CRIMINAL JUDICIARY REFORMS IN INDIA

Synopsis

HYPOTHESIS

The Criminal Justice System of our Country involves two aspects of justice- The Police and The
Judiciary and I shall hereby discuss the reforms individually in both the sectors.

Police being the most vital and most unmistakable piece of Criminal Equity Framework, it was
required to be redone. The remnants of English inheritances were looked to be discarded by making
it more responsive and capable and also more agreeable to individuals. To accomplish this coveted
objective and change the structure National Police Commission was comprised in 1977 by
Ministry of Home Affairs which gave suggestion on required changes needed to be incorporated
in the existing Police System.

On the 24th of November, 2000, the Ministry of Home Affairs proposed to set up for the
constitution of a Committee on Reforms of the Criminal Justice System (Justice Malimath
Committee) to deliberate on the fundamental issues revolving in criminal law with special
emphasis on speedy trial and reposing the lost faith in the criminal judicial system. The Committee
proceeded by focusing mainly on comparing the adversarial system and inquisitorial system.

The recommendations that were suggested by the Committee were criticised on ground of being
violative of human rights of a person facing the criminal trial, as discussed. In January, 2018 the
Union Government considered to revisit the Justice Malimath Committee Report and it is yet to
see whether it is ratified and brought in terms with international standards of human rights or again
this aspect is left ignored.

RESEARCH QUESTIONS

1. What are the various reforms that have been brought in the Criminal Judiciary System of
our Country?
2. With special reference to the Justice Malimath Committee Report, have these reforms
proved beneficial and to what extent have they been implemented?

AIM & OBJECTIVE

The project aims to critically analyse the reforms that were brought in the form of reforms in the
criminal judiciary system in India. The project has been discussed in two parts- the first part

focusing on the reforms in the police system and the second part focusing on the judiciary. Both
the parts have been discussed with special reference to the Justice Malimath Committee Report.
