Statement of the Problem

This study aimed to put same-sex extramarital conduct on the same footing with

adultery and concubinage as defined in the Revised Penal Code that provide penal

sanctions.

This study specifically sought to answer the following questions:

1. When and How Same-Sex adultery is committed?

1.1 How sexual intercourse be consummated by same sex persons

2. What is the treatment of the law in general with respect to gender neutrality?

3. How does the law on adultery applies to same sex extramarital conduct?

4. How should Article. 247 (Death or physical injuries inflicted under exceptional

circumstances) of the Revised Penal Code be interpreted to cover same- sex

adultery.
