(अ). िनयम, 1971 का और संशोधन करने के िलए िन%निल3खत 5ा6प
िनयम, 3ज9ह: के9;<य सरकार क+टनाशी अिधिनयम, 1968 (1968 का 46) क+ धारा 36 Aारा 5दBत श3CतयD
का 5योग करते हुए बनाने का 5Fताव करती है , भारत सरकार के कृ ष मं ालय (कृ ष और सहका रता
वभाग) क+ अिधसूचना म:, भारत के राजप , असाधारण, भाग II, खंड 3, उपखंड (i) तार<ख
13 फरवर<, 2015 म: सा.का.िन. सं. 92(अ) तार<ख 13 फरवर<, 2015 Aारा 5कािशत कया गया था, उन सभी
Lय3CतयD से, 3जनके उससे 5भा वत होने क+ संभावना है उस तार<ख से, 3जसको उCत अिधसूचना वाले
राजप क+ 5ितयां, जनता को उपलMध करा द< गई थी पNतालीस दन क+ अविध समाOत होने से पूवP आRेप
और सुझाव मांगे गए थे ।
और उCत राजप अिधसूचना क+ 5ितयां तार<ख 13 अ5ैल, 2015 को जनता को उपलMध करा द< गई
थीं;
उCत अिधसूचना क+ बाबत आRेपD और सुझावD पर वचार कर िलया गया है ;
अब के9;<य सरकार क+ यह राय है क ऐसी प र3Fथितयां उBप9न हो गई हN जो बोडP के साथ परामशP

कए बना िनयम बनाने क+ आवWयकता 5दान करती हN ;

के9;<य सरकार, अिधिनयम क+ धारा 36 के परं तुक के िनबंधनD के अनुसार, इन िनयमD के बनाए
जाने के छ: माह के भीतर बोडP से परामशP करे गी और उन सुझावD पर वचार करे गी जो बोडP इन िनयमD के
संशोधन के संबंध म: दे ;
अत: अब, के9;<य सरकार, क+टनाशी अिधिनयम, 1968 (1968 का 46) क+ धारा 36 Aारा 5दBत
श3CतयD का 5योग करते हुए, क+टनाशी िनयम, 1971 का और संशोधन करने के िलए िन%निल3खत िनयम
बनाती है , अथाPत ्:--
1. (1) इन िनयमD का सं3ROत नाम क+टनाशी (संशोधन) िनयम, 2015 है ।

(2) ये राजप म: इनके 5काशन क+ तार<ख को 5वृBत हDगे ।
2. क+टनाशी िनयम, 1971 म:,-

(1) िनयम 6, के उपिनयम (4) म: शMदD, अंकD और अRर ''56प 2'' या 56प 2क'' के Fथान पर ''56प 2
या 56प 3'' शMद और अंक रखे जाएंगे;
(2) िनयम 7 के उपिनयम (1) म:, शMद, अंक और अRर “56प 2 ख” के Fथान पर “56प 4” शMद और
अंक रखे जाएंगे;
(3) िनयम 9 म:-
(i ) उप-िनयम (1) म:-
(क) ''या नवीकरण'' और ''जैसा भी मामला हो'' शMदD को हटाया जाएगा;
(ख) ''56प 3 या 56प 4'' शMदD और अंकD के Fथान पर ''56प 5'' शMद और अंक रखे जाएंगे;
(ii) उप-िनयम (3) म:-
(क) ''56प 5'' शMद और अंक के Fथान पर ''56प 6'' शMद और अंक रखे जाएंगे;
(ख) खंड (i ) म:, ''और कसी 5माणप का नवीकरण'' शMदD को हटाया जाएगा;
(ग) खंड (iv) हटाया जाएगा;
(iii) उप-िनयम 4(क) के पWचात िन%निल3खत उप िनयम अंत: Fथा पत कया जाएगा, अथाPत ् :-
''4(ख) एक Lय3Cत जो विनमाPण अनु^3Oत के िलए आवेदन करता है वह या उसके अधीन इस
5योजनाथP िनयुCत कमPचार< डाCटरे Cट के साथ रसायन व^ान म: माFटर ड_ी या तकनीक+
`ेणी क+टनाशकD के विनमाPण के िलए रसायन इं जीिनय रं ग म: ड_ी या क+टनाशक विनिमPित के
विनमाPण के िलए रसायन व^ान के साथ कृ ष व^ान म: Fनातक ड_ी धारण करता हो:
पर9तु एक वय3C
् त जो इस उप-िनयम के अिधसूचना क+ तार<ख को विनमाPण अनु^3Oत धारण
करता है उसे शै3Rक अहP ता 5ाOत करने के िलए दो वषP का समय दया जाएगा।'';
(4) िनयम 10 म:-
(i ) उप िनयम (1) म:, -
(क) शMदD और अंकD ''56प 6 और 56प 7'' के Fथान पर ''56प 7'' शMद और अंक रखे जाएंगे;
(ख) ''या नवीकरण'' और “जैसा भी मामला हो” शMदD को हटाया जाएगा ।

