JUDICIAL AFFIDAVIT – WITNESS

I, Reynato Rota y Dagami, 59 years old, married, farmer, a resident of

Brgy. Tagadtaran, Burauen, Leyte, after having been duly sworn to in accordance with
law, hereby depose:

That this judicial affidavit pertains to the investigation conducted by PO3 Samuel
Jade R. Alpino at Burauen Police Station, Burauen, Leyte under the supervision of
PSINSP RODOLFO C. RENOMERON JR, Acting Chief of Police relative to the
Qualified Theft of Coconut Incident at the land parcel owned by Simeon & Emerita
Relador, that transpired last June 13, 2018 at more or less 9:00 o’clock in the morning
at Brgy. Tagadtaran, Burauen, Leyte;

That I hereby state, that in answering the questions asked of me as appearing

below, I was fully conscious that I did so under oath and that I may face criminal liability
for false testimony or perjury;

Pakiana 1: Ikaw ba in nagsusumat hit kamatuoran ngan puro kamatuoran la hini

nga imbestigasyon?
(Do you swear to tell the truth and nothing but the truth only in this investigation?)

Baton: Oo sir.
(Yes sir.)

Pakiana 2: Disidido ka ba maghatag hit imo libre ngan boluntaryo nga asoy?
(Are you willing to give your free and voluntary statement?)

(Yes sir.)

Pakiana 3: Kay-ano nga aanhi ka ha opisina han Burauen Police Station?

(Why are you here at the office of Burauen Police Station?)

Baton: Anhi ako para hin pagsuporta hin pagtistigo bahin han iginpasaka
nga kiha kontra kanda Absalon Cajara alias Yeye, Arlene R. Tolibas, ngan duha
nga diri ko kilala ha ngaran nga mga umangkon eni ni Yeye Cajara.
(I am here to support as witness for the case being filed against
Absalon Cajara alias Yeye, Arlene Tolibas and two (2) John Does who are nephews of
alias Yeye Cajara)

Pakiana 4: Nakilala ka kun hin-o hit tagreklamo hini nga kaso?

(Do you know the private complainant of this case?)

Baton: Oo sir, Mario Relador y Manasis, 60 years old, married, retired PNP
member, a resident of La Paz Street, District 6, Burauen, Leyte.
Pakiana 5: An suspetsado hini nga krimen, nakilala kaba liwat hini ha iya?
(The suspect of this crime, do you also know him?)

Baton: Oo sir, hi Absalon Cajara alias Yeye, Arlene Tolibas ngan an duha
nga tawo nga diri ko kilala ha ngaran nga mga kaumangkunan eni ni alias Yeye
Cajara)
(Yes sir they are Absalon Cajara alias Yeye, Arlene Tolibas and two (2) John
Does who were nephews of alias Yeye Cajara.)

Pakiana 6: Kakan-o og diin natabu ini nga insidente?

(When and where did this incident happened?)

Baton: Nahitabo eni hadto han June 13, 2018 mga banda alas 9:00 han aga
dito ha Brgy. Tagadtaran, Burauen, Leyte partikularyo ngadto han gintatag-iyahan
nga tuna han kag-anak ni Mario Relador.
(This incident happened last June 13, 2018 around 9:00 o’clock morning at
Barangay Tagadtaran, Burauen, Leyte particularly at the parcel of land owned by
parents of Mario Relador.)

Pakiana 7: Nakain ka man han mahitabo eni nga incidente?

(Where were you when this incident happened?)

Baton: Nakadto ako guihap hito nga tuna nga gintatag-iyahan han kag-
anak ni Mario M. Relador.)
(I was also there at the said parcel of land owned by parents of
Mario M. Relador.)

Pakiana 8: Nag-aano kaman didto hito nga lugar?

(What are you doing on that said place?)

