JUDICIAL AFFIDAVIT

I, RORY C. BAUTISTA, 40 years old, married, Filipino, and with

residence at Unit 1707, 17th floor, Gramercy Condominiums, Makati Avenue,
Makati City, Metro Manila, state under oath as follows:

Preliminary Statement

I am being examined by Atty. Glenn Francis Gacal, with address at Unit

503, 5 Floor, Century City Lifestyle Center, Kalayaan Ave. cor, Salamanca
St., Brgy. Poblacion, Makati City. The examination is being held at the same
address. I am answering the questions fully conscious that I do so under oath
and may face criminal liability for false testimony and perjury.

Questions and Answers

Q1: Do you know, Lexi S. Ramirez, the plaintiff in this case?

A1: Yes, Sir.

Q2: How do you know her?

A2: She lives next to my unit.

Q3: Do you know her personally?

A3: I do not know her personally but we exchange hi’s and hello’s upon
seeing each other in the corridors.

Q4: So, you both live in the same condominium?

A4: Yes.

Q5: What is the name of your condominium?

A5: Gramercy.

Q6: Where is Gramercy?

A6: It’s the one near Makati Avenue.

Q7: What is your unit number?

A7: Unit 1707.

Q8: Where is Lexi’s unit?

A8: Unit 1708.

Q9: How long have you been staying in Gramercy?

A9: For about two years now.

Q10: You did not transfer units during these two years?
A10: No, Sir.
Q11: During these two years, did you see Lexi with another man?
A11: No, but I am sure she was with a man sometime January.

Q12: Do you remember when exactly in January?

A12: I cannot but I think it was around mid-January. I think it was a Sunday
night because I was studying for an exam for the next day.

Q13: What time were in your unit on that night?

A13: I think I was in my unit already at around 8pm.

Q14: What made you say she was with a man?

A14: I heard Lexi talking with a man.

Q15: How can you hear them?

A15: Because my room is ajoint to Lexi’s room.

Q16: What else, if any, did you hear on that particular night?
A16: I heard moaning, shouting, and banging. Words and sounds were
unclear whether the male voice was laughing.

Q17: How long did the moaning, shouting and banging last?
A17: I hear the noises in intervals whenever I went back to my room to get
my books. I studied in the sala to avoid the noise.

Q18: Do you often hear these noises from Lexi’s room?

A18: No, Sir. It’s only this time.

Q19: Did you stay in your unit the whole evening?

A19: Yes, Sir. I just studied in the sala room.

Q20: How long did you study?

A20: I think I studied until around 3am.

Q21: What time did you sleep?

A21: I think it was around 3am also, when I stopped studying.

Q21: Do you remember what time you woke up the following day?
A21: I woke up around 8am, Sir.

Q22: Do you have anything more to say about this case?

A22: No more sir.

Q23: Why did you execute this Judicial Affidavit?

A23: I am executing this Judicial Affidavit to attest to the truth of all the
foregoing facts, to serve as my direct testimony, and for all other intents
and purposes.
