INFORMATION

The Undersigned Assistant City Prosecutor accuses BRIAN SINADYA

of the crime of Forcible Abduction With Rape defined and penalized under Article
342 of Revised Penal Code in relation to Republic Act no. 8353, committed as
follows:

That on the July 16, 2016, in the City of Iloilo, Western Visayas,
Philippines, and within the jurisdiction of this Honorable Court, accused
BRIAN SINADYA, with intent to by means of force, violence and
intimidation to wit: by pulling her and forcing her to walk, at the same
time pointing at her a gun and threatening to kill her should she cry out
for help, succeeded in bringing her to ride in his car, where they rode
going to the house of the accused’s Uncle Sam where the said
accused, by means of force, violence and intimidation, succeeded in
having sexual intercourse with her against her will.
That the crime was attended by an aggravating circumstance of
the crime was committed at nighttime and that advantage be taken of
superior strength or means employed to weaken the defense.
