AFFIDAVIT OF INDIGENCY

I, CRISTINA A. ESGUERRA, 60 years of age, widow, with residence

address at 516 K Purok Rosal, Pinagbuhatan, Pasig City, after having been
sworn to in accordance with law, depose and say;

1. That I would like to file a civil case for Annulment of Contract against Sps.
Catalina and Carlito Martin in order to protect my rights;

2. That I, however, belong to the indigent group in the barangay, my means

of living being derived solely from my job as “barangay utility worker”
receiving only a monthly allowance of P2,500.00 per month which is
insufficient for the subsistence of my family, and I have no other sufficient
means to provide for my basic needs;

3. That, the only property I have is a 122 square meter of real property which
my husband, PROCESO ESGUERRA inherited from his parents, as
evidenced by a certification issued by the City Assessor’s Office, Pasig
City;

4. That the said real property has been apportioned among my five children
and me and occupied by us as our family home;

5. That my children are also indigents having no sufficient means to provide

for their family, their means of income derived from tricycle driving
provides for less than minimum wages;

6. That, this case I intend to file arises from the act of my opponent in
utilizing in court a falsified document, a Deed of Mortgage which I never
executed, as their evidence to acquire my afore-mentioned property;

7. That considering that I have no income, I cannot afford to pay the filing
fees to initiate a complaint to protect my rights;

8. That I execute this affidavit to attest to the truth of the foregoing facts that I
am an indigent member of the community and is thus entitled to plead as
a Pauper Litigant before the Courts.
