INTERCEPTACIÓN DE
COMUNICACIONES

Cansado de escuchar con inusitada
frecuencia un grave error que sin el menor
análisis, los medios de comunicación lo
difunden, considero pertinente comentar,
aclarar o informar lo siguiente:
Es verdad que el Art. 155 del Código
de Procedimiento Penal, a propósito de
“intercepción” y grabaciones, dice que “El
juez puede autorizar por escrito al
Fiscal que intercepte y registre
conversaciones telefónicas o de otro tipo,
cuando lo considere indispensable para
impedir la consumación de un delito, o para
comprobar la existencia de uno ya cometido, o
la responsabilidad de los participes…” (Hay
otros dos incisos que no importan mucho para
el análisis que sigue).
En lo de fondo, escucho con fastidio TODA
grabación de voces o filmación de
conversaciones es ilegal si el registro de
voces o imágenes no se ha efectuado previa
autorización escrita del juez Penal
competente. Ese es un grave error porque
parte de supuestos equivocados fundados en
una generalización que afectaría ala sociedad,
restaría eficiencia al combate a la criminalidad
y repercutiría en la validez de actuaciones
probatorias, indispensables para una correcta
administración de justicia.
El control de la criminalidad depende en gran
medida de la recolección y uso de información
tanto por parte de la policía como del
Ministerio Público, quienes tienen sobre sus
hombros la responsabilidad de obtener
legalmente evidencias que luego puedan ser
presentadas en juicio para lograr que se
descubran los delitos y se sancione a los
responsables que deben recibir las penas
previstas en las leyes penales. Aunque en la
práctica, búsquedas, registros y cacheos
también están relacionados con la aplicación
del derecho vigente en cárceles y
penitenciarías, en aeropuertos, lugares
públicos y de aglomeraciones de personas.

EAVESDROPPING

Tired of listening with unusual frequency
a serious error divulged by the media
without the smallest analysis, I consider
pertinent to comment, clarify or report
the following:
It is true that Art.155 of the Criminal
Procedural Code, regarding "eavesdropping"
and tapping, establishes that "The judge can
authorize, in writing, the Prosecutor to
eavesdrop and tape telephone or other kind of
conversations, when he considers it
indispensable to prevent the perpetration of a
crime, or to demonstrate the existence of one
already committed, or the responsibility of the
accomplices…" (There are other two clauses
that do not matter that much for the following
analysis).
As for the merits, it bothers me to listen that
ALL voice recording or conversation filming is
illegal if the voice or image recording has not
been performed with prior written authorization
of the competent Criminal judge. That is a
serious error since part of the mistaken
assumptions based on a generalization that
would affect society, would reduce efficiency
to battle criminality and would have
repercussions on the validity of pleadings,
which are indispensable for a correct
administration of justice.
The control of criminality depends, in
great measure, of the gathering and
use of information by the police as
much as by the Attorney General’s
Office that have on their shoulders the
responsibility of legally obtaining evidences,
which can later be presented in trial in order to
achieve the discovery of crimes and the
punishment of the responsible ones, receiving
the latter the penalties foreseen by the
criminal laws. Although in practice, searches,

una tremenda tontería pretender que el
familiar de un secuestrado, el dueño de la
casa robada, o el extorsionado por
funcionarios corruptos tenga que pedir
autorización previa del Juez Penal para
registrar en cinta o en video la constancia de
la comisión de esos delitos.
Derechos de terceros:
Lo que si es inconstitucional y, obviamente,
ilegal, es la grabación de conversaciones de
TERCEROS, ajenos al que graba o filma,
quien, en estos supuestos es interceptor y no
interlocutor. Así, yo no puedo interceptar las
llamadas telefónicas que otro haga desde su
teléfono de la casa o de la oficina, grabarlas y
difundirlas, porque, simple y llanamente, en
esos casos yo no soy interlocutor; por
consiguiente, la misma prohibición que existe
respecto a un particular, es mucho mayor
respecto a policías o fiscales, quienes, en ese
caso si, deben pedir autorización previa al
Juez Penal.
Pero, si puedo grabar VALIDAMENTE todas
mis conversaciones o entrevistas en las que
yo sea interlocutor; y, luego, si quiero,
difundirlas. Desafortunadamente, los jueces
de la Corte Suprema de Justicia y del Tribunal
Constitucional que tiene y ha tenido el
Ecuador, de pésima calidad, salvo rarísimas
excepciones, no se han preocupado de emitir
fallos formulando estas precisiones; por ello, a
falta de jurisprudencia nacional, se puede
consultar el estudio del magistrado español
Manuel Estrella Ruiz sobre Medidas
restrictivas de derechos fundamentales,
incluida la interceptación de comunicaciones;
y el fallo del Tribunal Constitucional español
114/1984 en el que claramente se afirma que
“la divulgación del contenido de una
conversación por uno de los interlocutores