(i i ) उप-िनयम (1) के पWचात, िन%निल3खत उप-िनयम अंत:Fथा पत कया जाएगा, अथाPत ् :-

“(1क) एक Lय3Cत वaय, Fटाक या वaय के िलए 5दशPन या क+टनाशी के वतरण हे तु
अनु^3Oत 5दान करने के िलए आवेदन करता है , वह या उसके अधीन इस 5योजनाथP िनयुCत कमPचार< कृ ष
व^ान या जैव रसायन या जैव 5ौcोिगक+ या जीवन व^ान या रसायन व^ान या वनFपित व^ान या
5ाणी व^ान म: Fनातक ड_ी के 6प म: 9यूनतम अहP ता धारण करता हो।
पर9तु सभी फुटकर वaेता या ड<लर जो इस उप-िनयम के अिधसूचना क+ तार<ख को विधमा9य

अनु^3Oत धारण करते हD, उ9ह: शै3Rक अहP ता 5ाOत के िलए दो वषP का समय दया जाएगा।
(i i i ) उप िनयम (2) म:, “या नवीकरण” शMदD को हटाया जाएगा;

(i v) उप-िनयम (3क) म:, -
(क) खंड (i ) म:, शMदD, अंकD और अRरD “56प 6क ” और “56प 6ख” के Fथान पर “56प 7” शMद और
अंक रखे जाएंगे;
(ख) खंड (i i ) म:, शMद, अंक और अRर “56प 6 ग”, के Fथान पर “56प 8” शMद और अंक रखे जाएंगे;
(v) उप-िनयम (4 क) के खंड (i ) म:-

(क) शMद, अंक और अRर “56प 6 घ” के Fथान पर “56प 9” शMद और अंक रखे जाएंगे;
(ख) शMद “या नवीकरण” हटाए जाएंगे;
(vi ) उप-िनयम (6) के पWचात, िन%निल3खत उप िनयम अंत:Fथा पत कया जाएगा, अथाPत ्:-
“(7) सभी अनु^3Oतधा रयD Aारा 5Bयेक वषP िनयम 9 और िनयम 10 के अधीन 56प-10 म: अनु^3Oत
5ािधकार< को एक 5माणप 5Fतुत कया जाएगा। अनु^3Oत अिधकार< 5Bयेक दो वषe म: कम से कम एक
बार अवसंरचना, प रसर, Fटाक और अिभलेख का िनर<Rण संचािलत करे गा”;
(5) िनयम 10(क) के उपिनयम (क) म:, िन%निल3खत वाCय अंत म: जोड़ा जाएगा, अथाPत ्:-
“सभी ऐसे FटाकD का अिभलेख 56प 11 म: रखा जाएगा”;
(6) िनयम 11 म:, -
(i ) उप िनयम (क), के Fथान पर िन%निल3खत उप िनयम रखा जाएगा, अथाPत ्:-
''(क) “क+टनाशी के विनमाPण क+ अनु^3Oत, य द कोई हो, जो धारा 9 क+ उपधारा (3 ख) के अधीन

