According to the Florida Statutes for expungements and sealings (§§ 943.0858, 943.059), a
defendant is automatically disqualified from expunging or sealing their criminal history record,
regardless of whether Adjudication was Withheld, when the case involves any of the offenses
listed below and:
(i) The defendant was found guilty of the offense charged;
(iii) The defendant pled nolo contendere (i.e., no contest) to the offense charged;
(iv) The defendant was a minor (i.e., juvenile) and was found to have committed the offense
as a delinquent act;
(v) The defendant was a minor (i.e., juvenile) and pled guilty to the offense charged; or
(vi) The defendant was a minor (i.e., juvenile) and pled nolo contendere (i.e., no contest) to
