Narrative: Background:
•April 2018: Criminal allegations were made against Sgt. Dan Hargraves, and WSP was assigned the criminal investigation about his
questionable conduct on the graveyard shift of March 30th, 2018. (WSP Case investigation 04-18-009186) The internal investigation
reference this matter is under LEA Complaints 18-10.
•May 23rd, 2018: WSP Detective Larry MCGill came down to Pullman PD to conduct witness interviews of the 4 patrol officers who worked
the same shift with Sgt. Hargraves on the night in question. Officer Scott Patrick was the PPD Guild representative for the officers.

Allegation:
WSP Detective McGill wrote the following in his criminal report against Sgt. Hargraves, “At 5:00 p.m., McGill contacted PPD office to
interview each of the officers working with Hargraves the night of the incident. The statements were compelled by PPD and a gag order was
also placed on them. Before the first officer entered, the Guild President, Scott Patrick, had entered the room and introduced himself. After
the introductions, Patrick told McGill, "You are not going to get anything out of these guys." McGill asked, "Why would you say that?"
Patrick replied, "Because they do not remember anything." McGill said to Patrick, "You do not even know what questions I am going to
ask." Patrick stated, "You're right, I don't know, but you're still not going to get anything." Patrick stated he would record the interviews and
provide a copy to McGill.”

Investigation:
Chief Jenkins requested Spokane PD investigate whether Officer Patrick participated in “witness tampering,” a crime defined under RCW
9A.72.120. Spokane Officer Lesser (135) was assigned the investigation and interviewed WSP Det. McGill on 11-14-18. Lesser and
Spokane Sgt. Keller drove to the PPD on 11-27-18 to interview the four officers that Patrick advised prior to their interview by WSP in May.
Lesser asked the Officers (Gordon, Harris, Emerson, and Winegardner) the following questions:
“The seven separate questions that I had prepared were as follows:

interview with Detective McGill?
2)Will you please describe the details of this conversation and when it occurred?
3)Did Scott Patrick ask you specifically what you planned to tell WSP Detective McGill during your upcoming interview?
4)Did Scott Patrick suggest to you that you tell WSP Detective McGill that you didn't remember anything about what occurred during your
shift that started on March 30, 2018 reference the activities of Sgt. Hargraves during that shift?
5)Did Scott Patrick ask you to withhold any relevant information from Detective McGill reference the investigation of Sgt. Hargraves?
6)Were you asked by Scott Patrick to provide false statements to Detective McGill reference the investigation of Sgt. Hargraves?
7)Was the information you provided to WSP Detective McGill on May 23, 2018 truthful and complete?”
Spokane Officer Lesser concluded his investigative report as such, “11/27/2018 there is no indication that Pullman Officer Scott Patrick
participated in or is guilty of witness tampering. All four officers indicated that during their conversations with Pullman Officer Scott Patrick
before their interview with WSP Detective McGill that Patrick just advised them to be honest and to tell the truth. Patrick also advised them
not to speculate and to not provide answers to questions when they didn't know what the answers were. All four officers also stated that
Pullman Officer Scott Patrick did not tell them to purposely forget any information, did not ask them to withhold any relevant information and
did not ask them to provide any false statements to Detective McGill. At this point, I am going to suspend my investigation in regard to the
possible witness tampering charges.”
Cmdr. Tennant’s Recommendation:
I have reviewed the WSP report and the Spokane PD report, and I concur with Lessor’s assessment that there is no indication that PPD
Officer Scott Patrick participated in any type of witness tampering. In fact, it appears that he was properly acting in his role as Guild
Representative. I see no indication of any department policies and/or procedures being broken and consider the matter to be closed with a
disposition of “Unfounded” as to the criminal allegation, and no further allegations left standing.
