Ms. No. 1418, Home (Transport-Vil, 10th October 2007.) No SRO A-46/2007.—The following Notification of the Government.of India, Ministry of Shipping, Road Transport and Highways (Department of Road Transport and Highways), New Delhi, the 10th April, 2007 is republished:— G.S.R.276(E)—Whereas the draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, published as required by sub-section (1) of Section 212 of the Motor Vehicles Act, 1988 (59 of 1988) in the Gazette of india, Extraordinary, Part lI—Section 3, sub-section (), dated the 21st September, 2006, vide Notification of Government of India in the Ministry of Shipping, Road Transport and Highways (Department of Road Transport and Highways), Number G.S.R. 583(E), dated the 21st September, 2006, inviting objections and suggestions from all persons likely to be affected thereby within @ period of sixly days from the date on which the said notification was published, were made available to the public; And whereas, copies of the sald Gazette were made available to the public on the 26th September, 2006 ; ‘And whereas, the objections and suggestions received from the public on the sald draft rules have been considered by the Central Government; Now, therefore, in exercise of the powers conferred by Sections 27, 64, sub-section (9) of Section 8, Section 110 and Section 139 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely— 1. (1) These rules may be called the Central Motor Vehicles (Amendment) Rules, 2007. (2) They shall come into force on the date of their publication in the Official Gazette 2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred as the said rules), in rule 2, in clause (0), for the words ‘but excluding the countries with whom there are no diplomatic relations”, the words and figurés “that are Convention on Road Traffic signed at Geneva on 19th day of September, 1949" shall be substituted 3. In tule 4 of the said rules, after item number 11 and the entry relating thereto, the following item number and the entyy shall be inserted, namely:— "12. proof of legal presence in India in addition to proof of residence in case of foreigners. 4. Aer rule 7 of the said rules, the following rule shall be inserted, namely:— “8, Minimum educational qualification for driving transport vehicles. —The minimum educational qualification in respect of an applicant for obtaining a licence to drive a transport vehicle shall be @ pass in the eighth standard—————— Oct. 31, 2007] TAMIL NADU GOVERNMENT GAZETTE Provided that the minimum educational qualification specified in this rule shall not apply In the case of— (0. renewal of a driving licence to drive a transport vehicle; or i) addition of another class of transport vehicle to the-driving licence ; ‘already held before the commencement of the Motor Vehicles (Amendment) Rules, 2007. 5. In mule 10 of the said rules,— (the words “or renewal” shall be omitted: (i) after item number (d) and the entry relating thereto, the following items and the entries shall be inserted, namely:— (2) proof of residence. (proof of age. {g) proof of citizenship." 6. In rule 14 of the said rules, in sub-rule (1), after item number (e) and the entry relating therelo, the following items ‘and the entries shall be inserted, namely:— “(0 proof of residence. (u)proof of age. (h) proof of citizenshi 7. In rule 18 of the said rules, after sub-rule (2), the following sub-rule shall be inserted, namely:— “(@) Where the licensing authority renewing the driving licence is not the licensing authority who issued the driving licence the fact of the renewal shall be intimated to the licensing authority who issued the driving licence: Provided that in case the application is for issuance of a duplicate driving licence which has been lost, tom or rmuttated such that the identification or authenticity of the document cannot be reasonably established, the licensing authority receiving such application shall on confirmation from the original issuing authority, issue the duplicate driving licence: Provided also that if such confirmation is not received within 60 days, duplicate licence shall be issued, without waiting for the confirmation” 8. In rule 32 of the said rules, in the TABLE — () against serial number 1, under column number (2), the words “or renewal” shall be omitted; (ii) for serial number 8 and the entries relating thereto, the following serial numbers and the entries shall be substituted, namely:— o @ “8, In respect of addition of another class of ‘motor vehicle to the driving licence in Form 7 8A. In respect of renewal of driving licence in Form 7 88. In respect of renewal of driving lience in Form 7 for which application is made after the grace period. e ‘Two hundred rupees including the cost of ‘computerized chip ‘Two hundred fity rupees including the cost ‘of Smart Card, ‘Two hundred rupees including the cost of computerized chip and additional fee at the rate of fity rupees for a period of delay of one year or part thereof reckoned from the date of expiry of the grace period. @) 17(4@) 18(1)(¢) 18(1)(8) ©) " " 18" 9. In rule 47 of the said rules, in sub-rule (1) after item number () and the entry relating thereto, the following item ‘and the entries shall be inserted, namely:— “(proof of citizenship. (®) proof of legal presence in India in addition to proof of residence in case of forejgners.”
