…while analyses of law tend to focus on conflict and resolution, rule-making or rule-applying,
one can – without in any way downplaying these aspects – also see law as contributing to the
formation of an entire cosmology, a way of envisioning and creating an orderly sense of the
universe, one that arranges humanity, society and ultimate beliefs into a scheme perceived as
palpably real.
-Lawrence Rosen, Law as Culture: An Invitation, 11
Does obedience to the Divine motivate particularism (sticking with your group),
universalism (concern for everyone, even beyond your group), or both?
What is the difference between the way the Rambam talks about God with respect to
stealing from someone who is pagan, and the way he does so with respect to working a
Canaanite indentured servant oppressively?
Do you think that following halakhah enhances a person’s moral character? Why or why
not? And how?

Do you think it is important to work for social reform in America, along the lines of the
idea of tzedek outlined by Dyonna Ginsburg?

…every one of the six hundred and thirteen precepts serves to inculcate some truth, to remove
some erroneous opinion, to establish proper relations in society, to diminish evil, to train in
good manners or to warn against bad habits. All this depends on three things: opinions: morals,
and social conduct.

pursuit of justice through systemic and structural reform, and (4) Tikkun Olam – our moral
responsibility as Jews to the non-Jewish world.
You can see three basic approaches for the rationale of dina de-malchuta dina. Do any
of them seem relevant to today?
Do you think that dina de-malchuta dina is about following law or also about civic duty?

Except writs of divorce – for they are not deemed effective agents of severing [a halakhic
marriage] because they are not party to [halakhic] matrimonial law. Gentiles are, however,
commanded to institute justice…
11b. R. Isser Zalman Meltzer, Even Ha-Ezel, Laws of Monetary Damages 8:5
ונראה דמה שכתב רש"י דעל הדינים נצטוו בני נח הוא חד טעמא עם דינא דמלכותא דינא והיינו דכיון דבני נח...

And it seems that what Rashi wrote that gentiles are commanded to institute justice is the
equivalent of the law of the kingdom is the law, meaning that because gentiles are commanded
to make law, the sovereign may make regulations for the purpose of repairing/preserving the
state, e.g., to obligate residents of the state in a tax which will be used to repair/preserve the
state.