tapes, records or films a conversation or
interview, he does NOT even need
authorization from the other speaker (although
sometimes it is appropriate to notify the other),
and even less will require prior authorization of
the Criminal Judge.
In fact, some social communicators
record or film conversations of their
speakers without prior warning, as it
happens with the banks and other public
or private entities that also film their
clients. It would be thoughtlessness to
pretend that the relative of a kidnapped,
the owner of the stolen house, or the
extorted by corrupted officials would have to
request prior authorization of the Criminal
Judge to tape or film the evidence of the
commission of those crimes.
Third party rights:
In fact, what is unconstitutional and, obviously,
illegal, is to tape conversations of THIRD
PARTIES, aliens to the one that tapes or films,
who, in these hypothesis is eavesdropper and
not speaker. Thus, I cannot eavesdrop the
telephone calls that another person does from
his home or office telephone, tape them and
divulge them, because, simply and clearly, in
those cases I am not a speaker; consequently,
the same prohibition that exists with respect to
an individual, is even bigger with respect to
prosecutors or police officers, who, in that
case, must request prior authorization to the
Criminal Judge.
However, I can LEGALLY tape all my
conversations or interviews in which I am a
speaker; and, then, if I would like to, disclose
them. Unfortunately, the judges of the
Supreme Court of Justice and of the
Constitutional Court that Ecuador has and has
had, characterized by their low quality with
unusual exceptions, have never worried about
issuing sentences establishing these points;
for that reason, as there is a lack of national
jurisprudence, the research on Restrictive
Measures on fundamental rights by the
Spanish judge Manuel Estrella Ruiz can be
consulted, including the communications
eavesdropping; and the judgment of the
Spanish Constitutional Court 114/1984 in
which it is clearly affirmed that "the disclosure

Ecuador debe dejarse de lado una sesgada
forma de “razonamiento lógico”, según el cual,
la conclusión lógica es buena o mala
dependiendo de la persona a quien afecta o
beneficia. Para ello, algunos medios de
comunicación deben dejar de buscar sustento
para su información en la opinión de seudo
juristas que, aunque hayan ocupado altas
funciones, jamás se han preocupado de
investigar o, al menos, pensar, antes de decir
lo que dicen.
LA VALORACIÓN DE LA
PROPIEDAD INMOBILIARIA Y SU
TRIBUTACIÓN

elevar significativamente los ingresos
municipales y aliviar la carga fiscal.
De un tiempo atrás, en respuesta a la
corriente privatizadora que en nuestro país
condujo a la venta de algunas empresas
estatales, a la influencia negativa que en los
precios de un importante número de activos
causó en sus inicios la dolarización de la
economía, a la necesidad que tienen los
administradores, propietarios y/o los
accionistas de conocer los patrimonios de las
empresas de sus respectivos intereses o al
menos los valores económicos o comerciales
de los bienes raíces de esas firmas, y en
razón de que, en concordancia con lo que
dispone la Ley Orgánica de Régimen
Municipal, los municipios deben valorar los
inmuebles urbanos y rurales de sus
jurisdicciones para finalmente calcular los
montos de los impuestos prediales que deben
recaudar, ha venido cobrando importancia la
valoración de la propiedad inmobiliaria y
dentro de ella, la urbana que, en nuestro

APPRAISEMENT AND ITS
TAXATION

increase considerably the municipal incomes
and mitigate the fiscal duty.
In answer to the privatization flow that
in our country has lead to the sale of
some state entities, to the negative influence
that the dollarization of the economy caused at
the beginning to the prices of an important
number of assets, to the need that the
administrators, owners and/or the
shareholders have for knowing the
patrimonies of the enterprises of their
respective interests or at least the
economic or commercial values of the
real estate of those companies, and as,
according with the provisions of the
Basic Law of the Municipal Regime, the
municipalities should appraise the urban
and rural real estate of their jurisdictions
in order to finally calculate the amounts of
the property taxes that they should
collect, the real estate appraisement has
gained importance lately and within it , the one
of the urban property that, in our society,

