JOINT AFFIDAVIT OF DESISTANCE

We, MA. AMOR SALANGUIT and RONILO B. MANINANG, of both

of legal age and with office address at Export and Industry
Bank, Export Bank Plaza, Chino Roces Avenue corner Sen. Gil.
Puyat Avenue, Makati City, under oath, depose and state:

1. We are the duly authorized representatives of the

private complainant, Export and Industry Bank in the above-
mentioned cases.

2. In our capacity as the bank’s representative in

the afore-mentioned cases, we acted as the bank’s witnesses
in the above-mentioned cases.

3. Our testimonies were taken during the hearing

conducted on November 12, 2001 and October 8, 2002,
respectively.

4. After our said testimonies, we and the accused,

Manuel H. Reyes, conducted a joint audit of the latter’s
account with the private complainant bank and it was found
out that said accused no longer has any obligation with the
bank in connection with the checks subject matter of the
above-mentioned criminal cases.

5. Hence, the filing of the above-mentioned criminal

cases was due mainly to misapprehension of facts on our
part.

6. In view of the foregoing, the private complainant

Export and Industry Bank, through the undersigned acting as
its authorized representatives, hereby desists from the
further prosecution of the above-mentioned criminal cases
and further requests for its dismissal.
 7. The private complainant Export and Industry Bank,
through the undersigned acting as its authorized
representatives, likewise requests for the withdrawal of all
documentary exhibits previously presented and offered by
private complainant, thru the undersigned, as well as the
withdrawal of the testimonies of the undersigned in the
above mentioned criminal cases.

8. We are executing this Affidavit of Desistance for

the purpose of seeking the dismissal of the above-mentioned
criminal cases and for whatever legal purposes it may serve.

IN WITNESS WHEREOF, we have hereunto fixed our

signatures on this 6th day of April 2006 at Makati City,
Philippines.
