24, 2018 to observe the damage
and met with Louisville Metro Government officials at their office to discuss the site. During the
initial meeting between the KDEP and Louisville Metro Government, concerns were raised that
the buried material underlying the landfill cap may have been exposed. In response to that
concern, an initial site visit was performed by LFI representatives on October 4, 2018 to
determine the extent of damage to the cap. Based on the initial site reconnaissance, LFI
contacted the KDWM Superfund Branch representatives on that day to report that there was no
obvious visual observations that the cap had been breached. Therefore, LFI requested that a
follow up site visit be completed with representatives from the KDWM Superfund Branch to
confirm LFI’s initial observations and to collect confirmation soil samples within designated
areas where the deepest rutting was observed as directed by the KDWM.

PROCEDURES

On October 9, 2018, representatives from the KDWM State Superfund Section, Louisville Metro
Government, National Environmental Contracting (NEC) and LFI, contractor/environmental
consultant for Louisville Metro Government, met at the site. The purpose of the meeting was to
observe the condition of the landfill cap for potential impacts/releases of regulated substances to
the environment. In addition, four grab samples were collected from the site in areas deemed by
both the KDWM and LFI personnel to be representative of the “worst case” conditions relative
to the rutted areas as shown in the attached photographs. KDWM and LFI collected samples
utilizing hand tools and split samples from the following locations:

Cell A – located on the east side of Edith Road

 TT (Tractor Trench)-1

 EP (East Perimeter)-1

 EB (East Bathroom)-1

Cell B – located on the west side of Edith Road

 WB (West Bathroom)-1

LFI’s samples were placed in laboratory supplied containers, labeled, and packed in an iced
cooler with appropriate chain-of-custody documentation. Samples were shipped via overnight
courier to Pace Analytical, Inc. (Pace) in Mt. Juliet, Tennessee for analysis. The KDWM hand
delivered their samples to McCoy and McCoy Laboratories, Inc. in Lexington, Kentucky for
analysis.

The following procedure description was provided to LFI by the KDWM personnel generally
describing their sampling protocol:

 A walkover of the entire park area was performed by the personnel present, and a
number of photos were taken, a few of which are included below. No ruts greater
than approximately 4 to 5 inches were found, with most appearing to be
shallower. As the ruts were made by vehicle tracks, some soil material along the
edges had been pushed up to a level above original grade, and depths of
penetration could only be estimated. A 7.5 x 5" field book was included in the
photos for scale. No landfill material was visually identified in any of the ruts, as
the landfill cap is reportedly a minimum two feet in thickness. Four sample
points were located in what appeared to be among the deepest ruts that could be
found, which were split between Superfund and LFI staff. The samples were
analyzed for total RCRA metals; the Division samples were shipped to McCoy &
McCoy Labs in Madisonville for expedited turnaround.

Copies of LFI’s laboratory data sheets and chain of custody documentation are provided as an
attachment.

RESULTS/CONCLUSION/ RECOMMENDATION

All total metals concentrations were consistent with naturally occurring background levels from
both laboratories. No obvious evidence of the material that exists below the clay cap was
observed and total metal concentrations in soils that were sampled in the deepest ruts are
consistent with unrestricted site use levels. The analytical results are summarized on the attached
Table 1.

Therefore, consistent with the Superfund Branch’s recommendations, LFI recommends no


remedial action at the park with respect to KRS 224.1-400, as no evidence of a release to the
environment was discovered.

During the site visit, Louisville Metro Government officials expressed the desire to level the
surface of the park grounds and re-seed with an appropriate mix consistent with current seasonal
conditions, with little or no addition of soils/cap material. LFI concurs with the City and
KDWM personnel that a Corrective Action Plan (CAP) needs to be prepared outlining
procedures for repairing the surface of the cap in a timely manner so that the site can be restored
for recreational use prior to the Spring of 2019. Therefore, LFI is requesting an issuance of a
letter to Louisville Metro Government by the KDWM directing the preparation and
implementation of a CAP.

The information below is designed to better explain the various terms used in your report of analytical results from the Laboratory. This is not

The name of the particular compound or analysis performed. Some Analyses and Methods will have multiple analytes

If the sample matrix contains an interfering material, the sample preparation volume or weight values differ from the Qc
standard, or if concentrations of analytes in the sample are higher than the highest limit of concentration that the
Dilution laboratory can accurately report, the sample may be diluted for analysis. If a value different than 1 is used in this field, the
result reported has already been corrected for this factor. 7

These are the target % recovery ranges or % difference value that the laboratory has historically determined as normal

Limits for the method and analyte being reported. Successful QC Sample analysis will target all analytes recovered or
duplicated within these ranges. 8
The non-spiked sample in the prep batch used to determine the Relative Percent Difference (RPD) from a quality control Al

sample. The Original Sample may not be included within the reported SDG.
This column provides a letter and/or number designation that corresponds to additional information concerning the result 9
Qualifier reported. If a Qualifier is present, a definition per Qualifier is provided within the Glossary and Definitions page and Sc
potentially a discussion of possible implications of the Qualifier in the Case Narrative if applicable.
The actual analytical final result (corrected for any sample specific characteristics) reported for your sample. If there was
no measurable result returned for a specific analyte, the result in this column may state “ND” (Not Detected) or “BDL”
Result (Below Detectable Levels). The information in the results column should always be accompanied by either an MDL
(Method Detection Limit) or RDL (Reporting Detection Limit) that defines the lowest value that the laboratory could detect
or report for this analyte.
A brief discussion about the included sample results, including a discussion of any non-conformances to protocol
Case Narrative (Cn) observed either at sample receipt by the laboratory from the field or during the analytical process. If present, there will
be a section in the Case Narrative to discuss the meaning of any data qualifiers used in the report.
This section of the report includes the results of the laboratory quality control analyses required by procedure or
Quality Control analytical methods to assist in evaluating the validity of the results reported for your samples. These analyses are not
Summary (Qc) being performed on your samples typically, but on laboratory generated material.
This is the document created in the field when your samples were initially collected. This is used to verify the time and
Sample Chain of date of collection, the person collecting the samples, and the analyses that the laboratory is requested to perform. This
Custody (Sc) chain of custody also documents all persons (excluding commercial shippers) that have had control or possession of the
samples from the time of collection until delivery to the laboratory for analysis.
This section of your report will provide the results of all testing performed on your samples. These results are provided
Sample Results (Sr) by sample ID and are separated by the analyses performed on each sample. The header line of each analysis section for
each sample will provide the name and method number for the analysis reported.
This section of the Analytical Report defines the specific analyses performed for each sample ID, including the dates and
Sample Summary (Ss) times of preparation and/or analysis.

Qualifier Description
J3 The associated batch QC was outside the established quality control range for precision.
J5 The sample matrix interfered with the ability to make any accurate determination; spike value is high.
J6 The sample matrix interfered with the ability to make any accurate determination; spike value is low.
The analyte failed the method required serial dilution test and/or subsequent post-spike criteria. These failures indicate
O1 matrix interference.