5दBत अनंितम आधार पर पंजीकरण जार< कया गया है , अनंितम पंजीकरण क+ समा3Oत क+ तार<ख को
समाOत हो जाएगी। मुgय अनु^3Oत पर पृhठांकन Aारा 5दBत अनु^3Oत, मुgय अनु^पित
् के साथ समाOत हो
जाएगी,”;
(i i ) उप िनयम (ख) म:, -

(क) “अनु^3Oत का नवीकरण” शMदD के पWचात “नाशकजीव िनयं ण आपरे टर क+ दशा म:” शMद
अ9त:Fथा पत कए जाएंगे;
(ख) खंड (i ) म:, शMद “क+टनाशी विनमाPण के िलए या” हटाए जाएंगे;
(ग) खंड (i i ) हटाया जाएगा;
(7) िनयम 15 म:, -
(i ) उप िनयम (2) म:, शMद और अंक “56प 13” के Fथान पर “56प 12” शMद और अंक रखे जाएंगे;
(i i ) उप िनयम (3) म: शMदD और अंकD “56प 15” और “56प 16”, के Fथान पर “56प 13” और “56प
14” शMद और अंक रखे जाएंगे;
(i i i ) उप िनयम (4) म:, शMदD, अंकD और अRरD “56प 15 क और 16 क” के Fथान पर “56प 15 और
16” शMद और अंक रखे जाएंगे;
(8) िनयम 24 के, उपिनयम (3) म:, शMद और अंक “56प 9” के Fथान पर “56प 17” शMद और अंक रखे
जाएंगे;
(9) िनयम 30 म:, शMद और अंक “56प 10” के Fथान पर “56प 18” शMद और अंक रखे जाएंगे;
(10) िनयम 32 म:, शMद और अंक “56प 11” के Fथान पर शMद और अंक “56प 19” रखे जाएंगे;
(11) िनयम 33 म:, शMद और अंक “56प 12” के Fथान पर “56प 20” शMद और अंक रखे जाएंगे;
(12) िनयम 34 म:,-

