LIGAYA D. BAROTE, also of legal age, Filipino, married to Delfin M. Barote, and a
resident of barangay Magatas, Sibulan, Negros Oriental, hereinafter referred to as the VENDEE;
WITNESSETH:
That there is a certain parcel of land known as Lot 767, of the Cadastral Survey of
Sibulan, located at barangay, Tubtubon, Sibulan, Negros Oriental, covered by Original
Certificate of Title No. 16524; consisting of EIGHT THOUSAND THIRTY THREE (8,033)
square meters, more or less, owned in equal shares by ALFONSO, SINFROSA, PONCIANO,
NICOLAS, RUFO, and DIONISIO, all surnamed DIPUTADO; and which parcel of land is more
particularly described as follows:
That the Heirs of the aforementioned owners had verbally partitioned and subdivided Lot
No. 767 in to six (6) equal parts consisting of ONE THOUSAND THREE HUNDRED THIRTY
NINE (1,339) square meters each, viz: Lot No. 767-A, was awarded to the Heirs of Alfonso
Diputado; Lot No. 767-B, was awarded to the Heirs of Sinfrosa Diputado; Lot No. 767-C was
awarded to Ponciano Diputado; Lot No. 767-D was awarded to Nicolas Diputado; Lot No. 767-E
was awarded to Rufo Diputado; and Lot No. 767-F was awarded to Dionisio Diputado; and that
after the partition or subdivision each of them immediately took possession of their respective
shares;
That SINFROSA DIPUTADO, died sometime ago, leaving without any testamentary will
nor debts not settled until the present and upon her death she was survived by her legitimate and
only compulsory heirs, namely: AMBROSIA ESTINOPO-MOLAS and FRANCISCO
ESTINOPO;
That invoking the provisions of Section 1, Rule 74 of the Rules of Court, the heir-vendor,
Francisco Estinopo, does hereby settle and adjudicate unto himself the one-half (1/2) portion of
Lot No. 767-B consisting of SIX HUNDRED SIXTY EIGHT (668) square meters, more or less;
WITNESSETH FURTHER:
That for and in consideration of the sum of TWO HUNDRED SIXTY SEVEN
THOUSAND TWO HUNDRED PESOS (Php.267,200.00), Philippine Currency, in hand paid by
the Vendee herein and receipt in full is hereby acknowledged by the Heir-vendor to his entire
satisfactions and that by virtue of these presents the herein Heir-Vendor does hereby SELL,
TRANSFERRED, and CONVEY unto the vendee, her heirs and assigns, all the vendors’ rights,
interests and participation over Lot No. 767-B, consisting of Six Hundred Sixty Eight (668)
square meters, more or less, free from all liens and encumbrances;

That the vendor herein declare that this land is not tenanted nor worked upon by an
agricultural lessee and that due notice has been given to all persons affected by this transaction
in compliance with the provisions of the New Civil Code of the Philippines, pertaining to the
rights of the redemptioner and preemptioner, but nobody opted to exercise the said rights and the
sale of these parcels land is in consonance with the provisions of the Comprehensive Agrarian
Reform Law because this parcel of land is within the retention limits of the vendor, further, the
vendor warrants her ownership over the said parcel of land and will defend the rights of the
herein vendee against any adverse claim whatsoever.
IN WITNESS WHEREOF, we have hereunto affixed our signatures this ___day of May
2007, at Tayasan, Negros Oriental.

FONTELO VALENCIA and I am known in our community under the said name;
That I have only learned lately that my correct and true name as entered in my Live Birth
Certificate is MINDA PROSPERA FONTELO VALENCIA;