valores económicos de los inmuebles,
inclusive sin esperar que los ciudadanos se
acerquen hasta sus ventanillas a detallar las
mejoras ilegales que han introducido en sus
propiedades, merece preguntar: ¿qué es la
valoración y qué el valor comercial?
La valoración, valuación o tasación, como
también se denomina es, en pocas palabras,
la técnica que basándose en el análisis de las
características y condiciones que tiene y se
encuentra el bien o la explotación que se
valora, en los servicios y beneficios que
genera o puede generar así como en los
precios referenciales o en los costos de
fabricación, construcción o de producción,
permite calcular el valor económico de ese
bien o explotación en el momento en el que
son inspeccionados y no en ningún otro en el
que existan condiciones diferentes.
El valor comercial es, en consecuencia, la
cuantía que por los servicios y/o las rentas
que produce, alcanza o alcanzaría libremente
un bien o una explotación en el mercado
cuando es o puede ser puesto en venta y
puede coincidir con el costo de fabricación o
producción de ese bien o explotación como
con su precio.
Por este concepto de valor comercial, que
concuerda con el principio de que las cosas
valen por su utilidad o rareza, se deduce que
–esta cuantía– no permanece fija en el tiempo
ni es igual en todos los lugares ni, por tanto,
que el valor económico de una edificación,
aunque sea nueva y esté técnicamente
construida, no solo depende de su costo de
construcción como equivocadamente acepta
un importante número de personas que hacen
avalúos sino además, de otros factores
llamados determinantes del valor comercial

exploitation has, on the services and
benefits that it generates or can generate as
well as on the referral prices or on the
manufacturing, construction or production
costs, allows to calculate the economic value
of that good or exploitation at the moment in
which they are examined and not in another in
which different conditions exist.
Consequently, the commercial value is the
amount that a good or exploitation
reaches or may reach in the market
without restraint, when it is or may be for sale,
for the services and/or the incomes that
it produces, and it can match the cost of
manufacturing or production as well as
with its price.
Due to this definition of commercial value, that
is consistent with the principle that things are
worth for their use or peculiarity, it is deduced
that –this amount involved– does not remain
fixed in time and it is not equal everywhere;
therefore, the economic value of a building,
although it is new and technically built,
does not depend only on its construction cost
as an important number of people who made
appraisement wrongly recognize but
additionally, of other factors so called
decisive factors of the commercial value

El recordar que hace más de una década
varias ampliaciones ilegales pero
técnicamente construidas en algunas
residencias fueron –con acierto– derrocadas
por órdenes de la Alcaldía de la ciudad de
Guayaquil y que, asimismo hace alrededor de
una década, en el sector norte de la ciudad de
Quito se fue al suelo un edificio que estuvo en
construcción, demuestra lo dicho en relación
con el influjo que ejercen los anotados
determinantes del valor comercial. Aún más,
como todo desalojo de materiales inservibles
encarece el aprovechamiento del suelo, es de
deducir que los valores comerciales de esos
inmuebles –antes de los derrocamientos y/o
de la caída de la citada obra civil– debieron
ser inferiores a los que pudieron alcanzar sus
correspondientes terrenos.
En este mismo tema y en base del principio
aritmético de que el todo es igual a la suma de
sus partes es de agregar que en las
ocasiones en las que debido a la falta de
demanda no es factible tener alguna
información oportuna sobre los valores
económicos que fija el mercado a los
inmuebles que se estudian, a sus similares o
a sus retadores y cuando sus componentes
básicos –tierra, obras civiles, explotaciones
agropecuarias y maquinaria y equipos,
tratándose de las propiedades rústicas– sirven

produciendo rentas, los valores comerciales
de estas propiedades rurales pueden ser
obtenidos a partir de los que alcanzan cada
uno de los citados componentes, como ocurre
con los cultivos tiernos técnicamente
introducidos.
Un obstáculo legal y una sugerencia a la
gestión municipal
El mencionado valor económico es distinto a
lo que equivocadamente consta en la citada
Ley de Régimen Municipal porque, como se
anotó, es confundido con el costo de
construcción –que es la suma que se ha
gastado o requiere invertir para hacer una
cosa o una obra civil– y con el precio –que es
la cuantía que libremente se acepta al

when their basic components –land, civil
works, agricultural exploitations and
machinery and equipments, when talking
about rural properties– are actually useful and
produce or there is a high possibility that they
will generate or they will continue producing
incomes, the commercial values of these rural
properties can be obtained from the addition of
each one of the said components, as it occurs
with the tender cultivations technically
introduced.
A legal obstacle and a suggestion to the
municipal operation
The abovementioned economic value is
different from what is wrongly evident in the
cited Law of the Municipal Regime because,
as it was expressed, it is confused with the
construction cost –which is the total that has
been spent or required to invest to do a thing
or a civil work– and with the price –which is
the amount freely accepted at the moment

permanentemente actualizaran los
presupuestos de construcción y si en base de
razones técnicas determinaran qué métodos
se deben aplicar cuando no es posible
conocer a tiempo los precios que fija la
demanda a los bienes que se valoran o a sus
similares y retadores, estos Departamentos
podrían estar únicamente constituidos por
técnicos relacionados con la construcción de
estas obras civiles simples.
Pero, considerando que en las grandes urbes,
aparte de la tierra existe una gran variedad de
edificaciones que poseen máquinas y equipos
especiales cuyas formas de operar y
mantener son desconocidos por estos
profesionales de la construcción y, además,
como en el sector rural, a las referidas
máquinas y equipos especiales, se agregan la
maquinaria y las explotaciones agropecuarias,
los municipios, para actualizar sus catastros
y/o valorar la propiedad inmobiliaria deberían
contratar a los avaluadores experimentados
que sean necesarios.
Los efectos tributarios que causa la
inadecuada valoración.
En relación con las cuantías de los impuestos
prediales es de señalar que, en vista de que la
recalcada Ley de Régimen Municipal posee
errores que inciden negativamente en la
valoración de la propiedad inmobiliaria, esas
sumas no responden a la realidad y por lo
común tienen que ser bajas. El poder