Baton: Usa ako han mga sinuhulan ni Mario Relador para magharas dida
hito na tuna na guintatag-iyahan han ira kag-anak.
(I am one of the hired workers of Mario Relador to clean the parcel of land of his
parents.)

Pakiana 9: Pwede mo ba igsaysay an panhitabo?

(Will you please narrate the incident)

Baton: Oo, sir hadton mga banda alas 8:30 han aga sumubra magkulang
han Hunyo 13, 2018 ginsugo kami ni Mario Relador kaupod an akon ig kasi ko
magtratrabaho nga hi Pepito Hecto para magtaod han tarpaulin didto hito nga
tuna nga gintatag-iyahan han kag-anak ni Mario Relador pero waray kami tuguti ni
Arlene Tolibas. Igin pabal-in ngadto ha may ubos, nga amo didto namon igin
taod an tarpaulin.
(Yes sir, last June 13, 2018, I together with Pepito Hecto was instructed by Mario
Relador to post his tarpaulin at the parcel of land of his parents. But Arlene Tolibas
defended not to put that said tarpaulin and instructed us to put it in the lower portion,
where we obliged.)

(What happened next?)

Baton: Kahuman namom itaod han tarpaulin nagtikang kami pagharas

pagkalibay hin mga 30 minutos sumubra mga banda alas 9 han aga han amo la
guihapon nga petsa, nakita ko hi alias Yeye Cajara kaupod an iya duha nga
umangkon nga kilala ko la ha nawong.
(After we posted the tarpaulin, we started to cut the grass, and after 30 minutes
had past at around 9:00 o’clock in the morning of same date, I saw alias Yeye Cajara
together with two (2) John Does).

(What did they do there?)

Baton: Tigda dayon hunulbot ni alias Yeye Cajara an iya sundang nga igin
katirigbas an amon upod nga konsehal nga hi Arnel Raga nga amo dumalagan
liwat eni ngadto ha may luyo han lubi.
(Alias Yeye Cajara pulled his long bladed weapon and attempted to hacked our
companion barangay counselor Arnel Raga who immediately run towards the back of
the coconut trees.)

(What happened next?)

Baton: Humawid hi Mario Relador nga ayaw nadiri ako hin samok nga kun
diri ka natugot pagharas manguli kami, kahuman hito ha amon liwat umatubang
nga nag ginuliat nga “MYDA PAMATAY HA IYO KUN MAGPADAYON KAMO PAG
HARAS”. Ginbaton nakon eni hi alias Yeye Cajara nga ginsuhulan la kami, gin
baton la liwat ako niya nga hadabi kamohini, ginbaton ko la hiya bahala ka kun
idabi mo kami kay sinuhulan la kami, ngan umatubang eni ngadto kan Mano
Mario Relador ngan gin yaknan hi alias Yeye Cajara nga manguli kami, kahuman
nagtikadto eni hi Yeye Cajara ngadto han iginbutang namon nga tarpaulin nga iya
eni gin taw-taw gamit an iya dara nga sundang nga peke eni nge decision
kahuman nagtikadto hiya han may langdahan, samtang kami in nag tiuli tikadto
ha baryo han Tagadtaran.
(Mario Relador pacified alias Yeye Cajara that he doesn’t want any trouble that
we will go home if that’s what you want. As said alias Yeye Cajara turned his attention
on us and cried out “MYDA PAMATAY HA IYO KUN MAGPADAYON KAMO PAG
HARAS” as I answered him that we’re only hired, as he answered back you will get
involved on this, as I answered him back it’s up to you, I was only hired, and then he
was told by Mario Relador that we are going home and there alias Yeye Cajara went to
the posted tarpaulin and destroyed it by hacking using his long bladed weapon while
saying this is a fake decision. After which he went to the kiln, as we went home going to
the direction of Barangay Tagadtaran proper.)

Baton: Waray na ha pagkayana sir.

Pakiana 14: Ubos hini nga imo asoy nakabutang it imo ngaran, boluntaryo ka ba
