The undersigned prosecutor states on information and belief that the defendant, either

directly or as a party, at County of Davis, State of Utah, committed the crime(s) of:

COUNT 1

SODOMY UPON A CHILD, a First Degree Felony, in violation of Utah Code Ann.

§ 76-5-403.1, as follows: That the above named defendant, between January 1, 2001 and

December 31, 2002, did engage in a sexual act upon or with a child under the age of 14,

involving the genitals or anus of the actor or the child and the mouth or anus of either person,

regardless of the sex of either participant.

The presumptive sentence for this offense is 25 years to life.

COUNT 2

SODOMY UPON A CHILD, a First Degree Felony, in violation of Utah Code Ann.

§ 76-5-403.1, as follows: That the above named defendant, between January 1, 2001 and

December 31, 2002, did attempt to engage in a sexual act upon or with a child under the age of
14, involving the genitals or anus of the actor or the child and the mouth or anus of either person,

regardless of the sex of either participant.

The presumptive sentence for this offense is 25 years to life.

This Information is based on evidence obtained from witness Tyler Cunningham.

PROBABLE CAUSE STATEMENT: The undersigned prosecutor is a Deputy

Davis County Attorney and has received information from the investigating officer, Tyler

Cunningham of the Clinton Police Department, and the information herein is based upon such

personal observations and investigation of said officer.

A woman reported that she had been sexually abused by the defendant when she

was between the ages of 3 to 5 years old. The abuse occurred at her home in Clinton, Utah while

the defendant was babysitting her. She stated that she remembered that on more than one

occasion the defendant asked her if she wanted to suck on a sucker. The defendant would then

put his penis in her mouth. She stated that he would make her suck on his penis until he

ejaculated in her mouth. Afterwards he would say, "sorry I juiced in your mouth."

The defendant was interviewed about the allegations. He admitted that he babysat

the victim when she was child. However, he did not remember sexually abusing the victim. He

stated that he was a drug addict at the time and doesn't remember a lot of what happened during

that time period.
