AFFIDAVIT OF WITNESS

I, Kris Aquino-Dela Cruz, 35 years old, female, married and resident

of 11 H Barangay Ermita, after having sworn in accordance with law, do
hereby depose and state THAT:

01. I was present and personally saw that accused, was illegally
arrested that the alleged 6.94 grams of shabu were planted and the stories
were merely fabricated because the accused refused to give in to the
demand of Statham of giving twenty thousand pesos (P 20,000.00).

02. I am the wife of accused Ambrosio “Osio” Dela Cruz. We are

currently renting at Sitio Laray, Barangay Inayawan, Cebu City because our
house was flooded by typhoon Yolanda last November 8, 2018. I am 2
months pregnant with our first child. On the 7th of December 2018, at
around 2:00 am, I woke my husband and asked him to buy me Balut because
I was craving. He thereafter heeded to my request. He went outside and
came back bringing two pieces of Balut with him.

03. Minutes later, there was a knock on the door and Osio went
to see who it was. When Osio opened the door, I saw Statham wearing
civilian clothing talking to my husband and afterwards he gave a one
thousand (1000.00) peso bill to Osio, and placed something inside Osio’s
right pocket. When Osio took it out, I saw a plastic sachet containing white
powder substance.

04. Statham then immediately grabbed and held Osio’s hand.

Statham demanded twenty thousand pesos (P20,000.00) from Osio or else
they will arrest him for selling drugs;

05. When Osio refused to pay the said amount, STATHAM

grabbed and held his hand. He tried to arrest Osio but he was able to run
inside our house. Osio was about to jump out of the window but he was
prevented by Statham. Statham and another officer then arrested and
handcuffed Osio.

I executed this affidavit to attest the truthfulness of the foregoing facts

and to support to prove that there was nothing illegal found in the person of
the defendant and that the alleged 6.94 grams of shabu was planted.
