Langford Compassionate Release Timeline: Significant Events


September 10, 2012- Attorney Reginald McDaniel sends Initial letter to the warden
requesting Compassionate Release (CR) under18 U.S.C. 3582 (c) (1) (A)
October 2, 2012- Follow up letter to the warden on the CR.
October 9, 2012- Received letter from the warden at Ashland Correctional Facility
acknowledging that the request was under consideration and being reviewing.
October 12, 2012-Letter to Mrs. Langford with updates that the process was underway
for CR.
May 24, 2013- Received copy of the memorandum addressed to Mr. Francisco J.
Quintana, Warden, Federal Medical Center in Lexington, KY, stating his recommended
motion for release of Mr. Langford was denied by Charles Samuels, the Dir. Federal
Bureau of Prisons.
May 29, 2013- Sent a letter requesting reconsideration of Compassionate Release
under 18 U.S.C. 3582(c) (1) (A) (ii) specifically and not under (A)(i) alone as stated in
the recent denial letter on behalf of inmate #27349-001, Larry Langford.
June 2, 2013-The infamous news story by CBS WIAT-42 that Mr. Langford had died.
WIAT retracted the story after letter sent from legal counsel demanding retraction.
June 6, 2013- Letter sent to Hon. Richard Shelby from Mrs. Langford asking for
assistance.
June 13, 2013- Released a letter to the public from Mr. Langford stating in part,
“Although I am grateful that I have had the time to reflect on the challenges and victories
of my life, I have one more wish. It is my final prayer that I will be able to die with my
family by my side. Some people don’t know that I was blessed with the best in- laws
anyone could ask for, Oliver and Clara Ferguson have been my parents, friends and
confidants and I love them dearly. My son Ronald, daughter-in-law, Sylvia,
grandchildren, Trey and Jared, my sister-in- law Cassandra and my niece LeNa’ have
provided our family with support, joy and laughter and I have missed their love and
presence.”
June 24, 2013- Letter sent to Dr. Laura Carr, Mr. Langford’s treating physician
requesting she send letter with updated medical to Dir. of Federal Bureau of Prisons,
under the new CR guidelines.
July 28, 2013- Reconsideration Request for Compassionate Release Program denied at
the Department of Justice level by the Assistant Director/General Counsel; Kathleen M.
Kenney, stating the condition does not meet the medical criteria for a reduction in
sentence.
September 2013-Tiffany Johnson Cole joins legal team, after temporary withdrawal by
McDaniel who remained in contact with family as the processed continued.
January 2015- Renewed request for Reduction in Sentence sent for Mr. Langford to
FBOP/DOJ.
January 18, 2017- Reduction in Sentence request denied
2015-present Family and legal counsel (Cole, Givan & McDaniel) continued efforts to
get the Compassionate Release including appeals and lobbying to the Obama
administration. Counsel and family continued working with local, state and federal
officials, particularly, Rep. Terri Sewell, and Rep. Juandalynn Givan, William Bell,
nationally recognized attorneys, ministers and many others including a meeting with
Mayor Woodfin’s office in June 2018.
January 2, 2018- Tiffany Johnson sends new request for Compassionate Release to
FBOP/DOJ.
February 26, 2018 - Copies of request for compassionate release sent to Doug Jones
and Richard Shelby
June 15, 2018- Filed petition for Commuted Sentence
November 2, 2018- Letter from DOJ to Warden denying request for CR although
admitting medical criteria met. Letter claims Mr. Langford was a threat to the
community.
November 27, 2018 - Letter to Doug Jones and Richard Shelby regarding denial of
compassionate release.
November 28, 2018- Langford’s legal counsel sends letter requesting reconsideration of
the November 2, denial
December 3, 2018 - Letter to Ken Hyle (DOJ/FBPO) requesting a reconsideration of
denial, clarification, and process for appeal.
December 19, 2018 - Second letter to Ken Hyle regarding the request for
reconsideration.
December 28, 2018- Motion for CR from U.S. Attorney Jay Towne filed on behalf of the
FMC Warden was granted by Hon. Scott Coogler ordering immediate release for time
served and 36 months of supervision.
December 29, 2018 – Mr. Langford is transported from the FMC in Lexington, KY to
Baptist Health Systems-Princeton.
