Facts:
Salvador Budlong, Third Assistan Fiscal, filed a petition against Judge Aquiles
Apalisok regarding his decision upon criminal case no. 1838. According to
Budlong, the respondent Camilo Puyon y Galagar should be charged of
serious physical injuries through reckless imprudence. Apalisok, sentenced
Galagar 30 days imprisonment plus costs and no civil liability imposed.

Issues:
Did the MTC erred in not imposing civil liability of the accused towards the
offended party?

Held:
Yes, art 100 of RPC states “Every person criminally liable of a felony is also
civilly liable”, Furthermore, Civil liabilty can only be extinguished in accordance
with the provisions of civil law.
