I am directed to state that usuaLly the Election Commission of India


directs to assess the manpower requirement at various ieveis ior
appointment of poiling personnel like Sector I Zonal Magistrate, Presiciing
Offrcers, Polling Officers, etc. in advance before the polls. Therefcre, the
preliminary work relating to the appointment of polling personnel for the
ensuing General Elections to Lok sabha, 2oI9 has been taken up.

2. In accordance wittr Section 159 of the Representation of the People


Act 1951, it is obligatory on the part of the following authorities to make
available the staff necessar5r for the performance of election duties in
connection with the eiection:

(i) Evdry local authority


tiil Every University established or incorporated by or under a
Central, Provincia-l or State Act.
(iii) A Government company as defined in section 617 of the
Companies Act, 1956.

(iv) Any other institution, concern or undertaking which is


established by or under a central provincial or state Act or
which is controlled or frnanced wholly or substantia-lly by funds
provided, directly or indirecfly, by the centra-r Government or a
State Government.

Under Section 26 of the Representation of the People Act, 1951, the District
Election Officer is the appointing authority for Presiding Ofhcer and polling
Officers for the polling stations.

3. For the above purpose, particulars of officers / offrcials working in


the Central / State Government Offices, PSUs, etc. based in the districts
have to be obtained and compiled in an electronic database. Therefore, the
basic details, category-wise along with their Level of Pay with applicable Cell
in terms of number of eligible personnel availabie have to be provided to the
District Election Officers concerned for inclusion in the database of polting
personrrel.

4- Iarn, therefore, to request you to issue suitable instructions to ail


HODs / PSUs / Subordinate offices / Regional Offices under your control,
to furnish the details of staff working under their control in the
prescribed proforma annexed herewith to the District Election Officers
concer-qed directlv. (The details of staff normally exempted from election
dutJr are al.so annexed herewith). Any changes due to transfer or promotion
of official subsequently should be brought to the notice of the District
Election Officers for updation of the database of polling personnel for the
forthcoming General Elections to Lok Sabha.2OI9.

LIST OF PERSONS EXEMPTED FROM POLLING DUTY

1. a) PoJice and members of the Tamil Nadu Fire Service and Senior officers of the
Indian Forest Service.
b) Territorial sta-ff of Forest Department.
2. Home Guards.
3. (a) Medical or Veterinary Officers and Compounders employed in hospitals and
dispensaries and staff employed in Medical, Nursing and other ancillary branch
of Government Medical Institutions including Medical Practitioners.
(b) Officers working in Grade-B (Cattle Extension) Officer in Veterinary Hospital.
4. Officers of the Public Health Departrnent actually engaged in operations for the
suppression of epidemics.
5. Executive Offrcers engaged in construction work on Irrigation and
Hydro-Electric Projects.
6. Revenue Divisional Officers, Tahsildars, Deputy Tahsildars and Election Deputy
Tahsildars (these officials will be serving as Supervisory / Zonal. Officers).
7. Ofhcers and members of the establishment of Jail Department (District
Probation Officers are not exempted).
B. Officers and sta-ff engaged in operation, maintenance and construction works
under the Electricity Board.
9. Staff employed in Post Offrces, Telegraph Offices and Railway Stations (Staff in
other Offices of these Departments should be taken into account).
10. Traffic and operation stalf in the Transport Department.
11. School teachers working as extra departmenta,I post masters.
l2.Technical Staff working in the Central Government
Undertakings such as Neyveli Lignite Corporation, etc.
13.411 Judicial Officers and Magistrates of the Judicial Department.
14.All the Staff of the Dairy Development Department and Tamil Nadu Co-operative
Milk Producers' Federation Limited except the administrative staff at the
headquarters at Chennai of the Dairy Development Department.
15.Para-Military forces, example, the Central Industrial Security
Forces, Indo-Tibetian Border Police, Central Reserve Police, Border Securily
Force and the Assam Rifles under the control of the Ministry of Home Affairs.
16.A11 the sta-ff of the Legislative Assernbly Secretariat.
17.The Officers and StaJf of All India Radio and Doordarshal.
lS.Officer/Staff of Commercial Bank located in rural area and if happens to be a

19. Exemption may be granted in the following cases if the Collector is satisfied that
tJre exemption is necessarJr:-
i) Offrcers and subordinates in charge of fish curing yards and
ii) One Clerk and one Office Assistant in each Sub-Registrar Office.

iii) Physicallyhandicappedpersons.

Personnel with following disabilities defined under "The Persons with Disabilities
(Equal Opportunities, Protection of Rights and Full Participation) Act, 1995" may be
exempted from polling duty:-

i) Blindness;
ii) Low vision;
iii) Leprosy -Cured;
it) Hearing impairment;
v) Loco motor disability;
vi) Mental Retardation;
vii) Mental illness;
ald RAW and Other Intelligence Agencies
20. Officials of C.B.I., LB
2l.Operational and technical staff of LIC, BSNL, MTNL, UPSC and educational
institutions. However, they may be deployed for election duty in unavoidable
circumstances.
22. As far as possible the officers and sta-ff of Central Warehousing Corporation
should not be requisitioned for election duty.
