PETITION

PETITIONER MIRASOL JAVIER SALONGSONGAN, by and through the


undersigned Counsel and unto this Honorable Court, respectfully aver—

1. Petitioner is of legal age, _______ Filipino, and resident L1 B3 Ph-2 Citiville


Executive Homes, 181 Congressional Avenue, Bahay Toro, Quezon City, Philippines,
where they may be issued summons, orders, and other processes of the Honorable
Court. Respondent Register of Deeds of Benguet, on the other hand, is being impleaded
in his official capacity as a necessary party in this Petition to afford complete relief to
the Petitioners. He may be served summons, orders and processes at the Office of the
Registry of Deeds in Benguet, Philippines.

2. Petitioner had a child named, PEDRO LUIS JAVIER SALONGSONGAN,


who is now _____ years old, male, was born in _________________, on ______________,
as can be gleaned from his Certificate of Live Birth issued by the Philippine Statistic
Authority| Office of the Civil Registrar General, a copy of which is hereto attached,
marked as ANNEX A, and made an integral part hereof.
3. Registered in the name of her minor child is a parcel of land located along
Tuba, Benguet, Philippines covered by Transfer Certificate of Title No. 016-2014000064
of the Registry of Deeds of Benguet, a copy of which is hereto attached, marked as

ANNEX B, as well as by Tax Declaration / Assessment of Real Property No.
______________ and Property Index No. _____________ of the Office of the Municipal
Assessor of Tuba, Benguet, a copy of which is hereto attached as ANNEX C, and which
is more particularly described as follows—

4. Petitioner thus seek leave of court to Sell, Transfer, Cede, Relinquish and
Convey the above-described parcel of land with a prospective buyer. They implore that
they be granted full authority to sign and execute a Deed of Absolute Sale, Deed of
Conditional Sale and or Contract to Sell and / or any and all other legal documents,
papers and instruments necessary for the Sale, Transfer of the property.

5. The Sale is in compliance with and pursuant to, the Petitioners’ legally
ordained parental duties. The proceeds of the sale shall be utilized entirely for the
benefit of Petitioners’ minor child Pedro Luis Javier Salongsongan and also his sister
primarily for education and support as well as for investment in money markets for
future financial advantage and security upon reaching majority age.

6. Neither Petitioner nor their minor child has any next of kin who may have
interest in the property.

PRAYER

WHEREFORE, Petitioner pray that after notice and hearing the Honorable Court
issue a judgment—

1. Granting Petitioner permission and authority to sell, transfer, cede, relinquish


and convey the real property located at Barangay Ampasit, Tuba, Benguet, Philippines
covered by Transfer Certificate of Title No. 016-2014000064 with any prospective
buyer/s;

2. Granting Petitioner full authority to sign and execute a Deed of Absolute Sale,
Deed of Conditional Sale and/or Contract to Sell and / or any and all other legal
documents, papers and instruments necessary for the sale , transfer, cession,
relinquishment and conveyance of the subject property.

3. Ordering the Register of Deeds for La Trinidad, Benguet to annotate the


judgment containing the authority so given on the Memorandum of Encumbrances of
Transfer Certificate of Title No. 016-2014000064.

Other reliefs just and equitable are likewise prayed for.
