Executive Summary Waukee Community School District Administrative Investigation ‘On March 29, 2016, Two Solutions, LLC, an lowa Licensed Private Investigative Agency met with attorney James C. Hanks, Ahlers & Cooney P.C., 100 Court Ave #600, Des Moines, IA. 50309. Mr. Hanks is legal counsel for the Waukee School Board. The meeting was to discuss Two Solutions conducting an investigative review of allegations of misconduct by Eric Rose, Chief Operations Officer for the Waukee Community School District. The allegations include: misuse of school property, unauthorized use of school personnel, improper payment from a school vendor, retaliation against school employees, and use of derogatory language, improper alcohol use and improper hiring practices. ‘The review included the following investigative steps: 1. Review of internal school reports previously completed by Waukee school staff. 2. Review of emails, camera footage and other correspondence related to the allegations. 3, Conducted fifteen interviews including the superintendent, chief financial officer, chief operations officer, director of human resources, operations director, operations manager, technology director, business services director, high school principal, and other administrative staff. No interviews or evidence collection were conducted with school vendors or outside personnel, Some interviewees appeared more forthright and credible while some appeared to be diminishing or lacking details in their answers. Findings: Sustained: Sufficient evidence to confirm allegation ‘Not Sustained: Insufficient evidence to confirm allegation Highly Probable: Indicators are it occurred, but lacks sufficient certainty Exonerated: Acts of the accused did occur, but were justified 1. After all interviews were conducted and a comprehensive review of available evidence was completed, investigators concluded: '* Use of School Property for Personal Benefit is Sustained. This includes the use of: tables and chairs, snow blowers, and dehumidifier. A floor fan was also identified as being used by Eric Rose for personal benefit. Personal use of the school generator was highly probable to have occurred. It was also revealed that Eric Rose took his kids to school in the District vehicle in more than one occasion. Tables and Chairs: Interviews of employees Chris Irvin and Matt Hansen detail their directive to deliver District tables and chairs to private residence’ while on District time. District vehicles were used. Interview of Nick Bavas, as the supervisor for Irvin and Hansen, outlining how his employees were directed by Rose to make these deliveries, as well he himself being directed. Interview of Eric Rose admitting he directed employee Chris Irvin to deliver tables and chairs to private residence’ and pick them up. When picking them up the ‘employee (Chris Irvin) had the choice of whether to accrue overtime or comp time per Rose, Interview of Eric Rose admitting he used the District tables for a couple of rummage sales at his residence, Snow Blower(s): Interviews of Lora Appenzeller-Miller, Keith Elmquist stating they were aware of Eric Rose using a District snow blower for personal use. Elmquist indicated it was the snow blower from the Central Main Administration Building and Appenzeller- Miller believed the snow blower used was from Schuler elementary. School vehicle was used to transport snow blowers. Interview of Eric Rose admitting he used several District snow blowers at his home on several occasions in 2013. These snow blowers were from Shuler Elementary and Vince Meyer Learning Center. Rose’s school issued vehicle was used to transport snow blowers. Interview of Nick Bavas detailing how Rose told Bavas he bought the Timberline snow blower to take it home and “test drive it” over the winter. Intérview of Eric Rose admitting he purchased a snow blower on his District Procurement Card (P-Card) in November of 2014. Rose himself picked up and transported the snow blower to his residence and used it for approximately 30 days, This snow blower was for the new Timberline school that opened in August of 2015. This snow blower was confirmed to be at Timberline during this investigation. Copy of P-Card invoice of the snow blower purchase made by Eric Rose with notation of being approved by Rose for payment. Rose was shown copy of invoice. Copy of Clive Power receipt on the snow blower purchased by Eric Rose. Eric Rose was shown a copy of the receipt. © Pictures of the snow blower currently at Timberline taken by investigators on June 8, 2016. Serial number on the Timberline snow blower matches the invoice serial number on the snow blower Eric Rose purchased in November of 2014. Generator: * Interview of Matt Hansen, Nick Bavas and Keith Elmquist on the District generator missing from Central Receiving Warehouse. Generator missing for several months. There was discussion about replacing it but that did not occur as employees believed Rose had it. Elmquist advises that Rose tailgates a lot at ISU games. * Interview of Eric Rose stating he took the generator home to show a neighbor how it operated. Rose states the neighbor was interested in buying one for tailgating. Rose denies using the generator for tailgating and denies using it at all. Dehumidifier: © Interview of Nick Bavas detailing how he was asked by Rose where a District dehumidifier may be located, as Rose needed one for his wet basement at home. Interview of Eric Rose admitting he took a District dehumidifier home due to moisture in his basement. Floor Fan: «Interview of Nick Bavas detalling how he received a text from Rose asking where a District fan may be located, as Rose needed one after recently shampooing his carpet at home and carpet still being damp. * Photograph of text message Bavas received from Rose, dated May 17, 2016 «Interview of Keith Elmquist outlining his knowledge of Rose using a school fan. * Interview of Eric Rose admitting he picked up and used a District fan from Shuler Elementary. Rose spoke to the school employee when picking up the fan but did not identify himself to the custodian as Eric Rose or the COO. Improper Use of Schoo! Vehicle lian passengers): «Interviews of Amy Patters, Keith Elmquist and Lora Appenzeller-Miller detailing their observations and knowledge that Rose transported his kids to school in his District issued vehicle. Patters saw this as recent as late May 2016, whereas Appenzeler-Miller and Elmquist knew this practice had been going on for quite some time.
