The Main Terms And Conditions ATTACHMENT For Hong Leong CM Flexi Property Financing: 14 15 16 Hong Leong Home Furnishing Financing-i be entitled to claim the surrender value on demand of the said certificate Your entitlement to any promotional rates for the Facilities (if applicable) is conditional upon the approval of HLMT of your MRTT application and the payment of the takaful contribution. If this condition is not complied with for any reasons whatsoever, the Bank is entitled to withdraw the promotional rates and impose the non-promotional rates at its discretion, ) _ Takaful coverage of Property(ies) You are to cover and you authorise the Bank to sign any takaful application form/advise on your behalf to cover the property(ies) to be charged to/assigned with such takaful operator as may from time to time to be approved by the Bank in the name of the customer(s)/charger(s)/assignor(s) and the Bank as charge and loss payee against such risks and for such sums as the Bank may require. 9) All residential property(ies) to be covered under houseowner certificates whilst commercial and vacant property(ies) will be covered under fire certificates In this respect, you are to let us have custody of the original takaful certificate and the takaful contribution receipts. Where the property(ies) is under construction, you are to cover the property(ies) upon ‘commencement of construction. Fees & Costs Unless otherwise agreed by the Bank, all fees, costs and other expenses (including stamp duties, legal and other professional fees) in connection with the Facility(ies) and the legal and security documents shall be borne by you whether or not the Facilty(ies) is utilised, withdrawn or cancelled for whatever reason. In the event the Facility(ies) has to be recovered by any process of law, all fees and expenses in connection with such recovery including the Bank's solicitors’ fees and costs (on a solicitor and client basis) shall be borne by you. Quit Rent and Assessment You are required to settle all quit rents, assessment rates and other incidentals and outgoings related to the said Property promptly when due at your expense and you shall forward such receipts of payment to the Bank Other Conditions a) The Bank reserves the right in its sole discretion to debit your current/savings account with the Bank towards the Monthly Instalments and Grace Period Profit instalments (if applicable) or for payment of expenses relating to the Facility(ies), including the Takaful contribution, quit rent, assessment, outgoings, fees and costs (including any professional charges) incurred in the recovery of the Bank's Selling Price and enforcement of the securities. b) Should there be any outstanding balance of the Facility(ies) Amount after the expiry of the Grace Period, the balance of the Facility(ies) Amount will be credited into a "Financing Payable Account" and thereafter, payment shall be made therefrom in the same manner as stated in this letter. ©) The Facility(ies) Agreement entered between you and the Bank is for the sole purpose of financing or part-financing the purchase of the said Property or such other purpose set out in this letter in accordance with the Shariah contract of Commodity Murabahah/Tawarrug and you are obliged to follow the rules and regulations thereof. d) The Bank shall be entitled to have the said Property revalued from time to time and at any time and the fees and costs incurred shall be borne by you. ) The said Property shall not be used for purposes which are in contravention of the Shariah principles or for any “unlawful” purposes. f) The Bank reserves the right to impose additional conditions governing the Facility(ies) Amount/Selling Price from time to time at its discretion with twenty one (21) days prior notice to you. 9) The Bank may suspend the utilisation of or terminate the Facilty(ies) in the event if you do not pay any sums payable or if you or the security parties breach any of the terms stipulated in the Letter of Offer andlor the Facility(ies)/security documents and/or provide, any information/documents, representation or warranty is incorrect/false, or default on any account with the Bank or with any other financial institution or fail to make the declaration pursuant to the Islamic Financial Services Act 2013 or BNM Guidelines on Credit ‘Transactions and Exposures with Connected Parties or upon the occurrence of an event of HLISB/CM Flexi Ppty/TnC incl HFF-i Apr 2018. 9
