1. Q: Please state your name, age, address and occupation?
A: I am JACOMO C. CUNI-IT, 45 years old, married, and residing at 32 Brgy. Hillside, Baguio City. I am a Clinical Psychologist. 2. Q: Are you the Clinical Psychologist who performed psychological evaluation examination to the Petitioner, NOEL FRANKLIN DIAZ SISON? A: Yes. 3. Q: How long have you been practicing your profession? A: I have been practicing for 23 years now. 4. Q: Where and when did you graduate as a Clinical Psychologist? A: I graduated from Ateneo De Manila University, year 1991. 5. Q: Where do you work? A: I am at present employed at Baguio General Hospital, Department of Psychology. 6. Q: Is this your first time to testify as expert witness? A: No. 7. Q: What is the work of a Clinical Psychologist? A: Clinical psychologists aim to reduce the distress and improve the psychological well being of our clients. We use psychological methods and research to make positive changes to our clients' lives and offer various forms of treatment. 8. Q: Are you the one who make clinical interpretation of the behavior of the Petitioner, NOEL FRANKLIN DIAZ SISON? A: Yes. 9. Q. What about the respondent, did you also make clinical interpretation of her behavior? A. Apparently, the behavior and actuation of the respondent during the time of the marriage the respondent is suffering from Anti-Social Personality Disorder this is a serious and severe apparently incurable. This disorder is chronic and long-standing before the marriage. 10. Q. And you based your interpretation on the report given by the petitioner? A. Based on the psychological examination wherein there is no pattern of lying when I examined her, the petitioner was found to be very responsive, coherent, and relevant to marital relationship with respondent. 11. Q. And the last page of Exhibit "B" which is your report there is a statement rather on the last page, last paragraph which state: It is the clinical opinion of the undersigned that marriage between the two, had already hit bottom rock even before the actual celebration of marriage. Respondent’s immature, irresponsible and callous emotionality practically harbors the possibility of having blissful relationship. His general behavior fulfills the diagnostic criteria for a person suffering from Anti Social Personality Disorder. Such disorder is serious and severe and it interferred in his capacity to provide love, caring, concern and responsibility to his family. The disorder is chronic and long- standing in proportion and appears incurable. The disorder was present at the time of the wedding and became manifest thereafter due to stresses and pressure of married life. He apparently grew up in a dysfunctional family. Could you explain what does chronic mean? A. Chronic is a clinical language which means incurable it has been there long before he entered marriage apparently, it came during early developmental basic trust was not develop. 12. Q. And this long standing proportion? A. That no amount of psychological behavioral help to cure such because psychological disorder are not detrimental to men but to others particularly and this because the person who have this kind of disorder do not know that they have this kind of disorder. 13. Q. So in other words, permanent? A. Permanent and incurable. 14. Q. You also said that this psychological disorder is present during the wedding or at the time of the wedding or became manifest thereafter? A. Yes, Sir. 15. Q. Is there any other clinical findings? A. That is the clinical findings. Personality Disorder labeled on Anti-Social Personality Disorder. 16. Q. Does the respondent know that she has that kind of psychological disorder? A. Usually a person suffering that psychological disorder will not admit that they are suffering that kind of disorder. 17. Q. So because of this Anti-Social Disorder the petitioner suffers a lot? A. Yes, because the petitioner is a victim of hardships of marital relation to the respondent. 18. Q. Was the Anti-Social Personality Disorder also shown to the parents? A. Yes, according to the petitioner, respondent never give due respect more often than not he even shouted at them for no apparent reason. 19. Q. Did you say Anti-Social Disorder incurable? A. Yes, sir. 20. Q. Is there a physical violence? A. Actually, I could see the petitioner is tortured mentally of the respondent. 21 Q. How was the petitioner tortured? A. He was able to offset by the time he was separated by the respondent. 22. Q. Do you mean to tell us that Anti-Social disorder is incurable? A. Yes, sir. 23. Q. Why did you know? A. Anti-Social disorder is incurable again because the person itself, the respondent is not aware that this kind of personality affects the other party. 24. Q. This Anti-Social behavior is naturally affected the petitioner? A. They do not have children because more often than not the respondent is always busy of her work. They do not have peaceful harmonious relationship during the less than four months. 25 Q. And because of that Anti-Social disorder she had not shown love to the petitioner? A. From the very start, the respondent has no emotion to sustain the marital relationship. After their wedding, they went back into their separate lives and they never perform marital obligations to each other. 26. Q. And this affected psychological incapacity to perform marital obligation? A. Not only that up to this time from my clinical analysis of Anti-Social Personality Disorder, he is good for nothing person.