El Art. 23, numeral 3 de la Constitución
Política de la República del Ecuador,

Por su parte el Art. 35 ejusdem, establece que
el trabajo es un derecho y un deber social
que gozará de la protección del Estado.
Por lo tanto, siendo todos iguales ante la Ley,
gozando de las mismas oportunidades y
protección del Estado, resultaba
discriminatorio que personas que adolecen de
alguna discapacidad, no tengan las mismas
oportunidades laborales frente a las demás
personas no afectadas con alguna
discapacidad.
El Art. 53 de la Constitución, expresa que es
obligación del Estado, establecer las
“medidas que garanticen a las personas con
discapacidad, la utilización de bienes y
servicios, especialmente en las áreas de
salud, educación, capacitación, inserción
laboral y recreación; y medidas que eliminen
las barreras de comunicación, así como las
urbanísticas, arquitectónicas y de
accesibilidad al transporte, que dificulten su
movilización. Los municipios tendrán la
obligación de adoptar estas medidas en el

cumple con un juicio lógico, pero el
error en que incurra puede traducirse en
un vicio en el procedimiento, en la motivación
de la sentencia o en un vicio material cuando
no obstante la corrección formal del fallo
existe error en la decisión del fondo del
asunto.
Inobservancia en este caso fue el problema.
Inobservancia significa desconocimiento,
desobediencia o falta de aplicación de la
norma jurídica. No se trata de un error en el
modo de aplicarla, sino de una omisión de
cumplirla. Errónea aplicación es la
inadecuación o falta de correspondencia de la
norma aplicada con el caso concreto, es decir,
una norma es observado o cumplida, pero no
es la que debía aplicarse, o es aplicada con
una mala interpretación de su mandato. En
definitiva, la errónea aplicación implicaría
siempre una inobservancia, y viceversa.
La violación del debido proceso se traduce en
una contravención al comportamiento exterior
que el Juez o las partes debían observar al
cumplir su actividad: En este caso, el Tribunal
de Casación cumple un verdadero examen
fáctico en tanto debe examinar la conducta
concretamente observada en el proceso por

JURISPRUDENCE
REQUIREMENTS FOR THE

SUPREME COURT

Non-observance means ignorance,
disobedience or lack of application of the legal

behavior concretely observed in the process

RESOLUCION DEL TRIBUNAL
SUPREMO ELECTORAL CON
RELACIÓN A LA ASAMBLEA
CONSTITUYENTE
Como es de conocimiento público, estamos
próximos a participar en el proceso electoral,
encaminado a la elección de los miembros de
la Asamblea Constituyente, con este propósito
el Tribunal Supremo Electoral, ha tomado en
consideración que la Asamblea Constituyente
es un procedimiento especial que se
diferencia claramente de las elecciones
pluripersonales ordinarias, razón por la cual
este Organismo resolvió omitir la aplicación de
los Artículos 35,36,37 de la Ley Orgánica de
Partidos Políticos los cuales determinan:
Art. 35.- Establece, entre otras la causales
para la extinción de un partido político el
hecho de no haber obtenido el porcentaje
mínimo de 5% de votos válidos en dos
elecciones pluripersonales nacionales
sucesivas y por no haber participado en un
evento electoral al menos en diez provincias.
Art. 36.- Prescribe que el Tribunal Supremo
Electoral es el único organismo que puede

DECISION OF THE SUPREME
ELECTORAL COURT IN
RELATION TO THE CONSTITUENT
ASSEMBLY
As it is of public knowledge, we are just about
to participate in the electoral process, directed
to the appointment of the members of the
Constituent Assembly, with this purpose the
Supreme Electoral Court, has taken into
consideration that the Constituent Assembly is
a special procedure that clearly differentiates
itself from ordinary multi-personal elections,
reason by which this Agency resolved to omit
the application of Articles 35, 36, 37 of the
Basic Law of Political Parties which
determines:
Art. 35.- It establishes, among other grounds
for the extinction of a political party, the fact of
not having obtained the minimum percentage
of 5% of valid votes in two multi-personal
national successive elections and by not
having participated in an electoral event at
least in ten provinces.
Art. 36.- It prescribes that the Supreme