NOTIFICATION
New Delhi, the 5th November, 2015
G.S.R. 840(E).—Whereas the draft rules further to amend the Insecticides Rules, 1971 which the Central Government
proposes to make in exercise of the powers conferred by section 36 of the Insecticides Act, 1968 (46 of 1968) was
published in the notification of the Government of India in the Ministry of Agriculture (Department of Agriculture and
Co-operation) vide number G.S.R.92(E),dated the 13th February, 2015 in the Gazette of India, Extraordinary, Part-II ,
Section 3, Sub-section (i), dated the 13th February, 2015, inviting objections or suggestions from all persons likely to be
affected thereby, before the expiry of the period of forty-five days from the date on which the copies of the Gazette
containing the said notification were made to the public;
And whereas, copies of the said Gazette notification were made available to the public on the 13th April, 2015;
And whereas, objections and suggestions were duly considered in respect of the said notification;
Whereas, the Central Government is of the opinion that circumstances have arisen, which render it necessary to
make the rules without consultation with the Board;
In terms of proviso to section 36 of the Act, the Board shall be consulted within six months of making of the
rules and the Central Government shall take into consideration any suggestions which the Board may make in relation to
the amendments of the said rules;
Now, therefore, in exercise of the powers conferred by section 36 of the Insecticides Act, 1968 (46 of 1968), the
Central Government, hereby makes the following rules further to amend the Insecticides Rules, 1971, namely:-
1. (1) These rules may be called the Insecticides (Amendment) Rules, 2015.
(2) They shall come into force on the date of their publication in the official Gazette.
2. In the Insecticides Rules, 1971,-
(1) in rule 6, in sub-rule (4) for the words, numbers and letter “Form II or Form IIA”, the words and numbers “Form
II or Form III” shall be substituted;
(2) in rule 7, in sub-rule (1), for the word, number and letter “Form IIB”, the word and number “Form IV” shall be
substituted;
(3) in rule 9-
(i) in sub-rule (1) –
(a) the words “or renewal” and “,as the case may be, ” shall be deleted;
(b) for the words and numbers “Form III or Form IV”, the word and number “Form V” shall be substituted;
(ii) in sub- rule (3) –
(a) for the word and number “Form V”, the word and number “Form VI” shall be substituted;
(b) in clause (i), the words “ and any certificate of renewal” shall be deleted;
(c) clause (iv) shall be deleted;
(iii) after sub-rule (4A), the following sub- rule shall be inserted, namely:-
“(4B) A person who applies for manufacturing licence shall possess or shall employ a person possessing
Master’s degree in Chemistry with a Doctorate or a graduate degree in Chemical Engineering for manufacture of technical
grade pesticides or a graduate degree in Agriculture Science with Chemistry for manufacture of pesticide formulation:
Provided that a person possessing a manufacturing licence on the date of notification of this sub-rule shall be
allowed a period of two years to comply with the educational qualification.”;
(4) in rule 10 -
(i) in sub rule (1) ,-
(a) for the words and numbers “Form VI and Form VII”, the word and number “Form VII” shall be substituted;
(b) the words “ or renewal” and “,as the case may be, “ shall be deleted;
(ii) after sub-rule (1), the following sub-rule shall be inserted, namely:-
“(1A) A person who applies for the grant of licence to sell, stock or exhibit for sale or distribute insecticides shall possess
or shall employ a person possessing a graduate degree in Agricultural Sciences or Biochemistry or Biotechnology or Life
Sciences or in Science with Chemistry or Botany or Zoology as the minimum qualification:
Provided that all retailers or dealers possessing a valid licence as on the date of notification of this sub-rule
shall be allowed a period of two years to comply with the educational qualifications.”;
(iii) in sub-rule (2), the words “or renewal” shall be deleted;
(iv) in sub-rule (3A),-
(a) in clause (i), for the words, numbers and letters “Form VIA” and “Form VIB”, the word and number “Form VII”
shall be substituted;
(b) in clause (ii), for the word, number and letter “Form VIC”, the word and number “Form VIII” shall be substituted;
(v) in sub- rule (4A), in clause (i) -
(a) for the word, number and letter “Form VID”, the word and number “Form IX” shall be substituted;
(b) the words “or renewal” shall be deleted;
(vi) after sub-rule (6), the following sub-rule shall be inserted, namely:-
“(7) A certificate shall be submitted by all licencees under rule 9 and rule 10 in Form X to the licensing authority every
year. The licensing officer shall conduct inspection of infrastructure, premises, stocks and records at least once every two
years.”;
(5) in rule 10 (A), to sub-rule (a), the following sentence shall be added at the end, namely: -
“A record of all such stocks shall be maintained in Form XI.”;
(6) in rule 11, -
(i) for sub-rule (a), the following sub-rule shall be substituted, namely: -
“(a) A licence to manufacture insecticides, if any, issued on the basis of provisional registration granted under sub-
section (3B) of section 9, shall expire on the date of expiry of the provisional registration. A licence granted by
endorsement on the main licence shall expire along with the main licence.”;
(ii) in sub-rule (b), -
(a) after the words “renewal of a licence” the words “in case of pest control operators” shall be inserted;
(b) in clause (i), the words “to manufacture insecticides or” shall be deleted ;
(c) clause (ii) shall be deleted;
(7) in rule 15, -
(i) in sub-rule (2), for the word and number “Form XIII”, the word and number “Form XII” shall be substituted;
