21 ANSWER AND CRIMINAL COMPLAINT

23 I, Mason-el, Tex - Lee, issue of God/Allah, in full life domiciling on the land, am the heir

24 and Beneficiary to the Estate, being of the full age of majority, and of sound mind, and

25 competent does affirm and request that the court take judicial notice of the facts as stated:

26 1. I have seen no evidence of injury

27 2. I have seen no evidence of property damage

4. The JohnDoe(County Attorney) is making a false claim, by accusing me of committing a

crime, and is guilty of committing a crime against me, crime himself.

5.The accusations of a crime, made by NAME, is a false allegation.

6. A crime may not legally exist without substance, and I have not, at any time given my consent

to be the surety for a contract obligation, brought forward by an County Attorney, acting as an
7
Agent, for a corporate fiction, who does not have proper standing.
8 a. Supreme courts ruled “Without Corpus delicti there can be no crime”“In every prosecution
9 for crime it is necessary to establish the “corpus delecti”, i.e., the body or elements of the
10 crime.” People v. Lopez, 62 Ca.Rptr. 47, 254 C.A.2d 185.

11 7. The basic principles of law require that for a crime to exist, their must exist a proper accuser,

12 an injured party, and/or damage to property.

13 a. “As a general principal, standing to invoke the judicial process requires an actual
justiciable controversy as to which the complainant has a real interest in the ultimate
14
adjudication because he or she has either suffered or is about to suffer an injury. ” People
15
v. Superior Court, 126 Cal.Rptr.2d 793.

8. The attorney does not represent the injured party, nor does the attorney represent a living
17 Man, with rights to pursue a criminal accusation. The attorney is acting as an agent for a
18 fiction, perpetuating fraud, to conceal his own interest. This is a misrepresentation. There is no
19 substance in fiction, as it only exists in the mind of men.
20 9. An attorney, who is a trained professional in the law, certainly understands the legal elements
21 that must be present, for a crime to exist.
22 10. The attorney knows that a legal fiction, lacks proper standing to bring a criminal complaint
23 against any Man, because a fiction is corporate and a Man is living, which violates of the legal

24 principle of standing, defining whether or not the party may even bring the alleged complaint.

25 11. "Persons dealing with the government are charged with knowing government statutes and

26 regulations, and they assume the risk that government agents may exceed their authority and

27 provide misinformation." Ninth Circuit Court of Appeals, Lavin v Marsh, 644 f.2D 1378, (1981).
12. The attorney bringing the false claim, has full knowledge that reliance on the undisclosed

information, would result in the Man being mislead into making a plea, which would otherwise
be technically incorrect, void ab initio.

a. "For a crime to exist, there must be an injured party. A crime in law requires a corpus

delectii and a corporation cannot be the body of the crime or an injured party. "There can be

no sanction or penalty imposed on one because of this exercise of Constitutional rights."

9 13. The DEFENDANTS have a financial motive to commit fraud....benefits, have been receiving
10 payments from the Attorney NAME, wheree ....
11 The criminal complaint number 123456 brought by ATTORNEY, is a false claim, and the
12 continued perpetuation of these proceedings is Fraud, and the basis upon which all assert my
13 counter-claims herewith, for the following violations of law:
14 14. Perjury in violation of 18 U.S.C. § 1621;

15 15. Perjury in violation of 18 U.S.C. § 1623;

16 16. Obstruction of Justice -- Conspiracy to Defraud United States -- 18 U.S.C. § 371;

17 17. Obstruction of Justice and Witness Tampering -- 18 U.S.C. § 1503;
